Co.KGMSExtum,whoownedandoperatedthecargoshipBBCMagellan,pleadedguiltyon
Tuesdaytofailuretomaintainanaccurateoilrecordbookandtamperingwithwitnessesby
persuadingthemtoprovidefalsestatementstotheU.S.CoastGuardconcerningabypasshoseon
thevesselthatwasbeingusedtodischargeoilintothesea.
Thetwocompaniesweresentencedtopayatotalof$1.25millioninfinesanda$250,000community
servicepaymenttotheNationalFishandWildlifeFoundationtofundprojectsthatenhancecoastal
habitatsoftheGulfofMexicoandbolsterpriorityfishandwildlifepopulations.
Inaddition,theshipBBCMagellanisbannedfromdoingbusinessintheUnitedStatesforthenext
fiveyears.
ThepleasandsentenceswereannouncedbyAssistantAttorneyGeneralJohnC.Crudenforthe
JusticeDepartmentsEnvironmentalandNaturalResourcesDivisionandActingU.S.Attorney
ChristopherP.CanovafortheNorthernDistrictofFlorida.
InMarch2015,duringaninspectionatthePortofPensacola,theU.S.CoastGuarddiscoveredan
improperlyattachedrubberhose.Officialslaterdeterminedthat,betweenJanuaryandMarch2015,
thecrewoftheBBCMagellan,actingonbehalfofthevesselsowner,hadinstalledandillegallyused
therubberhosetoremoveoilywastesfromthevesselsholdingtanksanddischargedthemdirectly
intotheocean.
Thecrewalsofailedtomaketherequiredentriesinthevesselsoilrecordbook.Whenquestioned
aboutthehosespurposeandhowoilywastesweredischargedfromtheship,thechiefengineer
instructedothercrewmemberstolietotheCoastGuard.
Shippingcompaniesthattransportcommerceacrossopenseasmustrespecttheinternationallaws
andobligationsoftheirtrade,whichexisttopreventthespoilingofoceansandmarinehabitat,said
AssistantAttorneyGeneralCruden.Thisegregiousbehaviorbyshippingcompanies,whichincluded
intentionaldeceptionandwitnesstampering,willnotbetolerated.Wewillcontinuetoprosecute
companiesandtheirofficersforthesecrimes.
ThecasewasinvestigatedbyU.S.CoastGuardSectorMobile,theU.S.CoastGuardInvestigative
ServiceandtheEPA.ThecasewasprosecutedbyAssistantU.S.AttorneyJ.RyanLoveforthe
NorthernDistrictofFloridaandTrialAttorneyBrandyN.ParkeroftheEnvironmentalCrimesSection
oftheDepartmentofJusticeEnvironmentalandNaturalResourcesDivision.
