Case Study
The Duck Boat Case

On the evening of July 19, 2018, a duck boat operated by Ride the Ducks sank on Table Rock Lake
in the Ozarks near Branson, Missouri, in the United States. The amphibious vehicle sank with 31
people on board, leaving 17 dead, during high winds associated with nearby severe thunderstorms.

Do some brief research on the internet and answer the following questions:

1. What the heck is a “duck boat”? (1 pt)

Ans- The Duck Boat (also Called DUKW) is an Amphibious Vehicle with wheels as well as
water able vehicle. It was in use by the United States of America’s military and its accomplices
in the late extensive stretches of 2nd world war and as well as the Korean War. The vehicle
basically is able to run on the road and in the waterbodies as well. Later after the end of Korean
War, a veteran in Minnesota began a business of giving rides to the people. This was basically a
vehicle with the ability to run on the roads and sail in the waters.
2. After reading chapter 4, was the duck boat company negligent? Support your answer. (5
pts)

Ans- Here in the instant case, Boat association was thoughtless. National Weather Service which
updates about the weather conditions, had given warnings of genuine rainstorm forewarning to
the districts which were around the lake an hour before this accident took place. National
Weather Service department that day reported breezes close by. It was noted that the wind was
moving excess of 60 miles every hour, and the whirlwind was moving quickly and causing three-
foot waves on the lake over the lake. In November 2019, the National Transportation Safety
Board conveyed a "Security Recommendation Report" on the setback. The report makes
reference to that the Coast Guard had on and on dismissed prosperity proposition that may have
made voyager duck boats safer and potentially prevented the mishap. The NTSB had at this point
given strong alarms about the arrangement of the vehicles and the danger introduced to explorers
by their vertical asylums of the boat. Beside all above, none of the explorers or group were
wearing a day by day presence coat in the boat which was a remarkable pass for Boat
association.
The recently referenced reality obviously communicates the truth of heedlessness as for Boat
Company.

3. How was this case settled? (2 pts)

Ans- An administration guarantee was recorded in 2018, for around US$100 million to serve
people from an Indiana family. They had lost nine people in the disaster. Here the suit faults the
boat company for ignoring the warnings that had been given by NTSB concerning the
environment before the faitful incident occurred as well as using the boat with defects in its
structure. In 2019, a settlement took place by relatives of the two people from Indiana’s family.
An additional administration guarantee was recorded in 2018 by Tia Coleman, who was out of
station when the boat accident took place. Coleman's husband and three child were killed in the
same. She filed an additional lawsuit. In 2018, a mysterious settlement took place with Ripley
Entertainment. In the settlement, it was decided to serve two young ladies of a couple from
Higginsville, Missouri. They were having their 45th wedding remembrance when they were on
the duck boat ride. In 2020, the last suit which was against Ripley Entertainment was consented
to an undisclosed total. By and large, 31 cases were archived against the association, with all
being consented to undisclosed aggregates.
4. Why do you think the case never went to court? (4 pts)

Ans- Here in the instant case, it never went to the court because the courts didn't have the domain
over the case. An administration judge found that Table Rock Lake was undependable, or, as
such that it doesn't maintain business activity. The capability was critical: Under United States
chief of naval operations' office guideline, criminal allegations like the ones brought against the
three men perhaps apply in government court accepting the stream whereupon the bad behavior
is professed to have happened is viewed as navigable. Consequently, this case never went to
court.

5. The duck boat company has a connection to the Niagara area. What is it? (2 pts)

ANS- The family of Tia Coleman, her husband and three children were killed in the same
accident. They were the Nigerian family and the connection of the Duck boat company to
Niagara Is the people of Tia Coleman’s family.
