COMPLAINT-AFFIDAVIT

I, Ignatius Ortega, Filipino, of legal age, with assistance of counsel

and a resident of #49 Matimtiman St., Brgy. Teachers Village-East,
Diliman, Quezon City after having been duly sworn to in accordance with
law, say:

1. That I am the Police Chief Inspector of Quezon City Police District

with headquarters at Maginhawa St., Brgy. Sikatuna Village, Diliman,
Quezon City;

2. That on August 29, 2016, I received information that a certain BERTO

DIMAGIBA has in his possession firearms and ammunition without
having license to possess the same;

3. That a witness, Emerlinda Santos, executed an affidavit attesting that

BERTO DIMAGIBA tried to pawn a .38 caliber revolver to her on
May 2013. A copy of the affidavit is attached as Annex A-1;

4. That another witness, Rocky Dela Rosa, executed an affidavit

attesting that he saw BERTO DIMAGIBA opening fire at the sky
using a revolver on the night of December 31, 2015. A copy of the
affidavit is attached as Annex A-2;

5. That SPO3 Terry Ohio, another witness, executed an affidavit

attesting that while he was patrolling in Don Antonio Heights on the
night of December 31, 2015, he heard two popping sounds in quick
succession and immediately saw BERTO DIMAGIBA running away.
A copy of the affidavit is attached as Annex A-3;

 6. That after procuring Search Warrant No. 87000, dated 03 September
2016, and having executed it, found and seized two (2) cal. 38
revolvers and ammunition for said gun;

7. That verification made with the Provincial Firearms and Explosive

Office in Camp Crame Quezon City, showed that subject is not
included in the list of bonafide licensed firearms holder in Quezon
City or anywhere in the Philippines;

8. That I accuse and hereby charge BERTO DIMAGIBA, residing at #5

Don Victorino St, Don Antonio Heights, Novaliches, Quezon City, of
violating RA 10591 for illegal possession of firearms;

9. That I am executing this affidavit to attest to the truth of all the

foregoing allegations and to serve as basis for the filing of a complaint
against Berto Dimagiba for Illegal Possession of Firearms as may be
found applicable.
