1. PlaintiffisaFilipino,oflegalage,married,andresidingatNo.11CamdasSubd.,BaguioCity,wherehemaybe
servedwithsummons,papersandotherprocessofthisHonorableCourtACOPLawFirm,Suite704,LANDCO
Bldg,KisadRd,BaguioCity.

2. DefendantAurelioLaxaisaFilipino,oflegalage,single,andresidingatNo.55,Trancoville,BaguioCity,where
hemaybeservedwithsummons,papersandotherprocessofthisHonorableCourt.

3. DefendantBonifacioCruzisaFilipino,oflegalage,married,andresidingatNo.78LeonilaHill,BaguioCity,
wherehemaybeservedwithsummons,papersandotherprocessofthisHonorableCourt.

4. DefendantULTRASpeedMachineShopandAsMetalProductsisajuridicalentitydulyregisteredwiththe
Securities and Exchange Commission. It is engaged in the selling metal products and Auto Repair. It is
representedhereinbyAurelioLara,ownerandmanagerofULTRASpeedMachineShopandAsMetalProducts.
ItmaybeservedwithpapersandotherprocessesofthisHonorableCourtatNo.131WestQuirinoHill,Baguio
City.

5. DefendantAurelioLaraisaFilipino,oflegalage,married,andresidingatNo.131WestQuirinoHill,Baguio
City,wherehemaybeservedwithsummons,papersandotherprocessofthisHonorableCourt.

6. Bothpartieshavecapacitytosueandtobesued.

7. Plaintiffhereinisthewifeofvictimofthevehicularaccident,RomeoTuadleswhoisthesolebreadwinnerofthe
family.

9. DefendantULTRASpeedMachineShopandAsMetalProductsownedbyAurelioLarahaslegalpossessionof
thevehicleandbounditselfbyanacknowledgmentattachedherewithAnnexA,toberesponsibleforanyand
allincidentsthatmayoccurwhilethesaidvehicleisintheircustody.
10. DefendantAurelioLaraistheemployerofAurelioLaxa,beingtheownerofULTRASpeedMachineShopand
AsMetalProducts.

11. OnApril29,2019,BonifacioCruzbroughthisvehicletoULTRASpeedMachineShopandAsMetalProducts
byAurelioLaraforrepairandleftthesaidvehicleattheshop.

12. AtaboutMay2,2019,AurelioLaxa,adriverofAsMetalProductswithhiscoworkersonboarddrovethe
vehicleingoingtothebeach.

13. Indrivingbackfromthebeach,AurelioLaxalostcontrolofthevehiclewhilenegotiatingacurvecausingitto
turnturtleresultinginthedeathofoneofitspassengersRomeoTuadles.

14. Ademandletterforindemnificationfordamageswasbyplaintifftodefendants.

15. DefendantBonifacioCruzpromptlydeniedliabilityforreasonthathisvehiclewasusedanddrivenwithouthis
knowledgeandconsentbyAurelioTuadlesatthetimeoftheaccident.

16. AsaresultofthedeathofRomeoTuadles,hisfamilyisinfinancialdifficultiesbecausetheydependonhimasa
solewageearnerinthefamily.Hence,theymustbemadetopayfordamagesforthedeathofRomeoTuadles,in
theamountequivalenttoFIVEHUNDREDTHROUSANDPESOS(P500,000.00).

17. DuetothesuddendeathofRomeoTuadles,hiswifeandchildrensufferedmentalanguishandseriousanxiety.

18. Consequently,Plaintiffwasconstrainedtoengagetheservicesofcounseltowhomitobligateditselftopayas
Attorney'sFeestheamountequivalenttoTWENTYFIVEPERCENT(25%)ofthetotalamounttobeadjudgedin
favorofplaintiffs,andthecostsofthissuit.

PRAYER

WHEREFORE, theabovepremisesconsidered,itisrespectfullyprayedofthisHonorableCourtafter
hearingonthemerits,that:

a. Defendants be ordered to pay for damages for death in the amount of FIVE HUNDRED
THROUSANDPESOS.

b. DefendantsbeorderedtopaymoraldamagesintheamountofFIVEHUNDREDTHOUSAND
PESOS(Php500,000.00);

c. Defendants be ordered to pay attorneys fees in an amount equivalent to TWENTY FIVE

PERCENT(25%)ofthetotalamounttobeadjudgedinfavorofplaintiffs;

d. Defendantsbeorderedtopaythecostsofthissuit.

Otherreliefsjustandequitableunderthepremisesarelikewiseprayedfor.
