JUDICIAL AFFIDAVIT OF GRACE RABANAL

I, GRACE RABANAL, of legal age, single, and living at Bengao, Marcos Highway,
Baguio City, the witness in this case, state under oath as follows:

PRELIMINARY STATEMENT
The person examining me is Atty. Mae Ann Y. Badua with office address at 6th floor,
Alviar Tower Building, Baguio City. The examination is being held at the same address. I
am answering her questions fully conscious that I do so under oath and may face criminal
liability or false testimony and perjury.

PURPOSE: This testimony of plaintiff Rose Hermosa is being offered to prove that a
vehicular accident along Marcos Highway, Baguio City transpired in her presence in full
view upon which she saw the plate number of the vehicle involved and its appearance.

The questions asked by my counsel and the answer I gave are as follows, to wit;

Q1: Please state your name and other personal circumstances.

A1: I am Grace Rabanal of legal age, single and a resident of Bengao, Marcos Highway
Q2: Are you the same as the Grace Rabanal as the witness in the above case?
A2: Yes.
Q3: Where were you on the day of October 21, 2015 at about 4:00 AM?
A3: I was at my stall in front of Mamitas restaurant.
Q4: What were you doing there?
A4: I was selling cigarettes and candies.
Q5: Can you describe the place?
A5: The place is well lit and with pedestrian lane, there were an ample amount of signs
for caution to the vehicles that passed by.
Q6: While selling, what happened next?
A6: I saw a vehicle approaching.
Q7: How would you describe the movement of the vehicle?
A7: The car was approaching at a high speed.
Q8: What type of vehicle was approaching?
A8: The vehicle was a royal blue Toyota Fortuner.
Q9: What happened to the Royal blue Toyota Fortuner that was approaching?
A9: The vehicle swerved to the opposite lane and to the sidewalk where the victim
Domingo Salazar was standing.
Q10: What happened next?
A10: He was hit by the vehicle.
Q11: After the incident, what did the driver of the Royal blue Toyota Fortuner do?
A11: The Defendant went outside of his vehicle to seemingly check on the plaintiff .
Q12: What did you do next?
A12: Just like everyone else I went near the incident however the Defendant immediately
went back to his vehicle upon seeing people already closing in and drove off in a hurry.
Q13: Were you able to positively identify the Defendant?
A13: Yes.

I also attest that the attachments of this Judicial Affidavit are faithful reproductions of
their corresponding original copies.
