LEAVE RULES
IREC Vol.-I (Edition 1995)
Railway Rule 501 to 557

These rules may be called the railway servant (Liberalise Leave) Rules-1949)
502 These rules shall apply to (i) Railway Servant appointed on or after 01.02.1949
(ii) Railway Servants appointed prior to 01.02.1949 who have elect to be
governed by these rules. (iii) Other who are brought under these rules by special
order.
503 Leave cannot be claim as a right. It may refused or revoked by the authority
competent to grant such leave.
505 It shall not be open to alter the kind of leave applied by employee. It can be
altered at the written request of employee within 30 days from the date employed
join duty. (RB No. F(E)III/98/LE-1/1 dated 05.02.1998)
507 Except as proved other wise under leave rule any kind of leave may be granted in
combination with any other kind of leave.
510 No Railway Servant shall be granted leave of any kind for continuous period
exceeding five years.
523 LEAVE ON AVERAGE PAY
Railway Servant shall be entitled to 30 days leave on average pay in a calendar
year. It shall be credited in advance. It is credited in 2 installments of 15 days
each on the 1st January and 1st July of every calendar year. LAP shall be credited
at the rate of 2 days for each completed months.
The maximum leave can be accumulated up to 300 days + 15 of current half year
w.e.f. 01.07.1997 (RB No. F(E)III/97/LE-1/03 dated 10.11.1997).
524 Maximum Average pay leave may be granted is 180 days at a time. If employee is
on EOL/LWOP/Absent from duty during previous half year, the credit of next
half year shall be reduced by 1/10 of the period of such absent/EOL subject to
maximum 15 days in one half of the year.
While affording credit of LAP fraction of day shall be rounded off to the nearest
day (RB No. E(P&A)1-96/CPC/LE-5 dated 07.02.1997)
525 Railway Servant serving in Railway School shall be credited to 5 days each of the
half year on 1st January and 1st July of every calendar year. If the period is
availed as EOL/Absent/Dies non the credit in next half year shall be reduced by
1/30 of the period of such EOL/Absent/Dies-non subject to maximum of 5 days.
If School Teacher is appointed/ceases to be in service shall be allowed @ 5/6 days
for each completed month in the half year in which appointed. If Railway School
staff avails portion of vacation he/she shall be entitled to LAP in such proportion
of 30 days as the number of days of vacation not availed during full vacation. If
Railway Servant does not avail himself any vacation, LAP shall be admissible to
him maximum as due in that year under Rule 523/RI. Provided leave taken in
conjunction shall not exceeds 300 days.
526 LEAVE ON HALF AVERAGE PAY
It can be granted to Railway Servants on half average pay. It shall be credited in
leave account in 2 installments 10 days each of the half year on 1st January and
1st July in advance. The amount of LHAP can be availed in one spell combined

with any other kind of leave or not shall be limited to 24 months. This leave may
be granted on Medical Certificate or private affairs or at the request of employee.
It can be accumulated in Leave Account unlimited.
LHAP is not admissible to Railway School Staff. (RB No. E(P&A)1-92/CPC/LE-
3 dated 04.12.1992) * 20 days LHAP has been restored to
Headmasters/Principal/ Teachers of Rly. Schools in lieu of 10 days LAP w.e.f.
1.09.2008(*[Link]: E(P&A) 1-2008/CPC/LE-10 dt. 06.03.2009, RBE
NO: 46/2009)

If an employee remain absent or under suspension and the period is treated as No


work (without pay) than 1/8 of that number of days will be deducted from
earning of LHAP. (RB No. E(P&A)1-85/JCM/NC/3 dated 09.03.1988)
527 COMMUTTED LEAVE
It can be granted on Medical Certificate to Railway Servants. If authority
competent to grant such leave is satisfied that there is reasonable prospect of the
Railway Servant returning to duty on its expiry. Twice the amount of such leave
shall be debited against leave on half average pay. No limit to the number of days
of commuted leave to be availed during entire service.
180 days shall be allowed to be commuted during the entire service, in case
(LHAP) only utilized for approved course of study and is certified to in the
interest of Public interest.
Where commuted heave has been sanctioned and employee retire/resign from
service without returning the duty, the commuted leave shall treated as half
average pay and difference between the leave salary be recovered. Provided that
retirement is thrust upon employee compulsorily and due to ill health no leave
salary shall be recovered. Commuted leave may be granted at the request of
employee even LAP is due to him.
528 LEAVE NOT DUE
Leave not due may be granted to permanent Railway Servants. LND shall be
limited to leave half average pay which is likely to earn thereafter.
LND during the entire service shall be limited to 360 days on Medical Certificate,
out of which not more than 90 days at a time and 180 days in all in one spell.
LND shall be debited against LHAP account and is likely to earn subsequently.
Where Railway Servants who has been granted leave not due resign or retire
voluntarily fro service without returning duty leave salary be recovered
considering resignation or retirement is taking effect from the date on such leave
had commenced. If employee retirement is compulsorily thrust upon him by
reason of ill health and incapacitated Railway Servant for further service, no leave
salary shall be recovered.
529 LND shall be granted to temporary Railway Servant who has put in minimum one
year service and suffering from TB, Cancer, Leprosy etc. for 360 days during
entire service.
530 EXTRA ORDINARY LEAVE
Extra Ordinary Leave may be granted to a Railway Servant (a) No other leave is
admissible (b) Other leave is admissible but the Railway servant applies in writing
for the grant of extra ordinary leave (2) Unless the president in view of the

exceptional circumstances of the case otherwise no temporary Railway Servant


shall be granted EOL on one occasion is excess of three months to 24 months
depending upon his sickness (3) Two spells of EOL if intervened by any other
kind of leave shall be treated as one continuous spell of EOL (4) No limit in case
of permanent Railway Servant, but all kind If leave together, shall not be exceed 5
years in one spell at divisional or Railway level.
Grant of Extraordinary leave for study purpose of Probationers of Indian Railway
Medical Service. (RB No. 2001/E/GR/11/7/13 dated 26.03.2004)
531 Probationers in Railway shall be entitled to leave under these rules as if he had
held his post substantively otherwise than probationers provided that where such
person already hold lien on permanent post before such appointment, he shall be
entitled to leave under the rule as a permanent Railway Servant.
532 LEAVE TO SPL. CLASS RAILWAY APPRENTICES :
One month leave on full stipend may be granted. More than one months leave can
be granted on the grounds ill health but without stipend.
533 APP. MECH.
535 16 days full stipend leave may be granted. 20 days on half stipend on Medical
Certificate may be granted to App. Mech., ASM, Comml. Clerk, PWI, IOW, TXR
etc.
534 TRADE APP.
12 days leave may be granted on full stipend leave in a year. 15 days on half
stipend leave can be granted in a year.

LEAVE TO WORK SHOP STAFF :


539 Workshop staff may be allowed to take leave with pay, if due, or without pay for
period not less than half a day. The concession is restricted to six occasions in a
year.
540 LPR ( Leave Preparatory to Retirement )
If Railway Servants do not desire of leave encashment of LAP as the time of
retirement may be permitted by competent authority to take leave preparatory to
retirement to the extent of leave on average pay not exceeding 300 days together
with half average pay with the condition that it includes the day preceding the
date of retirement. But EOL should not includes.
540/A LEAVE ENCASHMENT (While in Service)
On implementation of 6th PC, provision of Leave Encashment while in service
has been introduced subject to following condition.
(a) Leave encashment will be subject to maximum 60 days in entire service.
(b) Maximum up to 10 days in one occasion, debited in the LAP A/c.
(c) Minimum balance of Leave in the A/c should be 30 days after encashment.
(d) One should avail his Pass on this A/C for getting the benefit of encashment.
(e) Encashment will be permissible every alternate year only.
(f) The encashment will not be deducted from the balance at the time of
encashment on Retirement A/c i.e one can avail a maximum of 300 (on
Retirement) +60 days (on Service) encashment in his entire service.
(g) Not entitled for HRA & Transportation allowance.

(i) Board has clarified that the PTO also includes in the term of Passes for
availing the Leave Encashment. (RBE NO: 194/2008 dt. 3.12.09)
(ii) Board further clarified that staff who are directly related with running of trains
viz Drivers, Guard etc & SMs ,ASMs should be exempted from availing of
10 days leave & Pass/PTO to encash their Leave. (RBE NO: 196/2008 dt.
12.12.08)
(iii) It has been decided to permit Rly. Servant to encash LAP upto 10 days
without any linkage to the number of days & nature of leave availed at the
time of availing Pass/ PTO. ( RBE NO: 14/2009 dt. 11.06.09)
(iv) It has been decided to withdraw the exemption granted vide Letter dated
12/12/2008 with immediate effect. Accordingly hence forth the category of
running staff, ASM etc. shall also have to fulfill all the conditions
prescribed for railway employees for the purpose of availing Encashment
of LAP upto 10 days while availing passes/ PTOs. (RB L. No.

544 A Railway Servant who proceed on or commuted leave is entitled to leave salary
equal to pay drawn immediately before proceeding on LAP. On half average pay
or LND is entitled to leave salary equal to half the amount as detailed above. On
extra ordinary leave he will not entitled to any leave salary.
549 CASH EQUIVALENT OF LEAVE SALARY (DEATH)
In case of death while in service the cash equivalent may be granted to deceased
employees family without any reduction leave admissible to him not exceeding
300 days on last pay drawn basis.

550 LEAVE ENCASHMENT ON RETIREMENT


(1) It has also been decided by the President that the existing provisions of
Railway Servants may be modified as follows in respect of Railway Servants.
(a) The benefit of leave encashment of unutilized leave on average pay shall
be payable upto maximum 300 days.
(b) retirement on superannuation.
(c) cases where the service of a Railway Servant has been extended in the interest
of public service beyond the date of retirement on superannuation.
(d) Vol. Retd Pre-matured retirement.
(e) Railway Servant are terminated by notice or by payment of pay and allowance
in view of notice or otherwise in accordance with the terms of his
appointment.
(f) Termination, re-employment
(g) Death of Railway Servant while in service.
(h) LPR on retirement.
(i) Transfer of Railway Servant to an industrial establishment.
(j) On absorption of a Railway Servant in a central public sector undertaking
autonomous body etc.
(2) A Railway Servant who resigns or quits service shall be entitled to cash
equivalent in respect of LAP at credit on the date of cessation of service to the

extant of half of such leave at his credit, subject to a maximum of 150 days.

All Railway Servant who retired on or after 30.09.1977 may be paid equivalent to
leave salary for leave on average pay at their credit at the time of retirement. It
shall be limited to maximum of 240 days LAP upto 30.06.1997 which is be raised
to 300 days w.e.f. 01.07.1997. It may be paid as one time lump sum payment on
settlement. Authority competent to grant such suo-moto issue order for granting
LAP at credit on the day of retirement. In case of compulsory retirement under
D&AR and pension as a consequence is reduced then leave encashment is not
payable. A Railway Servant who resign or quits service shall be entitled to cash
equivalent in respect of half the LAP at credit on the day on cessation of service
to the extent maximum of 150 days. (RB No. E(P&A)1-98/CPC/LE-6 dated
25.05.1999 & E(P&A)1-98/CPC/LE-6 dated 01.10.1999)

Consequent upon the decision taken by Government on the recommendation


of 6th CPC relating to encashment of leave in respect of both earned and
HAPL shall be considered subject to over all limit of 300 days. The cash
equivalent payable for HAPL shall be equal to leave salary as admissible for
HAPL + DA, without any reduction on account of pension or other
retirement benefits. The order shall take effect from 01/09/2008.(RBE No.
148/2008 dtd 08/10/2008)

SPECIAL KINDS OF LEAVE

551 MATERNITY LEAVE


A female Railway Servant with less than two surviving children may be granted
maternity leave for a period of 180 (RBE No. 158/2008) days from the date of
commencement. (RB No. E(P&A)1-97/CPC/LE-8 dated 23.10.2008)
During such period she may be paid salary drawn equal to pay drawn before
proceeding leave.
In case of Mis-carriage/Abortion it can be granted for 45 days in entire carrier of
service to female employee. The maternity leave may be supported by Medical
Certificate on application. (Rly Board No. E(P&A)1-94/CPC/LE-6 dated
28.04.1997)
In continuation of maternity leave any leave, LND upto 60 days applied for and
(incl. Commuted leave) may be granted without medical certificate. In addition to
these on recommendation of Medical Attendant the Extra ordinary leave can be
granted for illness of females or new born baby upto 02 years. (RBE 158/2008)

CHILD ADOPTION LEAVE


The adoption leave is sanctioned at par with Maternity leave i.e. 180 days for two
alive children subject to following legal process for such adoption and the age of
such child should be less than one year.

Adopted mother may also be granted leave even without production of medical
certificate as leave due and admissible not exceeding one year but this facility will
not be available to adopted mother having two childrens. The maximum
admissible period of one year leave of the kind due will be reduced by the age of
child.
If child is less than one month, leave upto one year may be allowed.
If child is six months old, the leave upto 6 months may be allowed.
If child is nine months of more, leave upto 3 months may be granted.
The maternity leave may also be granted to unmarried female Rly. Servants.
551(A) PATERNITY LEAVE
A Male Railway Servant (include. App.) with less than 2 surviving children may
be granted paternity leave for a period of 15 days during the confinement of his
wife. During the period of such leave he shall be paid leave salary equal to the
pay drawn immediately before proceeding to leave. Paternity leave shall not be
debited against the leave account and may be combined with any other kind of
leave. (as in the case of maternity leave.). It may not normally be refused under
and circumstance. Paternity leave to a male Railway Servant may be allowed in
case of wife had given birth to the child on a date not prior to 180 days from the
date of issue of this order i.e. 07.10.1997. (RB No. E(P&A)1-98/CPC/LE-6 dt.
21.05.1999 & RB No. E)P&A)1-98/CPC/LE-6 dt. 01.10.1999.

Male Railway Servant (including apprentice) with less then TWO Child on valid
adoption of child below the age of one years be sanctioned Paternity Leave on the

552 SPL. DISABILITY LEAVE


This leave may be granted permanent or temporary Railway Servants who is
disabled by injury inflicted or caused in or in consequence of due performance of
official duty. Such leave may be granted in case where the disability manifested it
self within three months, after the occurrence of its cause. The period of such
leave shall not exceed 24 months. It may e combined with any other kind of leave.
Such leave may be granted more than one if disability reproduced in similar
circumstances but not more than 24 months for one disability. It is counted as
duty for pension, leave salary during leave. First 120 days of any period be equal
of leave salary while on leave on average pay and remaining period of any kind
such leave equal of half average pay. In case period exceeding 120 days Railway
Servant may at, his option, get pay equal to LAP, by debiting half day leave from
his leave account. Person whom the WCA applies the amount of leave salary
payable shall be reduced by the amount of compensation.

hospitalization/medical treatment.

553 SPECIAL DISABLITY LEAVE FOR ACCIDENTAL INJURY


This leave may be granted to permanent and temporary Railway Servant who is
disabled by injury accident incurred in or inconsequence of due performance of
his official duties or by illness.

554 HOSPITAL LEAVE


This leave is granted to Group C and Group D staff only while medical
treatment for illness or injuries is directly due to risk incurred in the course of
official duty/duties. It is granted on production of medical certificate by
authorized medical attendant. For 1st 120 days salary equal to leave on average
pay is payable for remaining period salary equal to leave on half average pay in
payable.
The amount of Hospital leave may be granted by GM is unlimited.
It shall not be debited against leave account.
It may be combined with any other kind of leave but shall not exceeds 28 months
after combination. Salary during hospital leave shall be reduced from the amount
of compensation payable under Sec. 4(1) WC Act.
It has been decided that the period the leave salary can be paid equal to LAP with
the recommendation of CMS concurrence by Associate Account Officer and
sanction by JA Grade Officer, but post facto approval of GM will have to be
obtained. For treatment of the kidnapped Railway Servant subject to
physical/mental stress and not for the duration he remained captive. RB No.

556 STUDY LEAVE


It is granted 12 months at a time and during entire services not more than 24
months in all.
Doctors : If PG course, for medicine and research, it is granted for 36 months,
with the personal approval of GM, above it leave is taken for higher study which
will be help in Railway Working Bond should be executed, that he will serve
railway at least 3 year after expiry of such leave. Leave salary pay + DA only
payable. Incurred in performance of official duty/position. (RB No.
F(E)III/89/LE-1 dated 23.06.1998)

CHILD CARE LEAVE(w.e.f. 01/09/2008)


On implementation of 6th P.C, the Child Care Leave has been newly
introduced to Female Rly. Employees subject to following condition.
(a) The CCL will be granted up to 730 days (2yrs) in entire service for first Two
elder children up to 18 yrs of age of them.
(b) The terms & condition on which the leave will be granted is
(I) For Rearing (II) On Sickness of child (III) Education ground.
(c) During such sanctioned leave the employee will be eligible to draw Leave
Salary on the LAP (Leave on Average Pay) rate.
(d) Leave account to be maintained of each individual in the proforma.
(e) It can be availed in one or more than one spell.

(f) It can be combine with any kind of leave except CL.


(g) The leave account is to be maintained in the prescribed format.
(h) The CCL cannot be demanded as a matter of right. No employee can proceed
on CCL with out prior approval of leave by the sanctioning authority.

As per Boards order CCL can be availed only if No Earned Leave is at


her credit & the CCL sanctioned prior to 18.11.08 shall be treated as CCL &
after the date to be regulated as per the revised order.

Board further clarified that LHAP is not to be considered as Earned Leave


for the purpose of grant of CCL to employees.

CASUAL LEAVE:
Casual leave is a leave is admissible to all Railway servants and is granted to
enable them to attend to sudden /unforeseen needs / requirements. It is not recognize as
leave or subject to any rule under the leave rule applicable to the Rly servant. CL cant be
combined with any other kind of leave except [Link] .It can be granted for Half day
also. It can be prefixed or suffixed with weekly rest
& holidays
The total casual leave admissible to Railway Servant in a year form 01.01.1998 is
as under:

I) 8 days - To all Railway servants who are eligible to avail of all


Public holidays or workshop paid holidays
II) 10 days - To all Railway servants who, because nature of their
Duties are not allowed to avail themselves of public
Holidays at all or are allowed to avail themselves only
Of a few public holidays.
Casual leave not availed with in the calendar year will lapse at the end of the year
i.e. 31st December.

SPECIAL CASUAL LEAVE :


Special casual leave is granted to Railway employees by the Administration to
cover their absence form duty for the following work /situation.
I) For attending work of Railway mens Co-operative societies Max. 15 days
in a calendar year.
II) For promoting small family norms under family welfare programme.
For vasectomy operation Male 6 days
For Tubectomy operation Female (Wife) 7 days
For woman Railway employee(Self) 14 days
For Termination of Pregnancy (Abortion)- 45 days ( Once in service )

III) For participation in sports events.


Ordinary Events 30 days
National/International meet 90 days
IV) Attendance as official as meeting of Trade union/Association.
V) For participation of Cultural activities.- 30 days
VI) Scouts & Guides programmes/trainings. 30 days
VII) Occasion like voluntarily Donation of blood one day.
VIII) Mountaineering and Trekking expeditions.
IX) Union officials attending SBF meeting.
X) Absence due to Bandh/Cerfew & other disturbances
XI) Employees with Disabilities, for specific requirement relating to the disability
of the official (04 days ) RBE. NO. 201/2008 DATED : 26.12.2008.

1101 to 1115 JOINING TIME :

It will be granted to Railway Servants on transfer in public interest


It is not admissible in the case of temp. Transfer for a period not exceeding 180
days. Actual transit time is in the case of journey on transfer/tour shall only be
allowed.
Joining Time shall be commence from the date of relinquishment of charge of the
old post if the charge is made over in the (F/N) or the following date, if the charge is
made over in the (AN).
Joining time shall be calculated from old HQ in all cases including where a
Railway Servant receives his transfer order or makes over charge of the old post.
Not more than one days joining time shall be allowed to a Railway Servant to join
a new pot within the same station or which does not involve change of residence from
one station to another station, same station will be interpreted to mean the area falling
within the jurisdiction of the municipality of corporation including such of suburban
notified area.
In case of involving transfer from one station to another station and also involving
change of residence, the Joining time shall be Formula for each payment in lieu of
LHAP.
Allowed with reference to the distance between the Old Headquarter to New
Headquarter. By direct routes as indicated in the following schedule.

When holidays followed (s) journey time the normal joining time may be deemed
to have been extended to cover such holidays.

Up to 1000 Kms. 10 days


More than 1000 Kms but less than 2000 Kms. 12 days
More than 2000 Kms. 15 days
If journey by AIR 12 days

Extension of joining time beyond the limit of indicated above case be granted
upto the maximum limit of 30 days by the HOD and on Division by DRM and beyond 30
days by the Railway Board.

The total period of joining time should be approximately equal to 8 days for
preparation plus reasonable transit time plus holding if any following the extended
joining time.

While computing the transit time allowance could be made for the time
unavoidable spent due to duration of transport arrangement caused by strike of natural
calamity.

Reading in leave account with unutilized joining time when Railway Servants
joins the new post without availing of the full joining time the numbers of days of joining
time as admissible under there rules subject to the maximum of 15 days reduced by the
number of days actually availed of, shall be credited to his leave account as LAP. It will
be credited subject to the usual restriction leave account.
