OPPOSITION

OPPOSING PARTY, to this Honorable Commission respectfully

states that:

HOME VISION CABLE TELEVISION is granted PROVISIONAL

AUTHORITY to operate in San Ricardo, Southern Leyte in NTC Case No.
2010002 and existing under and by virtue of the laws of the Republic of
the Philippines with office address at San Ricardo, Southern Leyte duly
represented by Sandro L. Aboyot and for purposes of the present action,
it may be served with orders, notices and other processes of this
Honorable Commission in the address herein indicated;

He is filing and submitting this OPPOSITION to the verified

petition in the above captioned case in his capacity as an Affected Party
by virtue of Rule 2, Section 5(A) par (4) of The 2006 Rules of Practice
and Procedure Before the National Telecommunications Commission;

4) For CATV:
All grantees of PA/CA, TP to operate CATV, MMDS, Pay TV, and
regular TV stations in the service area applied for.

There are TWO [2] grounds strongly relied upon in this

Opposition to the application in the above captioned case, namely: [a]
Home Vision Cable Television is the Successor of PNVS; and/or [2]
Location of Pintuyan and San Ricardo.

Hereunder discussed and elucidated are the two grounds above

specified supporting the prayer for the dismissal of the above-
captioned application.
A. Home Vision Cable Television is the Successor of PNVS Cable
Television:

PNVS Cable Television is operating in Pintuyan, Southern Leyte.

They were granted permit on _________________________ which is to expire
on ___________________________. However, because of some uncontrollable
circumstances they stopped their operation and decided to sale their
equipment, tools, material and related machines to Home Vision Cable
Television. Attached herewith and marked as ANNEX A is the DEED
OF ABSOLUTE SALE executed by and between PNVS represented by its
Board Chairman EDUARDO G. GERBOLINGO and SANDRO ABOYOT
owner of HOME VISION CABLE TELEVISION.

This is the proof that HOME VISION CABLE TELEVISION is the

successor of PNVS Cable Television which gives it the vested right or
preference for the issuance of license in Pintuyan, Southern Leyte area.

B. Location of Pintuyan and San Ricardo:

The principal office of HOME VISION CABLE TELEVISION is

located at San Ricardo, Southern Leyte. San Ricardo, Southern Leyte is
the adjoining municipality of Pintuyan, Southern Leyte both being
located at Panaon Island, which compared to the applicant FIESTA
CABLE INC. whose principal address is located in San Juan, Southern
Leyte

For easy reference of this Honorable Commission, a copy of the

Map of Pintuyan, Southern Leyte to San Ricardo, Southern Leyte and
Map to Pintuyan, Southern Leyte to San Juan, Southern Leyte is
herewith attached and marked as ANNEX B and ANNEX B-1,
respectively.

The business of providing Cable Television is a matter of public

convenience and must be for the interest of the general public. It would
be advantageous if the one serving them is from the same locality so
that any emergency or concerns of the customers can be immediately
responded.

Hence, the current petition, herein opposed.

 PRAYER:

Wherefore, it is most respectfully prayed that after due notice and

hearing the requested Certificate of Authority to install, operate and
maintain a CATV system in the area applied for of FIESTA CABLE INC.
be dismissed and rejected.

Opposing Party also prays for such other relief and remedies just
and equitable under the premises.

due to distance, time constraint and lack of personnel.
