Chief,

This is an update. Your last update had 83 DTs but since that time we had owners sign allowing us to
enter the land for ROE S&E.

So you know, we also have 53 Value Letters going out this week. These are the letters that the land
owners will receive informing them of our intent to purchase the land and identifying the dollar amount
we intend to pay. These letters will be going to land owners in SDC, TCA and TX. These are the first
of an additional 350 Value Letters that will be going out in the following weeks. These landowners are
the ones that granted ROE for S & E but the unknown is how they will react once they know we want to
purchase the land.

1. The number of total possessions to date is 24, not 25; there are 11 in TX, not 12.

The RGC-1000 (b) (6) ) property DT is filed, but possession is not granted yet.

2. The DT noted as ‘on hold’ in the below email along with Cameron County, is located in CA not TX.

Attached is a list of 25 properties for which we now have an Order of Possession for temporary Right of

Entry granted by the respective District Court reported by DOJ as of COB yesterday.

The list is sorted by State & Sector; here is a summary:

2 in CA

11 in AZ

12 in TX

I can also report the following with certainty:

For CA, there are only 4 left to be filed.

For AZ, all are filed and in Possession

There were no ROE DT’s in NM.

For TX, all but 2 cases are filed (Cameron County and one other are on hold)

I am still in the process of validating all other condemnation information, and will release a
comprehensive briefing later today.

The issue I’m working to resolve is exactly how many signed ROE’s were received after filing occurred –
these cases either were dismissed, or are in the process of being dismissed by the AUSA in the
respective District Court.

Yesterday we met with Loren and he mentioned that we currently have been awarded an Order of
Possession for 18 properties. Division Chief Self is requesting the list of the properties to include a
description, location and names. It wouldn’t hurt to include any other information you may have on
