AN ACT TO ENHANCE THE MOBILITY OF DISABLED PERSONS BY REQUIRING CERTAIN BUILDINGS,


INSTITUTIONS, ESTABLISHMENTS AND PUBLIC UTILITIES TO INSTALL FACILITIES AND OTHER DEVICES

SECTION 1. In order to promote the realization of the rights of disabled persons to participate fully in
the social life and the development of the societies in which they live and the enjoyment of the
opportunities available to other citizens, no license or permit for the construction, repair or
renovation of public and private buildings for public use, educational institutions, airports, sports and
recreation centers and complexes, shopping centers, or establishments, public parking places, work-
places, public utilities, shall be granted or issued unless the owner or operator thereof shall install
and incorporate in such building, establishment, institution or public utility, such architectural
facilities or structural features as shall reasonably enhance the mobility of disabled persons such as
sidewalks, ramps, railings and the like. If feasible, all such existing buildings, institutions,
establishments, or public utilities may be renovated or altered to enable the disabled persons to
have access to them: Provided, however, That buildings, institutions, establishments, or public
utilities to be constructed or established for which licenses or permits had already been issued may
comply with the requirements of this law: Provided, further, That in case of government buildings,
street and highways, the Ministry of Public Works and Highways shall see to it that the same shall be
provided with architectural facilities or structural features for disabled persons.

CHAPTER 3- Discrimination on the Use of Public Accommodations and Services

Section 35. Public Accommodations and Services- For purposes of this Chapter, publuc
accommodations and services shall include the following:

(a) an inn hotel, motel, or other place of lodging, except for an establishment located within a
building that contains not more tha five (5) rooms for rent or hire and that is actually occupied by the
proprietor of such establishmemt as the residence of such proprietor,

(b) a restaurant bar, or other establishment serving food or drink;

(c) a motion picture theater, concert hall, stadium, or other place of exhibition or entertainment;

(d) an auditorium, convention center, lecture hall, or other place of public gathering;

(e) a bakery , grocery store, hardware store, shopping center , or other sales or rental establishment;

(f) a bank, barber-shop, beauty-shop, travel service, funeral parlor, gas station, office of a lawyer,
pharmacy, insurance office, professioal office of a health care provider, hospital or other service
establishment;

(g) a terminal, depot or other stations used for specified lublic transportations;

(h) a museum, gallery, library or other place of public display or collection;


(i) a park, zoo, amusement park, or other place of recreation;

(j) a nursery, elementary, secondary, undergraduate or post-graduate private school or other place of
education;

(k) a gymnasium; health spa, bowling alley, a golf course; or

(l) other place of exercise or recreation.

Republic Act No. 7277 or “Magna Carta for Persons with Disabilities” and Batas

Pambasa Bilang 344 or Accessibility Law are laws that support services to meet the

recreational needs of persons with disabilities. Republic Act No. 7277 guarantees that

persons with disabilities enjoy the same rights as any guarantees that persons with

disabilities enjoy the same rights as any other citizen of the country by mandating

relevant departments and agencies to meet the rights-based needs of people with

disabilities through non-discriminating policies, programs, projects, and special

benefits.
