On March 1st of 2008 at approximately 2050 hours, Mr. Connolly arrived at the United States Border Patrol
(USBP) checkpoint located on Interstate 19 m.p. 25 of the northbound lanes. Upon contact with the agents at
the USBP checkpoint, a K9 alerted to the presence of contraband. During a probable cause searched at the
secondary point of inspection by U.S.B.P. Agent Abukhurma #N469 noticed inside Connolly’s vehicle in
between the two front seats an AK-47 rifle that was found lying on the floorboard of the vehicle, next to the rifle
was a full 50-round magazine, and a full 30-round magazine in between the seats. Agent Abukhurman decided
to make contact with Connolly and during a pat down search for weapons he found a weapon inside of the right
front pocket of a jacket that Connolly was wearing. The weapon a .410 caliber revolver Taurus “Judge” which
was fully loaded he also found another box containing 5 rounds of the same caliber next to the handgun.
Connolly was detained by USBP and requested a DPS Officer for assistance with a possible misconduct with
weapons violation.

Officer Lomeli # 5871 responded from Interstate 19 exit 40 of the northbound lanes upon his arrival he made
contact with Agent Abukhurman who briefed him on the situation. Officer Lomeli made contact with Connolly
who stated he was familiar with the conceal weapons law in Arizona he also stated he possessed an expired
concealed weapons permit from the state of Texas. Connolly claimed ownership of the AK-47 rifle, and stated
the handgun was property of his friend “Diana”. Officer Lomeli requested a driver’s license check for Connolly
no warrant were found only a Protection order from the Santa Cruz County Office. The protected party was
Andrea Mendosa and her children, Officer Lomeli placed Connolly under arrest for violation of A.R.S. 13-
3102.A2 Misconduct with Weapons.

Officer Lomeli read Connolly his Miranda Rights, Connolly stated he understood them and waived his rights.
Mr. Connolly stated the jacket he was wearing was his. He also said the reason why the gun was in his pocket
was, because during the drive from Nogales, around kilometer 4, another driver cut him off , causing him to
apply his brakes suddenly, to avoid the collision. Connolly stated after the abruptly braked, and because he had
the handgun un-holstered on top of the front passenger seat, the handgun landed on the floor board. Connolly
said he decide to pick up the handgun and placed it inside his right front pocket for safety, as he continued on
his drive north toward Tucson. Officer Lomeli asked Connolly what the purpose of his trip to Tucson was,
Connolly stated “You want to know the truth?” I’m going to Tucson to rent porno movies because there is no
good porno-shops in Nogales Arizona well there is one, but it sucks”.

During the searched incident to the arrest Officer Lomeli found several boxes containing rounds of different
calibers to include more of the .410 gauge. Officer Lomeli asked Connolly about the extra rounds and the AK-
47 Connolly stated that he had being practice shooting earlier that day.

Officer Lomeli continued to search Connolly’s vehicle and came across 20 Business Reply mail cards with pre-
paid postage, from subscription magazines. 18 of them were filled out under the name of Andrea Mendosa with
an address of 1802 Saltillo Court in Rio Rico Arizona 85648. Officer Lomeli asked Connolly why he had the
magazine subscriptions in side his vehicle and why they were filled out under the name of the person of his
Protection Order. Connolly stated he had filled them out with the intention to send them in the mail, however
his mother had found them earlier and told him that it was a very bad thing to do and that those kinds of action
were not appropriate from a gentleman. I explained to Connelly that by him sending those subscriptions it will
create a problem for the PP Andrea Mendosa, to which Connelly responded “I know”

Officer Lomeli took pictures of all the items previously mentioned, the AK-47 rifle, the .410 Taurus handgun,
the ammunition and the Business Reply Mail cards were submitted into the DPS evidence lockers to be
transported to the DPS evidence room in Tucson, Arizona.
