SPECIAL TERMS AND CONDITIONS OF CONTRACT

1. COMPLETION PERIOD : 2 (Two) Months

SUPPLY :
Supply within 2 Months from the date of issue of LOI/PO or the date of advise to supply
the material by MANAGER- LPG PROJECTS -Mumbai, HQO, whichever is earlier.

2. DEFECTS LIABILITY PERIOD : As per GTC

3. RETENTION MONEY : As per GTC

4. PART ORDER : Not Allowed. Tender will be finalized on schedule


basis.

5. THIRD PARTY INSPECTION :

Scope of Third Party Inspection would be as below :

1. Visual : 100%
2. Dimensional Check : 100%
3. Tensile Requirement : One sample for each size of pipe and each heat
4. Chemical Analysis : One sample for each size of pipe and each heat
5. Bend / Flattening Tests : One sample for each size of pipe and each heat
6. Hydrotesting : As per Material Specifications / technical supply
conditions for pipe

Inspection & Test Plan ( ITP) has been attached. TPI shall cover the requirements as per
ITP.

All the pipes shall be stamped by Third party inspection agency. The TPI stamping shall be
clearly visible on all pipes and the stamping mark to be mentioned in TPI reports.

GENERAL TERMS & CONDITIONS OF THIS CONTRACT


(GTC)

This is an e- tender and bids are to be submitted on-line only at


http://etender.hpcl.co.in. Response in any other form shall not be accepted.

While on-line bidding, bidders would be required to upload the scanned copy in
pdf format of EMD instrument.(or exemption proof if applicable). For bidding
it is suggested that bidders should not wait for last date/ tender due date for their
bid preparation as several documents are to be uploaded in the offer and prices
are to be entered on screen for all items. There is a facility to keep the bid ready
in the system for final submission, however bidders are requested to keep
sufficient time margin with them for modifications, connectivity issues etc.
The taxes mentioned in techno-commercial sheet on-line (Excise Duty, CST,
Freight, TPI, Packing & Forwarding, Service tax, works contract tax etc.) will
be added to the amount (Sum of (item quantity x item rate quoted by bidder) for
arriving at total offer value. The education cess would be calculated on service
tax. In case bidder quoted some/all taxes as 0%, it would be concluded that
bidders quote is inclusive of all taxes applicable of all taxes applicable on
tender due date/time or extended due date/time.

1. SUBMISSION OF TENDER

1.1 Before submitting the Tender, the Tenderer shall at their own cost and
expenses visit the site , examine and satisfy as to the nature of the existing
roads, means of communications, the character of the soil, state of land and of
the excavations, the correct dimensions of the work facilities for procuring
various construction and other material and their availability, and shall
obtain information on all matters and conditions as they may feel necessary for
the execution of the works as intended by the HPCL. Tenderer, whose tender
may be accepted and with whom the Contract is entered into shall not be
eligible and be able to make any claim on any
of the said counts in what so ever manner for what so ever reasons at any point
of time and such a claim shall not be raised as a dispute and shall not be
arbitrable.

1.2 The Tenderer shall be deemed to have satisfied fully before tendering as to
the correctness and sufficiency of his tender for the works and of the rates and
prices quoted in the schedule of quantities which rates and prices shall except as
otherwise provided cover all his obligations under the contract.

1.3 It must be clearly understood that the whole of the conditions and
specifications are intended to be strictly enforced and that no work will be
considered as extra work and allowed and paid for unless they are clearly
outside the scope, spirit, meaning of the Contract
and intent of the HPCL and have been so ordered in writing by HPCL and/or
Engineer-in-Charge/Site-in-Charge, whose decision shall be final and binding.

1.4 Before filling the Tender the Contractor will check and satisfy all drawings
and materials to be procured and the schedule of quantities by obtaining
clarification from the HPCL on all the items as may be desired by the Tenderer.
No claim for any alleged loss or compensation will be entertained on this
account, after submission of Tender by the Tenderer/Contractor and such a
claim shall not be arbitrable.

1.5 Unless specifically provided for in the tender documents or any Special
Conditions, no escalation in the Tender rates or prices quoted will be permitted
throughout the period of contract or the period of actual completion of the job
whichever is later on account of any variation in prices of materials or cost of
labour or due to any other reasons. Claims on account of escalation shall not be
arbitrable.

1.6 HPCL reserve their right to award the contract to any tenderer and their
decision in this regard shall be final. They also reserve their right to reject any
or all tenders received. No disputes could be raised by any tenderer(s) whose
tender has been rejected.

1.7 The Rates quoted by the Tenderer shall in the following format only:

1. Basic Price -To be quoted in priced bid.(all others form part of un-priced bid)
2. Packing & Forwarding
3. Excise Duty:
4. Sales Tax without form C/ VAT
5. Octroi /ENTRY TAX: will be payable extra at actual-do not quote
6. Freight charges on door delivery basis
7. Transit Insurance
8. Third party Inspection Charges
9. Installation/Commissioning charges (wherever applicable) : quote lumpsum
10. Any others charges
