Board, Insurance companies, Banks or finance companies closing
shutters all of a sudden swallowing all your savings, shady rackets
in mutual funds and shares, under-weighment of goods,
adulteration in petrol, unscrupulous flat promoters taking you for
a ride, medical negligence- these are some of the problems you
face as citizen - consumers. How many such problems have you
encountered and how often have you wrung your hands in despair,
wishing that you could do something about it?

INTRODUCTION
The Indian citizen- consumer has borne incredible hardships and has
been constantly exploited. Most of us citizen- consumers have put up
with adulterated food, shortages in weights and measures, spurious and
hazardous drugs, substandard products, useless guarantees, shortages
leading to black marketing and profiteering and callous and indifferent
services. From being branded passive, tolerant people, we Indians have
come a long way. But we still have a long way to go.
John F. Kennedy defined consumers as “the largest economic group,

affecting and affected by almost every public and private economic
decision. But they are the only important group whose views are often
not heard.” Kennedy's Bill of Rights included the right to safety,
information, choice among a variety of products and services at
competitive prices and a fair hearing by governments over matters of
consumer policy. If one avails service for commercial use, he is not a
consumer.
The first World Consumer Rights Day was observed on 15th march 1983,
two decades after Kennedy made this revolutionary statement.
Eventually, several more consumer rights were added. Every year, this
day is now commemorated as World Consumer Rights Day.

RESPONSIBILITIES &
RIGHTS OF EVERY CONSUMER
Responsibilities of every consumer:
· Solidarity- the responsibility to organize together as consumers
to acquire sufficient strength and influence to promote and
protect our interests.
· Critical awareness-the responsibility to be more alert and

questioning about the price and quality of goods and services we
use.
· Action - the responsibility to assert ourselves and act to ensure

that we get a fair deal .As long as we remain passive consumers
we will continue to be exploited with regard to products and
services
· Social Concern – the responsibility to be aware of the impact of

our consumption on other citizens, especially disadvantaged or
powerless groups whether in the local, national or international
community.
· Environmental awareness- the responsibility to understand

the environmental consequences of our consumption. We
should recognize our individual and social responsibility to
conserve natural resources and protect the Earth for future
generations and help to adhere to the provisions of environment
laws.

CONSUMER PROTECTION ACT, 1986
The Consumer Protection Act, (COPRA) 1986 was a historic Act
enacted by our Parliament on 24th December 1986 which empowers
consumers and provides them better protection .
SOME DEFINITIONS FOR CONSUMERS

Consumer:
According to COPRA 1986 “Consumer” means any person who buys

any goods for a consideration which has been paid or promised or partly
paid and partly promised or under any system of deferred payment .It
includes any user of such goods other than the person. who buys such
goods for consideration paid or promised or partly paid or partly
promised, or under any system of deferred payment when such use is
made with the approval of such person. It does not include a person who
obtains such goods for resale or for any commercial purpose.
OR
Hires or avails of any services for a consideration which has been paid or
promised or partly paid and partly promised or under any system of
deferred payments and includes any beneficiary of such services other
than the person who hires or avails of the services for consideration paid
or promised , or partly paid and partly promised, or under any system of
deferred payment , when such services are availed of with the approval of
the first mentioned person;
Commercial purpose:
Commercial purpose does not include use by a consumer of goods

bought and used by him exclusively for the purpose of earning his
livelihood, by means of self-employment.
Consumer Dispute:
Consumer dispute means a dispute where the person against

whom a complaint has been made, denies or disputes or ignores
the allegations contained in the complaint.

Defect:
Defect means any fault, imperfection or shortcoming in the quality,

quantity, potency, purity or standard which is required to be maintained
by or under any law for the time being in force or under any contract,
express or implied or as is claimed by the trader in any manner
whatsoever in relation to any goods.
Deficiency:
Deficiency means any fault, imperfection, shortcoming or inadequacy

in the quality, nature and manner of performance which is required to be
maintained by or under any law for the time being in force or has been
undertaken to be performed by a person in pursuance of a contract or
otherwise in relation to any service. Deficiency generally applies to
negligence in service.
Goods:
Goods mean goods as defined in the Sale of Goods Act, 1930(3 of 1930)
Manufacturer:
Manufacturer means a person who
(I) makes or manufactures any goods or parts thereof; or
(ii) does not make or manufacture any goods but assembles parts
thereof made or manufactured by others and claims the end
product to be goods manufactured by himself or
(iii) puts or causes to put his own mark on any goods made or
manufactured by any other manufacturer and claims such
goods to be goods made or manufactured by himself.
Where a manufacturer dispatches any goods or part thereof to any branch

office maintained by him, such branch office shall not be deemed to be
the manufacturer even though the parts so dispatched to it are assembled
at such branch office and are sold or distributed from such branch
office.

Complainant:
Complainant means
(I) a consumer or
(ii) any voluntary consumer association registered under the
Companies Act,1956 (1 of 1956), or under any other law for the
time being in force or
(iii)the Central Government or any State Government who or
which makes a complaint
(iv)one or more consumers, where there are numerous consumers
having the same interest. In case of death of a consumer, his
legal heir or representative who makes the complaintg
Complaint:
Complaint means any allegation in writing made by a complainant that

an unfair trade practice or a restrictive trade practice has been adopted by
any trader; the goods bought by him or agreed to be bought by him suffer
from one or more defects; the services hired or availed of or agreed to be
hired or availed of by him suffer from deficiency in any respect .
A trader has charged for the goods mentioned in the complaint; a price
in excess of the price fixed by or under any law for the time being in
force or displayed on the goods or any package containing such goods.
Goods which will be hazardous to life and safety when used are being
offered for sale to the public in contravention of the provisions of any
law for the time being in force requiring traders to display information
in regard to the contents , manner and effect of use of such goods with a
view to obtaining any relief provided by or under this Act.
Service:
Service means service of any description which is made available to

potential users and includes the provision of facilities in connection with
banking, financing, insurance, transport, processing, supply of electrical
or other energy, board or lodging or both housing construction,
entertainment, amusement or the dissemination of news or other
information, but does not include the rendering of any service free of
charge or under a contract of personal services or for commercial
purposes.

THE CONSUMER PROTECTION ACT
TO YOUR RESCUE
Before The Consumer Protection Act 1986 came into force a citizen
consumer had recourse only to civil courts by adhering to civil procedure
code Consumers had to spend fortunes and wait for years for a decision
.Even if a favourable order was received it was only to punish the guilty
by a small token fine. The consumer seldom got back his losses.
The Consumer Protection Act, in contrast, gave the consumer redressal -

and helped him to get back losses with interest, a compensation for even
mental agony and costs .
The Consumer Protection Act provides an inexpensive, simple and

speedy remedy, in contrast to the frustrating, long drawn process of
regular courts. Any consumer can himself approach the District Forum,
the State or National Commission with a complaint and have his /her
grievances redressed. The Consumer Protection Act provides a three tier
system based on the total amount of compensation sought.
The District Consumer

Disputes Redressal Forum ... upto Rupees 20 Lakhs
State Consumer Disputes between Rupees

Redressal Commission. 20 lakhs and upto Rupees 1
Crore.
National Consumer Disputes

Redressal Commission ... above Rupees 1 Crore
WHY COMPLAIN?
Until the Consumer Protection Act came into force consumers in India
were complacent,
taking everything in their stride – whether it was a defective product or a
deficiency in service. Remaining complacent about your problems is not
going to get you anywhere. Moreover, your complaining may save other
consumers from suffering the same fate.

WHO CAN COMPLAIN?
· A consumer who is defined as one who buys goods or hires

services to be used by him, for himself and not one that can be
traded . So a trader or a manufacturer or even a value – added
reseller does not fall under this category. Anyway they have
their own associations to fight their cause , if at all any injustice
is meted out to them.
· Any registered voluntary consumer organization
· The Central Government
· The State Government
· One or more consumers on behalf of numerous consumers who

are having the same interest
· Legal heir or representative in the case of death of the

consumer
WHEN CAN A COMPLAINT BE FILED?
Under the Act , a complaint can be made in writing in the following

circumstances :
· If you have suffered loss or damage as a result of any unfair or

restrictive trade practices adopted by a trader or a service provider
· If the services hired /and or availed of suffers from deficiencies in

any respect .
· If you have been charged a price in excess of the price displayed or

fixed by or under any law for the time being in force
· If the goods which are hazardous to life and safety, when used, are
being offered for sale to public in contravention of any law for the
time being in force.

WHERE TO FILE A COMPLAINT
You can file a consumer complaint before the District Consumer

Disputes Redressal Forum of the Revenue District where the cause of
action (where you bought a product or hired a service ) arose.
If the value contested including compensation is upto Rs. 20 lakhs you
should complain before the District Forum. If the value is between Rs.20
and Rs. 1 crore you should complain before your State Consumer
Disputes Redressal Commission. If the value is more than Rs. 1 crore
you should complain before the National Consumer Disputes Redressal
Commission at New Delhi.
A Statewise list of Consumer Courts along with their address is appended

for your ready reference.
FEES FOR A FILING A COMPLAINT
Up to 1 lakh - Rs.100/-
1 lakh & above but less than 5 lakhs - Rs.200/-
Between 5 lakhs to 10 lakhs - Rs.400/-
10 lakhs to 20 lakhs - Rs.500/-
STATE COMMISSION
20 lakh to 50 lakh - Rs.2000/-
50 lakh to 1 crore - Rs.4000/-
NATIONAL COMMISSION
Above 1 crore - Rs.9000/-
HOW TO COMPLAIN?
To complain effectively, you have to go about it in the right way. The

following three steps are to be followed.
1. Once you are justified in making a complaint, a letter has to be

sent to the Opposite party explaining your problem with the
product or services, adhering to the principles of national justice.
2. Gather all the relevant facts and evidence about your complaint.
Evidence would include a receipt of purchase, or brochure,

confirmatory invoice, an advertisement estimate and bills.
3. Complain as soon as possible. Your letter should give the
opposite party a reasonable time to comply with your request,
say 15 days.
Note:
Keep all original documents with you in a file. Do not part with originals
unless called for by the court. Always use Xerox copies whenever
required.
CONSUMER REDRESSAL FORA
Consumer Dispute Redressal Fora do not have a single judge. At the

District Forum, and State Commission the Bench consists of a President
and two members (a male and female) who are nominated .The majority
decision of the three will be the final order. The President of the District
Forum or State Commission shall be a District or High Court Judge
respectively or retired as one.
The National Commission is a bench of five consisting of the President

who has been or is a judge of the Supreme Court and four other members,
one of whom, should be a lady member nominated from the public.
There can be court fee in the consumer courts as fixed by state

government and the consumer can appear himself, or through registered
consumer protection organization or through a lawyer.
District Forums are constituted at all District Headquarters, State

Commission are situated in the State Capitals. We have appended the list
of consumer fora with their addresses. For any additional information
you may contact your State / Union Territory, Food and Civil Supplies /
Consumer Affairs Department.

TIME FRAME FOR FILING A COMPLAINT
The complaint is to be filed within two years from the date of last
documented evidence such as letter, notice etc. For fees for filing a
complaint refer to the schedule given earlier. Even an affidavit does not
need stamp papers .A complaint can be sent by post or presented in
person by the complainant or by his/ her authorized agent. Usually the
forum requires three to five copies of the complaint.
RELIEF SOUGHT UNDER

The forums/ commissions can order the following relief:
· Removal of defects from the goods
· Replacement of goods
· Refund of the price paid
· Award of compensation for the loss or sufferings
· Removal of defects or deficiencies in the services
· Discontinuance of unfair trade practices /restrictive trade

Practices and direct them not to repeat these unfair practices
· Withdrawal of hazardous goods from being offered for sale

Award adequate costs.

A deposit of 50% of amount ordered by lower court or Rs. 25,000/-

whichever is less, in state Commission or Rs.35, 000/- in National
Commission shall be made with an appeal. Procedure for filing an appeal
is similar to that of filing a complaint, expect that the application has to be
accompanied by the copies of the orders appealed against with reasons
for filing appeals.
Note:
Appeals are to be filed within 30 days from the date of receipt of the order
by you. This applies to appeals at all levels. The Courts may condone
delay due to sufficient cause if filed with Petition and Affidavit

1. Name and complete address of the complainant
2. Name and complete address of the opposite party or parties as

the case may be

3. Date of purchase/ service obtained. Amount paid as
consideration and date when defect / deficiency was noticed and
reported to opposite Party.
4. Items of goods with quantity /nature of service.
5. Whether the complaint relates to unfair trade practice /defective

goods / deficient service/ charging excess price.
6. Copies of bills/ vouchers/ receipts and copies of correspondence

from both parties, if any
7. To be sent in quadruplicate

prizes, or other items free of charge, and
manufacture of spurious goods and sale of
spurious goods or adoption or deceptive practices
in the provision of services.
“Spurious goods and services” are defined as
goods and services which are claimed to be
genuine but are actually not so
“Regulation” is defined as regulation made by the

National Commission.
The definition of “service” is made more clear by
clarifying that the services mentioned are only
illustrative.

4 - In the sub-section (1) certain Section 4 is amended so that the establishment of the

10 - (i) Clause (b) in sub- The amendments to section10 provide minimum age
section(1) substituted of thirty- five years, minimum qualification of
(ii) Proviso inserted in sub- graduation and minimum experience of ten years for
section (1A) members of the District Forum. It also provides
(iii) Sub-section (2) sub- disqualifications for the office of member. A new
stituted proviso to sub section ( 1 A) is inserted to provide
(iv) Proviso inserted in sub- that where the President of the state Commission is,
section (3) by reason of absence or otherwise, unable to act as
Chairman of the Selection Committee, the State
Government may refer the matter to the Chief Justice
of the High Court who shall nominate a sitting Judge
of that High court to act as a Chairman to avoid delay
in selection. It also amends sub-section (2) to provide
for reappointment of Presidents and Members to
enable utilization of their experiences for a longer
period. It also provides that persons already holding
office of President or Members will continue to hold
such office till the completion of their term. It further
amends sub-section (3) to provide that the State
Government shall appoint a member on whole time
basis on the recommendations of the President of the
State Commission taking into consideration the
workload and other factors as may be prescribed
11 - In sub-section (1) certain Amendment to section 11 enhances the jurisdiction of

value of the goods or services and the compensation
claimed does not exceed rupees twenty lakhs. This
will be more convenient for the complainants and also
reduce the number of complaints filed with the State
Commission and National Commission
12 - substituted Section 12 is substituted to provide that every
complaint with the District Forum shall be
accompanied with such amount of fee as may be
prescribed. It also provides that the admissibility of
the complaint shall ordinarily be decided within
twenty-one days from the date from the date on which
the complaint is received and that once admitted a
complaint shall ordinarily be decided within twenty-
one days from the date on which the complaint is
received and that once admitted a complaint shall not
be transferred to any other Court or Tribunal .This
will help to quicken disposal of complaints.

13 - (i) Heading substituted The amendments to section 13 require the District

District Forum to pass interim orders where required.
It also includes a new sub-section (7) for the
substitution of parties in accordance with the
provisions of Order XXII of the First Schedule to the
Code of Civil Procedure , 1908 in the event of death
of the complainant or opposite party. These
amendments will facilitate quicker disposal of cases,
enable complainants to get immediate relief where
required, and streamline procedures.
14 - (i) Proviso inserted in clause The amendments to section 14 empower the District

15 - Second proviso inserted The amendment to section 1.5 provides that no appeal
by a person who is required to pay any amount in
terms of an order f the district Forum, shall be
entertained by the State Commission unless the
appellant deposits or twenty- five thousand rupees,
whichever is less.
16 - (i) Clause (b) and its proviso The amendments to section 16 make the same

17 - (i) Existing provision The amendments to section 17 clarify the jurisdiction

renumbered as sub section of the state Commission and also raise its jurisdiction
(1) to entertain complaints where the value of goods or
(ii) in sub-clause (i), in clause services and compensation claimed exceed rupees
(a), in sub-section (1)certain twenty lakhs but does not exceed rupees one crore. At
words present the jurisdiction of the State Commission is
(iii) sub-section (2) inserted above rupees five lakhs. This will be convenient for
the complaints filed before the National Commission.
17A& 17B - Inserted New section 17 A empowers the state Commission to

transfer a case from one District forum to another
District Forum to within the State if required for ends
of justice. It also inserts another new section 17B to
enable the State Commission to hold Circuits
Benches.
18A 19 - omitted Proviso is inserted to provide that no appeal by a

second proviso inserted person, who is required to pay any amount in terms of
an order of the State Commission unless the appellant
has deposited in the manner as prescribed by the State
Governments fifty per cent of the amount of rupees
thirty five thousand, whichever is less.
19A - Inserted New section 19A provides that endeavour shall be

made to dispose of appeals filed before the State
commission within ninety days from the date of
admission. It also further provides that no
adjournment shall ordinarily be granted unless for
sufficient reason for grant of adjournment has been
recorded in writing costs for have also been specified
in order. In the event of an appeal being disposed of
after the period so specified, the State Commission or,
the National Commission, as the case may be, shall
record in writing the reasons for the same at the time
of disposing of the said appeal.
20 - (i) Clause (b) and its The amendments to section 20 make the same

22 - Section 22 to 22 D Section 22 is substituted to provide that the provision
substituted for section 22 of sections 12,13 and 14 and the rules made there
under for the disposal of complaints by the District
Forum, shall, with such modifications as may be
considered necessary by the Commisssions. It also
empowers the National commissions to review any
order made by it, when there is an error apparent on
the face of record. These provisions will make the
powers and procedures in respect of National
Commission more explicit. It also inserts new
section 22A, 22B, 22C and 22D. New section 22A
empowers the National Commission to set aside
exparte orders against the opposite party or
complainant in the interest of justice. New selection
22B empowers the National commission to transfer
any complaint pending before the District Forum of
another State or before one state Commission to
another State Commission in the interest of justice.
New section 22C enables the National Commissions
to hold circuit Benches in any part vides for the senior
most member to preside in the absence of the
President of the District Forum, State Commission
and National Commission, as the cause may be, to
ensure un- interrupted functioning of the Forum or
commission. However, in the case of National
Commission, it provides that where a retired Judge of
a High Court is a member or where number of such
members is more than one, the senior- most amongst
them shall preside over the Commission. These
provisions will streamline the functioning of the
Consumer Redressal Forums and also reduce the
number of appeals to the Supreme Court from orders
of the National Commission.
23 - Second proviso inserted The proviso inserted in section 23 to provide that no

appeal by a person. Who is required to pay any
amount in terms of an order of the National
Commission, shall be entertained by the supreme
Court unless the appellant has deposited in the
manner as Prescribed b the Central Government fifty
percent of that amount of rupees fifty thousand,
whichever is less.
25 - Substituted Section 25 is substituted to provide for attachment by

the District Forums, state Commissions or National
Commission, as the case may be, of the property of a
person not complying with an interim an order. It also
provides that on application from any person entitled
to receive any amount from another person under an
order made by a District Forum, State Commission
and National Commission which remains due , the
District Forum, State Commission and National
Commission, as the case may be , may issue a
certificate to the Collectors fro recovery of the
amount as arrears of land revenue. These new
provisions are excepted to overcome the delays and
other difficulties faced in execution of orders of the
redressal agencies through civil courts.

27 - (I) Proviso omitted The amendments to section 27 empower the District
(ii) Existing section Forum, State Commission and National commission,
renumbered as subsection (1) as the case may be , with the powers of a judicial
(iii) sub sections (2) and (3) Magistrate of the first class for the summary trial of

28A - Inserted New section 28A provides that all notices required by
this Act can be served by using modern
communications facilities including speed post,
courier services and FAX messages. This will help to
quicken proceedings.
29 - Sub sections (3) and (4) The amendment enables the Government to make
inserted orders to remove any difficulty with respect to the
amended provisions of the Act for a period of two
years after the coming into force.
30 - Substituted The amendment substitutes a new section for section

30 to deal with the powers of the Central Government
and the State Government to make rules.
30A - Inserted New section 30A empowers the National commission

to make regulations with the previous approval of the
Central Government where required for the purpose
of giving effect to the provisions of the Act, and I
particular to make provisions for the cost of
adjournment of any proceedings before the District
Forum, the State Commission or the National
Commissions, as the case may be, which a party may
be ordered to pay.
31 - Substituted Section 31 is substituted to provide for the procedures

for laying of rules and regulations made under the Act
before each House of Parliament or the State
Legislature, as the case may be.

District councils
The district councils are established for every District by
notification.
It will have the collector /District Magistrate as chairman
Official and non official members (VCOs). As prescribed the State
Government's District Council will meet at least twice a year.
