Facts:

Adriano Hernandez, a Filipino citizen, a degree holder of Juris Doctor from Columbia Law School in New York
and a bar passer in NY in year 1990 took bar subjects in Ateneo Law School and 5-month bar review course
there. He sought the Supreme Court and prayed to allow him to take the bar exam in the Philippines

Issue; Whether or not Hernandez should be allowed to take the bar examination even if he is umable to
present requirements under Sec. 5 and 6 of Rule 138

Held: The Supreme Court ruled to allow the applicant to take the 1993 Bar Examinations with high regard of
Filipinos with same case in which the court allowed to take the bar examination. Non-graduates of Philippine
law schools have also been allowed to take the bar examination. However, the court held in this resolution that
in the following year, all applicants for the bar must comply with the requirements stipulated in Sec. 5 and 6 of
Rule 138 including the completion to studying law in any of the Philippine law schools.
