I HEREBY AFFIRM that, as part of my application process, Tescom may introduce me to current
and/or potential Tescom clients. For purposes of inducing Tescom to consider my application for
employment, I agree that should Tescom introduce me to a business with whom Tescom has or
intends to transact business, I will not directly approach that business for employment or accept
any offer of employment (whether as an employee or independent contractor) from that business
for a period of two (2) months from the date when I was introduced to that business by Tescom.
The prohibition only extends to employment rendering Software Quality Assurance and testing
services. In the event that I should breach this agreement, I understand that Tescom will suffer
damages for a loss of business opportunity, the exact amount of which is difficult to determine in
advance. Accordingly, I agree with Tescom to liquidate the amount of damages to the flat sum of
Five Thousand Dollars ($5,000), which I will owe to Tescom in the event I breach this agreement.
