Sub: Releasing of admitted dues by M/s Hindustan Steel Works

Construction Ltd. (HSCL), Bokaro in pursuance of Letter of
Acceptance No. HSCL/ED/TC/TW/STN-01/2013-TCD-993
dated 09.05.2013 and the Agreement dated 10.02.2014.

Dear Sir,
This is to inform you that M/s Harsh Engineering works is a SSI Unit,
engaged in the business of Casting, Fabrications, Erection, Machining, Civil
and other Mechanical and Mining.

On 18.08.2012, M/s Central Coalfields Limited issued a Tender Notice No.

GM(CMC)/Dhori/2012/278 dated 18.08.2012 for “Hiring of HEMM such as
Shovels, tippers, drills, dozers, graders and water sprinkler etc. for removal
of strata including top soil earth, alluvium soil, various rocks, blasted rocks
and blast hole drilling in all kinds of strata, excavation, loading,
transporting, dumping, spreading and dozing of specified place haul road
maintenance and water spaying on the haul road as per instruction of
Engineer at SDQ-1 outsourced patch”, which was awarded to the HSCL
vide Letter No. GM(CMC)/Dhori/2012/103 dated 05.12.2012.

On being awarded with the aforesaid work, the HSCL issued a NIT No.
HSCL/STN No. 01/2013 for the execution of the aforesaid work. M/s Harsh
Engineering participated in the aforesaid Tender and its bid was accepted
by the HSCL and pursuant thereto a Letter of Acceptance No.
HSCL/ED/TC/TW/STN-01/2013-TCD-993 dated 09.05.2013 was issued

showing the total contract price to the tune of Rs. 7,68,00,652.80, after
deducting its margin of Rs. 32,00,027.20 by the HSCL. Thereafter, an
Agreement No. HSCL/HP/TC/AGT-1235 dated 10.02.2014 was executed by
and between M/s Harsh Engineering works and the HSCL.

After issuance of Letter of Acceptance, M/s Harsh Engineering works had

started the execution of work and measurement of the executed work was
taken from time to time, on the basis of which the HSCL raised Running
Account (RA) Bills on M/s CCL and till 04.04.2014 raised total 6 RA Bills
on M/s CCL which was duly paid to HSCL and after retaining its margin,
the amount pertaining to those 6 RA Bills was subsequently released to
M/s Harsh Engineering works .

Moreover, after execution of the work for the period from 15.11.2013 to
14.12.2013, the HSCL after measurement, had raised 7th RA Bill dated
26.01.2014 to the tune of Rs. 1,09,34,000.00 on M/s CCL, but the
payment for the same was not released to M/s Harsh Engineering works
by the HSCL till date, without any valid reasons.

Thereafter, M/s Harsh Engineering works vide various Letters repeatedly

requested the HSCL to release payment on account of 7th RA Bill in order to
maintain continuity of work, but no heed was granted by the HSCL on such
requests.

It is relevant to mention here that due to non-release of the outstanding bill

by the HSCL, M/s Harsh Engineering works has compelled to take Loan
and also a huge amount from private parties besides the outstanding dues
payable to the suppliers at different places which runs over Crores of

rupees to complete the project in time and to meet the expenditure on

account of purchase of materials and labour charges etc.

HSCL has no reason, much less valid reason, for not making payment of
the aforesaid dues, especially in view of the fact that the M/s Harsh
Engineering works has satisfactorily executed the work in question and
the execution of the same was duly admitted by HSCL in its 7th Running
Account Bill dated 26.01.2014 raised by it on M/s CCL for its Dhori Quarry
No. 1 to the tune of Rs.1,09,34,000.00.

Apart from the above, HSCL has also not released Rs. 52,21,755.00 on
account of work executed by M/s Harsh Engineering works to the tune of
94,941.00 cu.m, which has also been admitted by the HSCL in its Letter
No. HSCL/P.E./Mines/CCL/Dhori/2014-1167 dated 06.05.2014 including
the Letter of M/s CCL being No. SDQ-1/P.O./HSCL/14/236 dated
28.04.2014.

Even the Security Deposit to the tune of Rs. 81,00,000.00 deducted from
the Running Account (RA) Bill raised by the M/s HSCL on the HSCL
including Rs. 4,00,000/- deposited by M/s Harsh Engineering works as
Earnest Money and Rs. 5,00,000/- on account of diesel escalation, total
being Rs. 85,00,000/- has also not been refunded till date.

It is pertinent to mention here that M/s Harsh Engineering works, in order

to execute the said works, invested a sizable and huge amount after taking
loans from friends and well-wishers and due to non-releasing of the
outstanding dues by M/s HSCL, M/s Harsh Engineering works is facing a

lot of problems including the immense pressure for returning the amount of
loan.

Please be informed that this representation is being made by M/s Harsh

Engineering works, without prejudice to the writ petition being W.P.(C) No.
2547 of 2017 filed by it before the Hon'ble Jharkhand High Court, which is
still pending.

In view of the aforesaid facts, it is humbly requested that your goodself may
be pleased to take necessary initiative in the matter in order to release the
aforesaid admitted outstanding dues to M/s Harsh Engineering works.
