Section 2. When Solicitor General or public prosecutor must commence action. — The
Solicitor General or a public prosecutor, when directed by the President of the Philippines, or
when upon complaint or otherwise he has good reason to believe that any case specified in the
preceding section can be established by proof, must commence such action. (3a)
Section 3. When Solicitor General or public prosecutor may commence action with
permission of court. — The Solicitor General or a public prosecutor may, with the permission of
the court in which the action is to be commenced, bring such an action at the request and upon
the relation of another person; but in such case the officer bringing it may first require an
indemnity for the expenses and costs of the action in an amount approved by and to be deposited
in the court by the person at whose request and upon whose relation the same is brought. (4a)
Section 4. When hearing had on application for permission to commence action. — Upon
application for permission to commence such action in accordance with the next preceding
section, the court shall direct that notice be given to the respondent so that he may be heard in
opposition thereto; and if permission is granted, the court shall issue an order to that effect,
copies of which shall be served on all interested parties, and the petition shall then be filed within

Section 10. Rights of persons adjudged entitled to public office; delivery of books and papers;

Section 11. Limitations. — Nothing contained in this Rule shall be construed to authorize an
action against a public officer or employee for his ouster from office unless the same be
commenced within one (1) year after the cause of such ouster, or the right of the petitioner to
hold such office or position, arose, nor to authorize an action for damages in accordance with the
provisions of the next preceding section unless the same be commenced within one (1) year after
the entry of the judgment establishing the petitioner's right to the office in question. (16a)
Section 12. Judgment for costs. — In an action brought in accordance with the provisions of
this Rule, the court may render judgment for costs against either the petitioner, the relator, or
the respondent, or the person or persons claiming to be a corporation, or may apportion the

Seksyon 1. Pagkilos ng Pamahalaan laban sa mga indibidwal. - Ang isang pagkilos para
pamamagitan ng isang verified petition na dinala sa pangalan ng Republika ng Pilipinas laban sa:
(a) Ang isang tao na nag-usurp, nakakasira, o labag sa batas na may hawak o
(b) Ang isang pampublikong opisyal na gumagawa o nagging biktima ng isang akto, sa
ng pagkilos. - Ang Solicitor General o isang pampublikong taga-usig, kapag inutusan ng Pangulo
ng Pilipinas, o kapag may reklamo o kung hindi man ay may magandang dahilan upang maniwala
magsimula ng pagkilos na may pahintulot ng korte. - Ang Solicitor General o isang pampublikong
taga-usig ay maaaring, sa pahintulot ng korte kung saan isinampa ang kaso, magdala ng naturang
nagdadala nito ay maaaring unang humingi ng indemnity para sa mga gastusin at gastos ng
pagkilos sa isang halagang inaprubahan at ideposito sa korte ng tao kung saan ang kahilingan at
susunod na seksyon, ituturo ng hukuman na ang paunawa ay ibibigay sa sumasagot upang siya
ay marinig sa pagsalungat dito; at kung ang pahintulot ay ipinagkaloob, ang korte ay dapat mag-
isyu ng isang order sa epekto, ang mga kopya nito ay ihahatid sa lahat ng mga interesadong
partido, at ang petisyon ay dapat na iharap sa loob ng panahong iniutos ng korte. (5a)
Seksyon 5. Kapag ang isang indibidwal ay maaaring magsimula ng gayong pagkilos. - Ang
Seksyon 6. Mga Partido at nilalaman ng petisyon laban sa pag-usig. - Kapag ang pagkilos
ay laban sa isang tao na nag-usurp ng isang pampublikong tanggapan, posisyon o franchise, ang
petisyon ay dapat magtakda ng pangalan ng taong nag-claim na may karapatan dito, kung
labag sa batas na pag-aari nito. Ang lahat ng mga tao na inaangkin na may karapatan sa
maaaring dalhin lamang sa Korte Suprema, sa Court of Apeals, o sa Regional Trial Court na
nagsasagawa ng jurisdiction sa teritoryal na lugar kung saan ang sumasagot o sinuman sa mga
sumasagot ay naninirahan, ngunit kapag nagsimula ang Solicitor General ng pagkilos, maaaring
dalhin ito sa isang Regional Trial Court sa Lungsod ng Manila, sa Court of Appeals, o sa Korte
Suprema. (8a)

opisyal na bond na iniaatas ng batas, dalhin sa kanyang sarili ang pagpapatupad ng opisina, at
maaaring pagkatapos ay kaagad na hingin ang sumasagot sa lahat ng mga libro at mga papeles
alinsunod sa naturang demanda, maaaring siyang parusahan para sa pag-urong bilang pagsuway
sa isang batas na kautusan ng korte. Ang taong pinahihintulutan na may karapatan sa tanggapan
ay maaari ring magdala ng pagkilos laban sa sumasagot upang mabawi ang mga pinsalang

pagkilos para sa mga pinsala alinsunod sa mga probisyon ng susunod na seksyon maliban kung
ang parehong ay magsimula sa loob ng isang (1) taon pagkatapos ng pagpasok ng paghatol na
