Dear Mr. Harris:

I write on behalf of my client, the Rock Island County Clerk, and submit this letter
as her response to appellants’ petition for writ of certiorari, which was extended by order of
the Court to July 30, 2018. Appellants are challenging federal and state laws governing the
voting rights of United States citizens who move to certain United States territories.

The Rock Island County Clerk is the local election authority responsible for
managing and administering elections in Rock Island County according to state statute. The
Rock Island County Clerk follows federal and state election laws, as interpreted from time
to time by the courts. The Rock Island County Clerk does not create policy with respect to
elections. The Illinois Attorney General was notified by the Chicago Board of Election
Commissioners, a similarly situated appellee in this matter, about the petition for writ of
certiorari. The purpose of the notice as per Illinois Supreme Court Rule 19(c), provides the
Attorney General “with the opportunity, but not the obligation, to intervene in the cause or
proceeding.” The Illinois Attorney General may, but is not required to, represent the people
of the State of Illinois before the supreme court in all cases in which the State or the people
of the State are interested. 15 ILCS 205/4: Duties of the Attorney General. The Illinois
Attorney General’s Office has declined to appear as the State of Illinois is not a named party
in this proceeding.

The Rock Island County Clerk does not take a position on appellants’ petition for
writ of certiorari. However, if the Court requires additional information, such information
will be provided as promptly as possible.
