WAIVER RELEASE AND INDEMNITY AGREEMENT

In consideration of permitting me, ________________________________________ (herein referred

to as “Guest”), to visit Danjugan Island through its Nature Tourism Program managed by the
Philippine Reef and Rainforest Conservation Foundation, Inc. (PRRCFI) at Brgy. Bulata,
Cauayan, Negros Occidental, Philippines on _________________________________________
(dates, herein referred to as “Visit”).

I hereby voluntarily release, discharge, waive and relinquish my right to any and all actions or
causes of action as a result of engaging in the Visit or any activities incidental thereto,
wherever or however the same may occur, and for whatever period said activities may
continue. I, myself, my heirs, executors, administrators, and assigns hereby release, waive,
discharge and relinquish any right to an action or causes of action which may hereafter arise
and agree that under no circumstances will I or any of my heirs, executors, administrators, and
assigns prosecute or present any claim against PRRCFI.

I, acting for myself, my heirs, executors, administrators, and assigns, agree that in the event
any claim shall be prosecuted against PRRCFI, I, myself, my heirs, executors, administrators,
and assigns shall indemnify and release PRRCFI from any and all claims or causes of action.

I acknowledge that I have read the foregoing and I am fully and completely advised of the
potential dangers in engaging in the Visit and am fully aware of the legal consequences of
signing this instrument.
