EXTRAJUDICIAL SETTLEMENT OF ESTATE OF ANDRES M. ECLEO WITH DEED OF ABSOLUTE SALE KNOW ALL MEN BY THESE PRESENTS: This AGREEMENT, made and entered into by and among CRISTULANO A. ECLEO, SR. of legal age, Filipinos citizen, widower, and RUDEN D. ECLEO, of legal age Filipino, married, and a resident of P-2 Barangay Matingbe, San Jose, Province of Dinagat Islands; \WITNESSETH: THAT- WHEREAS, in the year December27, 1965, Andres Ecleo, died intestate at Home in Barangay Matingbe, Dinagat, Surigao del Norte, leaving a certain residential land located at Aurelio, San Jose, Province of Dinagat Islands, consisting of (1.7208) hectares more or less, with the following boundaries, on the North by PIN # 020, PIN # 02; on the South by Barangay Boundary of Matingbe, on the East by Sec. 027, and on the West by Sec. 025, for being a portion of residential land consisting an area of (125) One Hundred Twenty Five square meters, Lot/Project lot No. 321, GSS-13-000179-D and bounded on the North along line 4-1 by an alley, (on the South along line 2-3 by a pathway, on the East along lines 1-2 by an alley, and on the ‘West along lines 3-4 by a pathway; All of Gss-13-000179-D. This Property is covered by Tax Dec. No. 17-06-0002-03577 5" GR,, in the name of Andres M. Ecleo; WHEREAS, the party hereto they the sole and only surviving heirs of the decedent entitled to succeed to they estate, being their surviving children; WHEREAS, it isto the best interests of the party hereto to divide, partition and adjudicate by and among themselves the entire above-described land in equal shares invoking Section 1, Rule 74 of the New Rules of Court, subject however, to contingent liabilities to creditors, heirs or other persons who might have been deprived of lawful participation in the estate of the decedent, for the period of two years from and after the settlement and distribution thereof Pursuant to Section 4, Rule 74 of the Rules of Court; and That in the remote event that any other property of the decedent should ever be found which is not herein included, the parties hereto further agree as they do so agree to settle and distribute the same in ike manner and proportion as above established; WHEREAS, there are no known debts or obligations due against the estate of said decedent; That, for and in consideration of the sum of FIVE THOUSAND PESOS ONLY (P5,000.00), Philippine Currency, to us in hand paid and acknowledged to my full and entire satisfaction, | hereby SELL, CEDE, and CONVEY by way of Absolute Sale unto, ALFREDO GIPAYO AMANDORON, who is likewise of legal age, Filipino, married, a resident of P-4, Aurelio, San Jose, Province of Dinagat Islands, his heirs, successors and assigns, a portion of the property described above.
