P E T I T I O N

COMES NOW, the Petitioner, through the undersigned counsel and


unto this Honorable Court, most respectfully alleges that:

THE PARTIES

1. Petitioner is of legal age, married, Filipino, and residing at Brgy.


__________, _____________________, ___________________ and for
purposes of this petition, petitioner can be served with summons and
notices of this Honorable Court at the undersigned counsel’s address at
LCR Law Offices, Unit 5, Bank of Makati Building, Roxas Drive,
Lumangbayan, Calapan City, Oriental Mindoro;

2. Respondent, Register of Deeds of ________________, is being


impleaded as a necessary party holding office at Brgy.
______________________ where he/she may be served with summons and
other court notices;

FACTS OF THE CASE

3. That the petitioner is the lawful owner of a certain parcel of land


located in Brgy. Mangarin, San Jose, Occidental Mindoro with an area of
Fifty Two Thousand One Hundred Sixty One (52,161) Square Meters
identified as Transfer Certificate of Title No. T-1476 also known as Lot
2426;

4. That the original owner’s duplicate copy of said certificate of title was
lost and misplaced and despite diligent efforts exerted to find or locate it,
the same proved futile and to no avail;

5. That the petitioner caused the reporting of said loss to the Register of
Deeds of Occidental Mindoro Branch for the annotation of the same at the
back of said certificate of title hereto attached. Said Memorandum of
Encumbrances1 which was annotated at the back of said title is hereto
attached and the annotation of the same to Transfer Certificate of Title No.
T-1476 marked as Annex”A”;

6. That the owner’s duplicate copy of said title has not been delivered to
any person or entity in order to secure any performance of any obligation
whatsoever.

THE PRAYER

WHEREFORE, invoking the provisions of Act No. 490 and Section


109 of the Property Registration Code, petitioner most respectfully prays of
this Honorable Court to issue an Order declaring as null and void the
owner’s duplicate copy of Transfer Certificate of Title No. T-1476 and
direct the Registry of Deeds of Occidental Mindoro to issue in lieu thereof
the new owner’s duplicate copy of said certificate of title which shall in all
respect be entitled to like faith and credit as the original thereof upon
payment of the prescribed fees.
