1.Equal Opportunity for Employment. – No person with disability shall be denied access to

opportunities for suitable employment. A qualified employee with disability shall be subject to

the same terms and conditions of employment and the same compensation, privileges, benefits,

fringe benefits, incentives or allowances as a qualified able bodied person.

"At least one percent (1%) of all positions in all government agencies, offices or corporal ions

shall be reserved for persons with disability: Provided, That private corporations with more than

one hundred (100) employees are encouraged to reserve at least one percent (1%) of all positions

for persons with disability."

2. Minimum wage. - (a) Every employer shall pay to each of his employees who is employed by

an enterprise other than in agriculture wages at the rate of not less than -

(1) Four pesos a day on the effective date of this Act and thereafter, for employees of an

establishment located in Manila or its environs;

(2) Three pesos a day on the effective date of this Act and for one year after the effective

date, and thereafter P4 a day, for employees of establishments located outside of Manila

or its environs; Provided, That this Act shall not apply to any retail or service enterprise

that regularly employs not more than five employees.

ART. 99. Regional minimum wages. - The minimum wage rates for agricultural and non-

agricultural employees and workers in each and every region of the country shall be those

prescribed by the Regional Tripartite Wages and Productivity Boards.


3. Overtime -All employees required to work beyond eight hours in one workday
is entitled to overtime pay. The basis of overtime pay is found in Article 87 of the Labor Code.

Article 87. Overtime work.

Work may be performed beyond eight hours a day provided that the employee is paid for

the overtime work an additional compensation equivalent to his regular wage plus at least

twenty-five percent thereof. Work performed beyond eight hours on a holiday or rest day shall be

paid an additional compensation equivalent to the rate for the first eight hours on a holiday or

rest day plus at least 30 percent thereof

4. Child Labor

 A child below 15 years old can be permitted to work if he/she is under supervision by

family senior/ parents provided that the child works directly under the sole responsibility

of his/her parents or legal guardian.

 The child’s employment does not endangers his/her life, safety, health, and morals, or

impairs his/her normal development.

 The parent or legal guardian shall provide the said child with the prescribed primary

and/or secondary education. And The employer first secures a work permit for the child

from the Department of Labor and Employment (DOLE).

Children aged 15 to below 18 years of age are permitted to work in any economic activity not

considered child labor, but not more than eight (8) hours a day and in no case beyond forty (40)

hours a week. They shall not be allowed to work between 10:00 P.M. and 6:00 A.M. of the

following day, and employer should provide the child with access to at least elementary and

secondary education.
