COMPLAINT-AFFIDAVIT

I, FATIMA SAQUILAYAN, 42 years old, married, and a resident of 122 San Enrique, Corner
Bartolome Street, Ayala Alabang Subdivision, Muntinlupa City, Philippines, after being sworn to
in accordance with law, do hereby depose and state that:

1. I am the wife of Ian Ben Saquilayan, 46 years old, a Pediatrician in Gentri Doctors Medical
Center at Baranggay Manggahan, Sesame Street, City of General Trias, Cavite. A copy of
our marriage certificate is hereunto attached and made as an integral part of this complaint-
affidavit as Annex “A”;
2. At about 6:00 pm of February 10, 2019, while I was driving in the busy streets of General
Trias City to pick up my husband from work, I received an SMS message from him saying
“Happy Anniversary to my wife! I already reserved a table for two in Gerry’s Grill
Gentri.”;
3. At exactly 6:20 pm, I arrived at Gentri Doctors Medical Center, I decided to park my car
near the entrance door so my husband can easily have a glimpse of me waiting for him. A
few moments later, he approached me in the parking lot and uttered me the following
words, “My client asked if I can meet him for a while, saglit lang ‘to. I’ll be here after 15
minutes. Wait for me”;
4. Upon considering that it was actually urgent for him to meet this certain client, I waited for
him patiently and assumed that his appointment would not take long since we have a
reservation to catch. However, instead of waiting for a few minutes, it took me two (2)
hours yet there was still no presence of him. I constantly send him messages and calls,
unfortunately, he was unresponsive;
5. I immediately went to his office to see his whereabouts, however, the door was locked. I
approached the security guard to unlock the said door, and upon opening it, I saw my
husband lying helplessly on the floor, soaked with his own blood. Shockingly anxious and
lost for words, I asked for people within the said area if they know who was behind the
death of my husband;
6. A certain Aira Camille Alfaro (disinterested witness), who is the head nurse of the hospital,
said that a client named Aristotle Cruzate had an appointment with Doctor Ian Ben
Saquilayan. Ms. Alfaro narrated that she heard a commotion between the two people, but
decided not to interfere because she presumed that everything is under control. A few
minutes later, she saw Aristotle Cruzate leaving the room swiftly, he was sweating a lot as
he suspiciously left the room while cleaning his blood-stained knife with a handkerchief.
Due to her fear of involvement, she decided not to apprehend the perpetrator. The sworn
statement of Ms. Alfaro is hereunto attached and made an integral part of this complaint as
Annex “B”;
7. Wilbur Saquilayan, 20 years old, a medical intern enrolled as a student of Lyceum of the
Philippines University, and the only son of Ian Ben, narrated that he was actually going to
surprise his father from office until he saw Luis Aristotle Cruzate quickly descending the
stairs while inserting a sharp object covered with handkerchief inside his bag. He said that
Cruzate was calling someone thru his cellphone saying “Napatay ko na din yung doctor”.
Bothered and furious, he secretly followed Cruzate until the latter was pick up by a black
Honda Civic car with plate number “TFQ 576”. When he went at his father’s office, he
noticed that the door was lock so he assumed that the latter might have left early. The sworn
statement of my son, Wilbur Saquilayan, is hereunto attached and made an integral part of
this complaint as Annex “C”;
8. My husband was immediately rushed to the Emergency Room of the said hospital, and
upon examination, he was declared “dead on arrival”. Chris Evans, Medico-Legal Officer
of the National Bureau of Investigation, performed an autopsy on the cadaver of my
husband and signed his autopsy report, he attested that Saquilayan’s cause of death was
cardiac arrest due to multiple stab wounds on the thorax. A copy of his Postmortem
Findings, his Certificate of Death, and a certification from the City Civil Registrar of Ian
Ben Saquilayan are hereunto attached and made an integral part of this complaint as Annex
“D”, “E”, “F” respectively;
9. The CCTV operator of the said establishment also gave us a clear copy of the footage
wherein it clearly indicated that Cruzate actually committed the brutal crime against my
husband. A copy of the CCTV footage is hereunto attached and made as an integral part of
this complaint as Annex “G”.
10. I immediately report the killing incident of my husband on or about 1:00 pm at the General
Trias Police Station which is the nearest police station. The original copy of the excerpt of
the police blotter duly issued by Senior Police Inspector Garcia of General Trias Police
Station is hereunto attached and made as an integral part of this complaint as Annex “G”;
11. Upon consultation with my lawyer, I understand that the acts of the accused qualify for
MURDER punishable under Article 248 of the Revised Penal Code.
12. I am therefore executing this affidavit freely and voluntarily in support of my intent to file
a case for MURDER and/or the appropriate criminal case against Aristotle Cruzate, who is
30 years of age, and a resident of Block 9, Lot 1, Governor Hills Subdivision, City of
General Trias, Cavite, Philippines.

COUNTER-AFFIDAVIT

I, ARISTOTLE CRUZATE, 30 years old, married, and a resident of Block 9, Lot 1, Governor
Hills Subdivision, City of General Trias, Cavite, Philippines, after being sworn to in accordance
with law, do hereby depose and state that:

1. I am the respondent in Criminal Case NPS Docket No.: V-02-INV-11B-0913 for the crime
of Murder under the Revised Penal Code;
2. I am executing this Counter-Affidavit as a reply and comment to the Complaint-Affidavit
of FATIMA SAQUILAYAN, and Affidavit of Witnesses of AIRA CAMILLE ALFARO
and WILBUR SAQUILAYAN, who are under investigation by this Honorable Court in
connection with the death of IAN BEN SAQUILAYAN on the 10th of February 2019.
3. I am the father of Brianne Cruzate, 6 years old, enrolled as a Grade One student in Navarro
Elementary School at Barangay Manggahan, City of General Trias, Cavite. A copy of the
birth certificate is hereunto attached and made as an integral part of this counter-affidavit
as Annex “A”;
4. On February 9, 2019, due to my daughter’s severe rashes, I decided to consult a doctor in
Gentri Doctors Medical Center at Sesame Street, General Trias City, Cavite. A pediatrician
named Ian Ben Saquilayan was assigned to us, the latter requested me to leave his office
for a while so can can personally examine my daughter;
5. At exactly 1:30 pm, I returned to his office to see what possible remedy would cure my
daughter’s severe and irritable rashes. Doctor Saquilayan, looking furious and agitated,
abruptly handed the prescriptions indicating the ointments that would lessen the irritation
brought by eczema (rashes). He even requested us to immediately leave because an
important client will be meeting him. A copy of the prescription given by Doctor
Saquilayan is hereunto attached and made an integral part of this counter-affidavit as
Annex “B”;
6. My daughter, who is feeling unwell, seemed that her eyes were swollen to tears, I asked
what is bothering her but she refused to disclose the reason behind it. When we arrived at
the house, she immediately told me that she was sexually harassed by Ian Ben Saquilayan,
her pediatrician. I immediately went to the nearest OB-Gyne to confirm whether or not
there is veracity in her statement, unfortunately, the gynecologist told us that she was
actually raped. Upon the latter’s findings, the vaginal lacerations in her orifice is so
extensive that it even caused the tearing of her hymen. Furthermore, there were even semen
and male sperm cells found in her vaginal canal determining that her pediatrician actually
had carnal knowledge with her. A copy of the gynecologist’s examination report is
hereunto attached and made an integral part if this counter-affidavit as Annex “C”.
7. On February 10, 2019, at 6:30 pm, I decided to confront Ian Ben Saquilayan regarding
what he did to my daughter. We talked in his office but the latter denied all the allegations
I asserted him. I even requested him to pay for what he did, but he impetuously said that
he should be going because he had a ‘wedding anniversary’ to catch. Aggrieved, I
confronted him that I will disclose his disgraceful secret to his family and friends by filing
a case for Statutory Rape for taking advantage of my daughter;
8. Unknowingly, Ian Ben Saquilayan suddenly stab himself multiple times in his chest
causing his untimely death;
9. Afraid that I might be accused of Mr. Saquilayan’s death by reason of his willful and
voluntary suicidal act, I consequently left the room and leave the place for good;
10. One of the hospital employees named Efren Penaflorida even testified that Ian Ben
Saquilayan indeed committed suicide because of depression caused by financial
bankruptcy. Hence, a suicidal letter written by Mr. Saquilayan was recovered in his drawer.
A copy of the suicidal letter is hereunto attached and made an integral part if this counter-
affidavit as Annex “D”;
11. Although Ian Ben Saquilayan and I had an argument in settling the controversy concerning
his unforgiving crime against my daughter, still, I never had the intention to kill him. In
fact, the only reason of confronting him is to demand for reasonable compensation due to
my daughter;
12. I am executing this Counter-Affidavit freely and voluntary for the purpose of attesting the
truth of the foregoing statements, to inform the proper authorities of the above facts, to
support my prayer for the dropping or dismissal of the instant case against me and for
whatever purpose this may serve best.
