MOTION FOR RECONSIDERATION

BID NO. DSWD7-PB-2018-01

WHOLESALE AND RETAIL TRADING through undersigned representative

hereby submits this Motion for Reconsideration under Sec. 55.1 of the 2016
Revised Implementing Rules and Regulations of Republic Act 9184 which reads:

“55.1. Decisions of the BAC at any stage of the procurement process may be
questioned by filing a request for reconsideration within the three (3) calendar
days upon receipt of written notice or upon verbal notification. The BAC shall
decide on the request for reconsideration within seven (7) calendar days from
receipt thereof. The bidder shall not be allowed to submit additional documents to
correct any defects in the bid submitted.”

On January 01, 2018, the Bids and Awards Committee (BAC) held the
Opening of Bids for BID NO. DSWD7-PB-2018-01. WHOLESALE AND RETAIL
TRADING was declared as Eligible and Complying with the technical
requirements upon the opening of the first envelope. However, upon opening the
second envelope which involves the Financial Component of the bid, the BAC
discovered the absence of a BID FORM. It was explained to us that due the
absence of the BID Form, we were to be declared as “disqualified to bid.”

This Motion for Reconsideration is hereby submitted within three (3)

calendar days upon the verbal notification of our disqualification to bid.

It is with our utmost prayer that Honorable Committee reconsiders our bid
under the following grounds:

1. WHOLESALE AND RETAIL TRADING have substantially complied with

the Financial Component of the Bid where a Financial Proposal Sheet
was submitted showing our bid prices. Under Item 13.1 paragraph (a)
of ITB No. DSWD7-PB-2018-01, it states:

“xxx a. Financial Bid Form, which includes bid prices and the applicable
Price Schedules, in accordance with ITB Clauses 15.1 and 15.4;”

The Financial Proposal Sheet submitted by WHOLESALE AND RETAIL

TRADING completely contains the detailed financial figures for our bid.
 In fact, the BID PRICE for each lot (lot 1-3) were indicated in the
document submitted. The Financial Proposal Sheet indicates a total
BID Price of Php 11,600,542.00 with the following breakdown:

BID Price for Lot 1 – Php 6,000,000.00

BID Price for Lot 2 – Php 1,000,000.00
BID Price for Lot 3 – Php 3,000,000.00

Indeed, WHOLESALE AND RETAIL TRADING has substantially

complied with the requirement to indicate and show the bid prices,
which includes the unit price, total price and total quotation for each
lot.

2. The lack of the formal requirement of a BID Form was made in

inadvertently. WHOLESALE AND RETAIL TRADING has the BID Form
already prepared, however, for some reason, it was not included in the
documents that we submitted. The BID FORM that we prepared also
contains the same information that was submitted in our Financial
Proposal Sheet, which indicate BID prices for lots 1,2 and 3.

Thus, it is our fervent prayer, unto this Honorable Committee to reconsider

the decision to disqualify WHOLESALE AND RETAIL TRADING for failure to
submit a BID FORM. Further, we pray that this Honorable Committee see that
WHOLESALE AND RETAIL TRADING has substantially complied with the
requirements, and accept our submission of the BID FORM which is attached to
this Motion for Reconsideration.

Also attached in this Motion for Reconsideration is a copy of the Financial

Proposal Sheet which we submitted on our bid. Both documents show the same
information and we hope that this Honorable Committee appreciate the fact that
indeed there was substantial compliance with the Financial Component
requirement of the bid.

Therefore, premises considered, it is most respectfully prayed unto this

Honorable Committee that:

1. The Bids and Awards Committee find that WHOLESALE AND RETAIL
TRADING as substantially complied with the Financial Component
requirement of the BID;
2. The attached BID FORM be accepted and considered.

Other reliefs just and equitable and likewise prayed for.
