The Effects of the Provisorische Civilprozessordnung to the Hungarian Procedural

Codification
During the Neo-Absolutistic Era, the Provisorische Civilprozessordnung of 1852 came into
force in Hungary. This code followed the Allgemeine Gerichtsordnung of Joseph II and based
on the written procedure. The Judex-Curial Conference of 1861 did not sustain this code. After
the Austro-Hungarian Compromise, the reform of the structure of jurisdiction and the
procedural law emerged. The prior was immediately executed (e.g. Act IV of 1869 on the
exercise of judicial power). However, a temporary procedural code, the Act LIV of 1868 was
enacted, which was also based on the written procedure. With the help of the jurisprudence and
archive sources, the paper demonstrates the elements of the Code, which originate from the
Provisorische Zivilprozessordnung.
