FACTS:

Andres Pablo, a policeman of a municipality of Balanga, together with Tomas De Leon, a fellow
constable, conducted a raid in the barrio of Tuyo, which according to an information lodged, a
jueteng game is being conducted. After the search, tambiolo (receptacle) and 37 bolas (balls),
were obtained from the operation and Francisco Dato, was arrested. The defendant claimed that
two cabecillas namely Maximo Malicsi and Antonio Rodgrigo were seen, but were not arrested
as these two ringleaders managed to escape through the hills. At the hearing of the case, Dato
pleaded guilty while Malicsi and Rodgrio pleaded the not guilty. The defendant testified that during
the said operation, he did not see the accused Malicsi and Rodrigo and only Dato was actually
seen on a low table where the jueteng game suspectedly being held on. These claims resulted to
the acquittal of Malicsi and Rodgrio, and conviction of Dato as a gambler.

However, it has been known, that Pablo had an interview and conference with the accused Malicsi
and Rodrigo in the house of Valentin Sioson, before the case went into the trial, wherein they
agreed to give Pablo P20
