Andres Pablo

FACTS:

 At noon of October 21, 1915, Andres Pablo (defendant) by order of his chief raided barrio
Tuyo where according to the information lodge a jueteng is being conducted.
 Prior to the defendant’s arrival, other players has already absconded except Francisco
Dato.
 After searching the area, defendant also found the tambiolo (receptacle) and 37 bolas
(balls)
 He also seen Antonio Rodrigo and Maximo Malicsi leave the area but refrained arresting
them as he had seen no material proof that the game was being held
 The defendant’s report states that he raided the jueteng game and seized a tambiolo and
bolas and he saw Francisco Dato (gambler); Maximo Malicsi and Antonio Rodrigo
(Cabecillas – ringleaders) but the latter escaped.
 Subsequently, Jose D. Reyes (chief of police), filed a complaint against Rodrigo, Malicsi
and Dato. Dato pleaded guilty, while Rodrigo and Malicsi pleaded not guilty
 At the trial of the case, defendant testified under oath that he and Tomas De Leon
testified under oath that on the date mentioned he and Tomas de Leon went to the said
barrio to raid a jueteng game, but that before they arrived there they say from afar that
some persons started to run toward the hills; that when witness and his companion
arrived at a vacant lot they saw Francisco Dato and a low table there, and the table
caused them to suspect that a jueteng game was being carried on. but that they did not
see the accused Rodrigo and Malicsi on the said lot, nor did they see them
run; and that only afterwards did the witness learn that these latter were the cabecillas
or ringleaders in the jueteng game, from information given him by an unknown person
 The RTC sentenced Dato and acquitted Rodrigo and Malicsi
 Before the trial, the defendant, Rodrigo and Malicsi had an interview and conference at
the house of Valention Sioson. On this occasion, he was instructed to to testify against
Rodrigo and Malicsi and in fact was given the sum of P5.00 through Gregorio Ganzon
 By these reason, the defendant was charged with the crime of perjury under Sec 3 of Act
1697 on December 1, 1915
 On December 28, 1915, the defendant was sentenced to two years imprisonment and fine
of P100. The defendant was also disqualified from the service and from holding any
public office
