MOTION FOR THE ISSUANCE OF BREAK OPEN ORDER

Complainants, by and through the undersigned counsel,

with all due respect submits this Motion.

A decision was rendered by the Sixth Division of the NLRC

in the above-titled case dated February 28, 2017 favorable to
complainants.

In order for respondents to comply with its obligation to

pay the judgment award, a personal property in the name of one
of the respondents was attached to this case however, despite
such attachment, the judgment award was not yet paid by
respondents;

Considering that the decision became final and re-

computation was done but not yet settled, then selling the
attached property to satisfy respondents’ obligation to pay
herein complainants is proper.

WHEREFORE, considering the above premises, it is most

respectfully prayed that a Break Open Order is to be issued for
the enforcement of the judgment award.

Other relief just and equitable are likewise prayed for.
