PETITION FOR PROBATE OF WILL

PETITIONER, by undersigned counsel, and to this Honorable Court respectfully avers

that:

1. The petitioner, of legal age, and resident of Camantiles Urdaneta City, Pangasinan,
is the executor named in the last will and testament of BYRON C. CLARO, deceased,
who died in the Baguio General Hospital on December 31, 2018;

2. A photostatic copy of the said last will and testament is hereto attached as Annex
“A” and made an integral part of this petition, the original thereof to be presented to
this Honorable Court at the time of probate;

3. The subscribing witnesses to said will are: Maria A. Perez, Lemwil B. Dacanay &
Krisha Mae P. Manalo, all of whom are residents of Camantiles Urdaneta City,
Pangasinan;

4. The decedent is an inhabitant of the Philippines and a resident of Camantiles

Urdaneta City, Pangasinan at the time of his death;

5. The said BYRON CORPUZ CLARO executed and left said last will and testament in
accordance with the formalites of the Republic of the Philippines, said last will and
testament (photostatic copy only) dated January 24, 2010, is hereto attached as
Annex B and made an integral thereto;

5. The Petitioner, named in the will as executor thereof, is legally qualified to act as
such and hereby consents and agrees to accept said trust;

6. The following persons, all of age, have been named in the said will as devisees of the
deceased, to wit:

Robyn Summer T. Claro DAUGHTER 24 66 Second St., Veterans Village, QC

Noreen T. Claro WIFE 50 66 Second St., Veterans Village, QC

7. The property left by the decedent consists of real and personal property, the gross
value of which is Fifty Million Pesos (P50, 000, 000.00).

PRAYER
WHEREFORE, it is respectfully prayed:
1. That, upon proper notice and hearing, the abovementioned Last
Will and Testament be admitted to probate;
2. That letters testamentary be issued to herein petitioner;
3. That such other relief be granted as may be deemed just and

I, WINTER LELAND M. SANTOS, of legal age, single, Filipino and a resident of

Camantiles, Urdaneta City Pangasinan, after being duly sworn in accordance with law,
depose and say that:

1. I am the petitioner in the above-entitled case for PETITION FOR PROBATE OF

WILL OF THE LATE BYRON CORPUZ CLARO;

2. I have caused the preparation and filing of the foregoing complaint;

3. I have read and understood the contents thereof, and the same are true and correct
to the best of my personal knowledge and based on authentic documents;

4. I have not commenced any other action or proceeding involving the same issue in
the Supreme Court, the Court of Appeals, or the different divisions thereof, or any
other tribunal or agency;

5. To the best of my knowledge, no such action or proceeding is pending in the

Supreme Court, the Court of Appeals, or the different divisions thereof, or any other
tribunal or agency;

6. If I should hereafter learn that a similar action or proceeding has been filed or
pending in the Supreme Court, the Court of Appeals, or the different divisions thereof,
or any other tribunal or agency, I hereby undertake to inform this Honorable Court of
such fact within five (5) days from such notice.
