Constitution – Tribal Communities
The tribal population of the country, as per the 2001 census, is
8.43 crores, constituting 8.2 % of the total population.
Article 342 of the Constitution.
They are the people who have been living in
Remote forest areas and hill tracks as tribes without any access
to modern socio-economic inputs.
Popularly believed to constitute the aboriginal element in Indian
society.
Most tribals share certain common features like, nature of
rurality, illiteracy, economic backwardness, and social
deprivation.

Tribal communities in India have their own history of
struggles for identity, citizenship, survival, representation and
pro-people development.
In the quest of governing the tribal territories the tribes
evolved their own system of governance for the purpose of
regulating the individual and communal behaviour of the
people in the society.
The forest occupies a central position in tribal culture and
economy.
The tribal way of life is very much dictated by the forest right
from birth to death.

Scheduled Areas
Art. 244 of the Constitution - two categories -
Tribal Areas:
i. Fifth Schedule: for the administration and
control of the Scheduled Areas and Scheduled
Tribes in any State other than the (States of
Assam, Meghalaya, Tripura and Mizoram)
ii. Sixth Schedule: for the administration of
Tribal Areas in the States of Assam,
Meghalya, Tripura and Mizoram.
Fifth Schedule
The Fifth Schedule under Article 244(1) of Constitution
defines “Scheduled Areas” as such areas as the President
may by Order declare to be scheduled areas after
consultation with the Governor of that State.
The criteria for declaring any area as a “Scheduled Area”
under the Fifth Schedule are:-
• Preponderance of tribal population,
• Compactness and reasonable size of the area,
• A viable administrative entity such as a district, block
or
• taluk, and, Economic backwardness of the area as
compared to neighbouring areas.
Applicability

Article 243M of the Constitution, inter-alia,

provides that the general provisions pertaining
to Panchayats in Articles 243A to 243L in Part
IX of the Constitution shall not apply to
Scheduled Areas
Dhilip Singh Bhuria Committee - 1994
• The Ministry of Rural Development, Government of
India, appointed a 22 member committee
• Comprising select Members of Parliament and
Experts headed by Dilip Singh Bhuria to
recommend exceptions and modifications in Part IX
of the Constitution in its application to the
Scheduled Areas.
• The Committee submitted two Reports in 1995, one
for Panchayats and the other for Municipalities.
The Bhuria Committee concluded that:
• ‘Tribal life and economy, in the not too distant past, bore a
harmonious relationship with nature and its endowment.
• It was an example of sustainable development.
• But with the influx of outside population, it suffered
grievous blows.
• The colonial system was established on the basis of
expropriation of the natural and economic resources of
tribal and other areas in the country.
• The principles enunciated in Article 39 and other Directive
Principles of State Policy have to be followed more
rigorously.

• On account of their simplicity and ignorance, over the
decades the tribals have been dispossessed of their
natural and economic resources like Land, Forest,
Water, Air etc.
• The dispossession has not been confined to that
through private parties.
• For the purpose of promotion of general economic
development projects, the State also has been
depriving them of the basic means of livelihood.
• These processes have been operative since a long time
causing human misery and socio-economic damage.

Panchayats Ext. to Scheduled Areas
With State legislation enjoined to give
primacy to communities to manage their
affairs in accordance with traditions and
customs Article – 244(1)
Definition of Village
{section 4 (b)}, a village shall ordinarily consist
of a habitation or a group of habitations or a
hamlet or a group of hamlets comprising a
community and managing its affairs in
accordance with traditions and customs.
PESA – Gram Sabha
Definition Gram Sabha

Under the PESA Act, {section 4 (c)}, every village

shall have a Gram Sabha consisting of persons
whose names are included in the electoral rolls for
the Panchayat at the village level.
PESA exclusively empowers Gram
Sabha to…..
safeguard and preserve the (a) traditions and customs
of the people, and their cultural identity, (b) community
resources, and (c) customary mode of dispute
resolution
carry out executive functions to
approve plans, programmes and projects for social
and economic development;
identify persons as beneficiaries under the
poverty alleviation and other programmes;
issue a certificate of utilization of funds by the
Panchayat for the plans; programmes and projects
PESA empowers Gram Sabha/

right to mandatory consultation in land acquisition,
resettlement and rehabilitation of displaced
persons
panchayat at an appropriate level is entrusted with
planning and management of minor water bodies

licenses/lease for mines and concession for the
exploitation of minor minerals

Importance of PESA
It will enhance people’s participation in
decision making.
Reduce alienation in tribal areas as they will
have better control over the utilization of
public resources.
Reduce poverty and out-migration among
tribal population as they will have control and
management of natural resources will
improve their livelihoods and incomes.

Minimize exploitation of tribal population as they
will be able to control and manage money lending,
consumption and sale of liquor and also village
markets.
Effective implementation of PESA will check illegal
land alienation and also restore unlawfully alienated
tribal land.
Most importantly PESA will promote cultural
heritage through preservation of traditions, customs
and cultural identity of tribal population.

Andhra Pradesh Panchayat Raj (Amendment) Act, 1998
promotes self governance, giving a central role to Gram
Sabhas, is vital to safeguard the interests of the people living
in the Schedule-V areas w.e.f. 24.03.2011
Sections 242-A to 242-I under Part VI-A of the Andhra
Pradesh Panchayat Raj Act, 1994
The villages in scheduled areas in the districts of
Srikakulam,
Vizianagaram,
Visakhapatnam,
East Godavari,
West Godavari
AP PESA & GRAM SABHA
Every village declared in the aforesaid manner shall
have a Gram Sabha comprising of adult members,
whose names are included in the electoral rolls at the
village level.
The Sarpanch of the Gram Panchayat shall be the
President of the Gram Sabha. The Gram Sabha shall
elect a Vice President and Secretary as per the
procedure prescribed below.
Project Officer of the concerned Integrated Tribal
Development Authority shall depute an officer not
below the rank of a Deputy Thasildar for convening
the first Gram Sabha

The quorum for the Gram Sabha meeting shall be
not less than 1/3rd of members of Gram Sabha of
whom at least 50% shall be ST members.
The Gram Sabha shall elect a Vice President and
Secretary from among the members of the village
by show of hands. The Vice President and the
Secretary shall be from the Scheduled Tribe and the
tenure shall be 5 years.
There shall be at least two statutory meetings of
Gram Sabha in a year.

An attendance register shall be maintained in
which the presiding Member shall obtain the
signatures or thumb impressions
At the end of each meeting of Gram Sabha, the
presiding Member shall read the proceedings of
the Gram Sabha and get the approval of the
Members.
Resolutions passed during the meeting of the
Gram Sabha shall be recorded in a register –
Signatures – Communication to concerned
department within 4 weeks
PESA Gram Sabha - Agenda
village agricultural production plans;
list of the location of the common lands in the
villages i.e. Porambokes etc. vesting in Panchayat
and other relevant particulars;
list of transfers of ownership of houses and other
immovable properties;
A copy of the approved budget estimates of the
Gram Panchayat;
A copy of the audit report on the accounts of the
Panchayat;

A list of defaulters, who are in arrears of payment
of taxes and fees due to Gram Panchayat;
Functioning of fair price shop / D.R. Depot;
Anganwadis; sub centers; schools, welfare hostels
Provision of drinking water electricity; and any
other development programmes
The Gram Sabha shall prepare and approve socio
economic profile the identification and the
implementation of individual /community
development programmes

The Gram Sabha shall furnish certificate of
utilization of funds to the concerned
agency/Government department for the funds
released to it.
The Mandal Praja Parishad may seek the advice
of/assistance from the Multi Disciplinary Teams
constituted by the Project Officer, Integrated
Tribal Development Agency concerned or any
other Government Agency in preparation of
village development plans and prioritizing the
benefits and schemes.
