MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Agreement made and entered into by and between:

The LOVEYOURSELF Inc. (TLY), a non-stock, non-profit, non-government,


professional organization, duly organized and existing under the laws of the
Philippines with principal office address at Room 9, 3rd Floor Anglo Bldg., 715A
Shaw Blvd., Mandaluyong City, represented herein by RONIVIN GARCIA
PAGTAKHAN in his official capacity as Executive Director, and hereinafter
referred to as TLY

-AND-

Details of Community-based Organization

-WITNESSETH that-

Save the Children (STC), in partnership with TLY as its Sub-Recipient for
Community-based Organization (CBO) Development, is implementing the GFFR HIV
Project entitled “Accelerating Community Engagement and Response on HIV and AIDS
Prevention (ACER)”.

WHEREAS, the GFFR HIV ACER Project’s goal is to maintain an HIV prevalence of
less than 1% by preventing the further spread of HIV infection and reducing the impact
of disease on individuals, families, sectors and communities.

WHEREAS, the GFFR HIV Grant Objectives are the following:

1. To improve the coverage and linkage of HIV services from prevention


and diagnosis to treatment and care;
2. To increase demand and access of HIV and STI prevention and care
services among key affected populations (KAPs) and the public;
3. To establish a functional information system to aid in the planning,
monitoring, quality assurance, and evaluation of the HIV and STI
program; and,
4. To strengthen the support system in place to intensify the delivery of
quality HIV and STI services.

WHEREAS, the GFFR HIV ACER Project supports CBO Community Strengthening
by way of direct engagement in generating demand for HIV testing and care services.

NOW, THEREFORE, for and in consideration of the foregoing premises, the


parties agree to the following:

 Target KAPs:
o Males who have Sex with Males (MSM)
o Transgender Women who have Sex with Males (TGW)
o Persons Living with HIV (PLHIV)

 Area of Coverage: Identify city and/or province.

 CBO Budget Allocation:


o A monthly allocation of no more than PHP 60,000.00, line items of which
should be specified in the monthly activity proposal, as follows:
o Budget Line 370 - CBO's/LGU - Events and Advocacy at Sites
o Budget Line 371 - Regional Quarterly Meetings;
o Budget Line 372 - Regular Meeting among TH Staff with Partner
CBOs; and,
o Budget Line 373 - CBO Clinic Support.
o Any funds used for expenses outside the abovementioned allowable line
items will be disallowed.
o Should there be any need for additional funding assistance outside the
abovementioned line items, including but not limited to: support for the
refurbishment, and renovation of the CBO’s community center space, they
may submit a separate proposal to that effect.

WHEREAS, in consonance with the GFFR HIV ACER Project’s regional targets for
reached, tested and linked-to-care populations, the CBO is committed to deliver 100% of
the CBO targets for MSM & TGW, subject to the following terms:

 At least 120 MSM and TGW clients per month in the first six months of
community center operations
 Following the sixth month, its reach must increase incrementally such that on
its twelfth month of operations, it is able to reach 240 MSM and TGW clients per
month.
 In addition to the above, it shall be subject to further targets for any outreach
activity it conducts, computed as follows: total budget requested for outreach
activities divided by PHP 125.

WHEREAS, the implementing arrangement herein stated shall be adhered to and


complied with by the CBO, to wit:

 Develop and operate a CBO-led or -supported HIV/AIDS service delivery


community center catering to KAPs;
 Promote easy access to community-based screening (CBS) by those not wanting
to access screening/testing services in health facilities;
 Develop partnerships with establishments, peer groups and online entities
and/or personalities with an expansive network and strong influence;
 Work closely and in full coordination with both DOH-RO, local health offices and
GFFR partner organizations to ensure no duplication of reached or tested
targets;

 Assist GFFR LGU sites with low performance outputs and co-develop action
plans;
 Fund a quarterly sit-down regional meeting, hosted by the GFFR Assistant
Regional Coordinator (ARC), to address concerns relative to performance
outputs and CBS issues, e.g. minors’ access to CBS;
 Fund a monthly meeting, hosted by the GFFR Justice Access and Learning Officer
(JALO), to discuss cases encountered, advocacy efforts, and other relevant
concerns;
 Submit a monthly performance output report, i.e. logsheet, via email to the
Registered Medical Technologist of the Social Hygiene Clinic, copy-furnishing
the ARC and the TLY Monitoring and Evaluation Officer, on or before the 4th of
the succeeding month;
 Submit to TLY hard copies of the monthly accomplishment report on or before
the 6th of the succeeding month;
 Make recommendations to improve strategies to reach KAP targets; and
 Ensure that policy guidelines on child safeguarding, fraud, corruption and
human rights protection are promoted and strictly adhered to.

WHEREAS, to ensure quality assurance is complied with, monthly validation shall


be conducted by the ARC, and biannual monitoring by TLY, at the office of the CBO to
validate performance outputs through applicable screening/testing documents such as
Reach Forms, CBS Forms 1 and 2, and Forms A.

WHEREAS, TLY, for its share of responsibility, shall ensure the timely release of
approved funds, provided that all required documents are submitted on or before the
abovementioned agreed timelines.

WHEREAS, the duration of this engagement is from x to x, 2019, with possibility of


renewal/extension, based on availability of funds from the Global Fund and the outcome
of the CBO’s performance evaluation.

WHEREAS, TLY reserves the right to terminate this agreement due to the CBO’s
inability to deliver targets, cases of fraud, and violations of rules of good conduct,
including but not limited to child safeguarding policies.

WHEREAS, this Agreement shall take effect upon signing thereof by both parties.

IN WITNESS WHEREOF, the parties hereunto set their hands on this 1st day of January
2019 in Mandaluyong City, Philippines.
