PROPOSED PROVINCIAL ORDINANCE NO.

AN ORDINANCE DISSOLVING BENGUET TECHNICAL SCHOOL AS AN ECONOMIC


ENTERPRISE

WHEREAS, Benguet Technical School (BTS) pursuant to Provincial Ordinance 06-112 has
been operating as an Economic Enterprise since 2006 with an initial subsidy of Two Million Pesos
(Php2,000,000.00);

WHEREAS, it was gradually decreased to One Million Two Hundred Thousand Pesos
(Php1,200,000.00) to augment the operational income and sustain its services as the prime venue of
Technical Skills Training and Education for skilled workforce and manpower of the Province;

WHEREAS, in 2018, the Technical Education and Skills Development Authority (TESDA) has
identified BTS, as the only public-LGU run Technical-Vocational School in the Province, to implement
the Universal Access to Quality Tertiary Education Act (UAQTEA) or R.A. No. 1093;

WHEREAS, subsequently, the implementation of the UAQTEA free education program at


Benguet Technical School only commenced in July, 2018 with the release of Five Million Six Hundred
Thousand Pesos (Php5,600,000.00) under the Trust Fund account of the Province;

WHEREAS, considering that the National Allocation for the UAQTEA Free Education Program
is intended for specific use, which did not include the salaries of Administrative Personnel, the
dissolution of BTS as an economic enterprise and the reintegration of all its functions to the regular
functions of the Provincial Government under the structure of the Governor’s Office is appropriate;

WHEREAS, the existing personnel of the School who were hired on Contractual Position will
remain on status quo until December 2019.

NOW THEREFORE, on motion duly seconded,

BE IT ORDAINED BY THE SANGGUNIANG PANLALAWIGAN NG BENGUET IN SESSION


ASSEMBLED THAT:

SECTION 1. TITLE. This ordinance shall be known as the “ORDINANCE DISSOLVING THE
BENGUET TECHNICAL SCHOOL AS AN ECONOMIC ENTERPRISE”.

SECTION 2. NAME OF THE SCHOOL. The Benguet Technical School (BTS) shall retain its
name to avoid confusion from contract Industries, other agencies and re-registration of Programs
with TESDA due to the change in name, for only its nature as an economic enterprise is dissolved.

SECTION 3. PERSONNEL. All existing contractual personnel (4 instructors and 3


administrative staff) who were hired under the plantilla positions of the BTS economic enterprise
will be absorbed under the new structure of BTS which will be under the Provincial Government of
Benguet effective January 01, 2019.

SECTION 4. SEPARABILITY CLAUSE. If any section or part of this ordinance is held


unconstitutional or invalid, the other sections or provisions not otherwise affected shall remain in
full force or effect.

SECTION 5. REPEALING CLAUSE. All other ordinances, orders, issuances, rules and
regulations, which are inconsistent with the provisions of this ordinance are hereby repealed,
amended or modified accordingly.

SECTION 6. EFFECTIVITY. This Ordinance shall take effect upon its approval in accordance
with the provisions of the Local Government Code of 1991, as amended.
