AFFIDAVIT OF MERIT

I, XXX, married, of legal age and with residence at 2220 Cedar St Apt C,
Alhambra, CA 91801, after being duly sworn in accordance with law, hereby
deposes and states:

1. That I am one of the children of XXX, respondent in Special Civil Action

Case No. 31-M (16) for Judicial Partition of Real Estate filed with Regional Trial
Court, Branch 26 of Medina, Misamis Oriental;

2. That sometime in November 1996, my mother and I were already living

in the United States;

3. That during the time that allegedly a complaint for Judicial Partition of
Real Estate was filed sometime in 2016, my mother and I were continuously
staying in the United States;

4. That my mother and I had the same official address so I would really
know when a document was delivered to us;

5. That we never received any Summons or court notice pertaining to the

case for Judicial Partition of Real Estate;

6. That we were now surprised to learn that there is already an Entry of

Finality of Decision for the above-mentioned case which my mother came to
know of thru unofficial means sometime in October 09, 2019;

7. That I am executing this Affidavit to attest the truth of the foregoing and
for the purpose of filing a Petition for Relief from Judgment.
