JUDICIAL AFFIDAVIT

I, QUEEN LEAH AVENUE, Filipino, married, of legal age,

with address at 214 Baker Street, Sampaloc, Manila, after having
been duly sworn to in accordance with law, hereby depose and
state:

PRELIMINARY STATEMENT

That in accordance with A.M. No. 12-8-8-SC, which

prescribes the use of judicial affidavits to serve as the direct
examination testimony of the witness, on the basis of which the
adverse party may conduct their cross-examination on such a
witness, I hereby execute this judicial affidavit in a question and
answer format;

That conformably with section 3 (b) of the said A.M. No. 12-8-
8-SC, I also state that it was Atty. FAIRY MERRYWEATHER,
with office located at Hall of Justice, Manila City, who conducted
the examination of the undersigned affiant;
 That conformably also with section 3 (c) thereof, I hereby state
under the pain of perjury that in answering the questions asked
of me, as appearing herein below, I am fully conscious that I did
so under oath, and that I may face criminal liabilities for false
testimony or perjury;

Atty. Fairy Merryweather manifesting – I am offering in

evidence the testimony of the witness, to prove the material
allegations contained in the Criminal Information for Acts of
Lasciviousness against the accused, to prove the circumstances
surrounding the consternation of the Private complainant
following the commission of the crime of Acts of Lasciviousness
and its elements, in support to the allegation of the private
complainant.

The witness will also testify on such other relevant matters

pertinent to the instant case;

AND UNDER OATH, AVERS THE FOLLOWING:

1. Q: Ms. Witness, can you tell your name and your other
personal circumstances?

A: My name is Queen Leah Avenue, 46 years old, married,

Filipino and a resident of 214 Baker Street, Sampaloc, Manila

2. Q: Did you personally know Princess Aurora Avenue?

A: Yes sir.

3. Q: How did you know her?

A: She is my daughter sir and we live in the same house since

she was born on January 29, 1996.
4. Q: Ms. Witness, can you tell what happened on the dawn of
July 4, 2019?

A: On 04 July, 2019 at around two o’clock in the morning, I woke

up to pee. But when I step out of our room, I saw my daughter
sitting in our living room. I asked her “kanina ka pa?” to which
she had not answered. I noticed she was not in her usual self;
her hands were shaking as she held her phone. I knew
something was wrong; I approached her and asked her if she’s
ok and how is she feeling, then she just started crying.

5. Q: Then what happened next?

A: I asked her what happened? Why was she crying? She told
me that her recent grab driver who brought her home few
minutes ago, harassed her. She demonstrated how her legs and
breasts were maliciously caressed by the driver. I asked why she
was seated in front, she replied that it was an instruction from the
driver because the car’s back door was locked as the seats were
wet from vomit. She further informed me that due to her fear for
her life, as the driver might kill her, she did not do other acts that
might provoke the driver to do something worst; thus, she just
changed her sitting position and pushed his hands away from her
breast to signify her refusal to driver’s actuations.

6. Q: What did you do upon learning that your daughter was

harassed?

A: I wanted to cry but I remained strong and firm for my daughter.

I asked her to show me her Grab’s booking history so I could see
the person who did that to her.

7. Q: What did you see in Grab’s booking history?

A: It was shown that her recent grab driver’s name is PRINCE

PHILIP SALVADOR. I asked her if he was the one who harassed
her and she answered in affirmative. She informed me that she
 has already called Grab’s customer service and reported the
incident.

8. Q: What is the state of your daughter while telling you the

incident?

A: She was crying.

9. Q: Then what happened next?

A: We hurriedly went to Barangay to file a blotter report regarding

the foregoing incident.
