RE: FOLLOW UP ON THE STATUS OF THE APPREHENDED


FALCATA LUMBER 10,083 PCS, 21, 1947.84 BD.FT. AND18-
WHEELER TRUCK WITH PLATE NUMBER KEE 937.

Dear CENRO DAHONOG,

Greetings of Peace & Good Health!

The undersigned respectfully follow up the status of the case pertaining


to the afore-said subject.

To recall, the conveyance 18-Wheeler truck bound to Togoloan, Misamis


Oriental and allegedly loaded with mixed Dimensional Falcata lumbers met a
collision with a Starex Van. The said planted forest products were loaded inside
the 40 footers container van with van number TGBU-6002900456. CENRO
Gingoog apprehended the same for allegedly expired transport permit.

On September 19, 2022, a Summary Administrative


Adjudication/Confiscation Proceedings, attended by the undersigned, was
conducted at CENRO Gingoog. The respondent submitted his position paper
pertaining to the incident, containing thereof his absolute reply to the
allegations made by the apprehending officer and completely attached all
pertinent documents tantamount to preponderance of evidence, indispensable
to overcome the presumption needs to be overcome as stated under Item No. 3
of Section 6 of DENR Administrative Order 97-32.

After the conduct of the Summary Administrative


Adjudication/Confiscation Proceedings, the respondent of this case has no
information/update of the case. Almost 7 months had already elapsed but no
known update as to the status/decision granted to the case.
The respondent considerately knows that this is not the only case
catered by your office/of the DENR Regional Office of Region X, but countless.
However, let us be reminded of the Law on Ease of Doing Business and the
Anti Red Tape Authority or ARTA law, which both legally require government
servants/employees to act/ give resolution to a case within a certain period of
time, like giving decision to an administrative proceeding/case.

This follow up is done, for every delay caused the undersigned so much
damage, because the forest products, conveyance and 40footer container van
may deteriorate faster than its normal deterioration due to sans maintenance.
It is of public knowledge that the value of the forest products, container van
and the conveyance are pricy as the respondent is just an ordinary
businessman.

Again, the undersigned would like to pray and appeal to your good office
that an immediate favorable decision/resolution of the aforesaid administrative
case be given without any more delay to minimize the damage of the
apprehended items.
