PUROK NARRA, BARANGAY PANGABUGAN, BUTUAN CITY OF WHICH THE
HEARING WAS HELD ON MAY 22, 2023 AT CENRO -NASIPIT, TALISAY,

The 2nd Administrative Confiscation Proceedings was called to order at 2:00 p.m May
29, 2023 at CENR Office, Talisay, Nasipit, Agusan del Norte with OIC. CENR Officer
NELSON B. CARANZO as Presiding Officer.

Hearing Officer: Good Afternoon everyone, this is a continuation of the

Administrative Proceedings conducted last May 22,
2023 regarding the apprehension of 35 pcs. Lauan logs
with a volume of 8.77 cu.m, two (2) pcs Fanbelt and
two (2) pcs Ply wheel at Purok-Narra, Barangay
Pangabugan, Butuan City.

- May I ask the secretary if those invited are present for

this afternoon’s hearing.
 -
Secretary: Based on the attendance sheet sir, the persons that we
invited are all present and we are in quorum, Mr. Chair.

Hearing Officer: Okay, since we are in quorum we may now proceed.

-To recall, the First Administrative Adjudication
Proceedings was duly moved and seconded to be
postponed due to non-appearance of the respondent Mr.
Lolong Cassion/ GP Cassion to give him opportunity to
defend his right in this administrative hearing.

-Requesting the Team Leader of Butuan West to read

your joint affidavit, for Lolong Cassion to provide his
answer.

Hearing Officer: Sir, under our policy you have the right to hire services
of a counsel/lawyer to defend your right. Do you have a
counsel with you right now?

Mr.GP Cassion Jr: I don’t have, Mr. Chair, but I have with me my adviser
Mr. Rosales.

Hearing Officer: Mr. Cassion, can you narrate the circumstances that
transpired during the apprehension.?

Mr. GP Cassion Jr: Good afternoon, Mr. chair. Actually, I only provide
milling services.

Last May 12, 2023, at around 11:00 in the morning, I

went to Brgy. Amparo, Butuan City to attend a fiesta
celebration and I went back home at around 1:00 in the
afternoon, 45 minutes later Mr. Julieto Efren of DENR
Nasipit with his companion, arrived. They told me that
they received information about the presence of illegal
forest products.

Later on, three (3) women arrived and they picture of

my bandsaw and suddenly the driver and the helper
started destroying my bandsaw even without a court
order.

Hearing Officer: Do you know the owner of the forest products?

Mr. GP Cassion: No, I don’t, Mr. Chair.

Hearing Officer: Did you mill forest products even without permit?
Mr. GP Cassion Jr: Yes, I did.

Hearing Officer: Any comments from member of the TWG?

DMO III Michael A. Moreno: Sir, you mentioned earlier that there were logs in your
compound and other forest products were still in the
river, correct? Who transferred the logs from the river to
your compound?

Mr. GP Cassion Jr.: Correct, Mr. Chair. The pump boat operator was the one
who transferred the logs to my compound.

DMO III Michael A. Moreno: Mr. Chair, I want to know from the Chief of LPU if the
Mini Sawmill of the respondent is registered.

For. II Roel C. Jumawid: No, licensed to operate Mr, Chair, but he has a renewal
application but did not accomplish because of lacked of
other document, like Log Supply Contract.

Hearing Officer: Do you know that Milling without permit is illegal?

Mr. GP Cassion Jr.: Yes, I Know, Mr. Chair.

Atty. Roberto A. Galano Jr.: Did you have a prior arrangement/communication with
the owner of the Lauan Logs?

Mr. GP Cassion Jr.: No, I didn’t.

FR Jewel Padullon: Did you engaged in milling services from January 2023
without permit?

Mr. GP Cassion : Yes, I did but only planted species.

FR. Jewel Padullon: At the time of the apprehension, you mentioned that the
logs were from Bit-os Station. Do you confirm that
before this hearing?

Mr. GP Cassion Jr.: No, someone just called me informing that the said logs
came from Brgy. Bit-os.

DMOIII Micahel Moreno: Did you give consent to DENR Apprehending officer to
enter you compound and apprehend the Lauan logs?

Mr. GP Cassion Jr.: No, I did not give consent but I could not do anything
because they were already in the compound.

Special Investigator I/Gemrey: Sir, you just let other people to enter and put forest
products without your consent, such is not normal.
Mr. GP Cassion Jr.: I am already accustomed with that kind of transaction
that the owner of the forest products deliver the same
without prior communication with me.

DMO III Michael A. Moreno: Mr. Chair, EO 23 still in effect which bans the cutting
of naturally grown forest products. In view of that, I
move for the confiscation of Lauan logs in favor of the
government.

For III BEdar Imam: I second the motion.

Hearing Officer: In has been moved and seconded that the apprehended
Lauan Logs 35 pcs. Lauan logs with a volume of 8.77
cu.m, two (2) pcs Fanbelt and two (2) pcs Ply wheel.

Any more comments? There being none, I declare this

proceeding adjourned.
