SECOND SUMMATIVE EVALUATION (MIDTERMS)

(Due on November 9, 2019)

Case # 1: DARLENE (This is a real case)

As part of a government program, Darlene, a grade 12 graduate, got a job with a local
garden nursery. She was to help Mr. Fritz, the owner, to tend plants and shrubs, place
orders and serve customers.
Mr. Fritz’s first review of Darlene’s work showed that she was performing all her job
duties exceedingly well. It was obvious that Darlene liked the work.
Over the next three months, Mr. Fritz’s behavior toward Darlene began to change.
As they worked, he would often put his hands on her shoulders and hips or lean over closer
to her at these times, she would quickly draw away from him. He then began to make
offhand remarks about how sick he was of his wife and that he needed “satisfaction” from
another woman.
Darlene did not encourage the comments or actions, nor did she say anything against them.
However, she become increasingly uncomfortable with the situation and tried to avoid the
owner as much as possible. One day Mr. Fritz asks for a kiss. When Darlene refused, the
owner said “I know what’s wrong with you. You’re scared you’re going to like it.” A few
days later, Mr. Fritz texted Darlene to go to his home for his wife was not around.
Darlene firmly refused. On several occasions, the owner tried to get Darlene to come to his
apartment.
In June, Mr. Fritz terminated Darlene’s employment, saying he had no work for her, even
though June is the busiest month of the year for plant nursery.

Questions:

 What are the human rights that were violated in the case? Explain?
 The right to life- all of us have the right to protect ourselves from whatever
we are involved especially the other people who abuse as. We have the right
to be protected by law. And no one shall arbitrary.
 We are all Born Free and Equal- all human beings have dignity and rights.
We endowed with reason and conscience and should act towards another in
a spirit of brotherhood.
 Is the termination of Darlene’s employment licit? Why?
 In this case, it would be best for Darlene to just end up working with Mr.
Fritz to prevent him from being harassed. And he has no right to be
terminated by Mr. Fritz working. So it’s better to give Darlene’s wage
as she has been working in the garden for several months and Darlene
she have the right to looked for another job .

 When Darlene first become uncomfortable with the nursery owner’s behavior,
why wouldn’t she have said something?
 Maybe Darlene wasn’t quiet on the pass few days or months when she
at the garden nursery because she was just observing before and when
she knew that Mr. Fritz had a plan to her she was afraid to sue because
Darlene didn’t want to lose her job.

Case # 2: PARAMVIR (this was a real cases: Pandori vs. Peel Board of Education )

In response to increased to violence in its schools, a local school board adopted a


policy prohibiting carrying weapons on school ground. The following spring, the
school administration learned that Paramvir, a Khalsa Sikh, was wearing a kirpan in
school. The school wanted to implement its “no weapon” policy.
Khalsa Sikh is a group of indigenous people living in Canada. They go through the Amrit
Ceremony, symbolizing spiritual commitment. One of the duries of the Khalsa Sikh is to
carry at all times on his or her person, a kirpan, an article of faith symbolizing a spiritual
commitment to law and morality, justice and order. A kirpan, is areal steel knife, encased
and secured in a sheath, and generally worn out of sight under normal clothing.
After prolonged discussions with Paramvir ‘s family and Sikh organizations, the school
board amended its weapons policy to include kirpans. It forbade Sikh students, however,
to wear the kirpan in school, they could only wear a symboli representation of the kirpan,
provided it did not involve a metal blade that could be used as weapon.
A Sikh teacher took the case to the Tribunal. At the hearing, it was argued that Sikh
religious practices dictate that kirpan must be made of iron or steel and worn at all times,
otherwise the Khalsa would break their holy vows. It was shown that, while the kirpan has
appearance of a weapon, it has never been used in Canadaas a weapon. Furthermore, it was
argued that other school boards did not have a policy restricting kirpans.
The school board argued that: the kirpan posed a risk as it looked like, and could be used
as a weapon. And others could perceive the kirpan as an invitation to violence.
Questions:

 Did the weapon policy discriminate against the Khalsa Sikhs? How?
 It does not discriminate against the school for carrying weapons,
rather than the school to enforce the prohibition of carrying weapon
inside the school. The following spring, the school administration
informed Paramvir a Khalsa Sihk was wearing a kirpan at the school
because this is their costum in Canada so it is forbidden for Khalsa to
wear kirpan inside the school unless they can only allow wearing
enthusiastic costume when they are performing if they so. Additionally,
the other school boards argued that there was no policy restricting
kirpans.

 Was the policy reasonable?


 It is reasonable if the school make a policy entitled “no weapon”
policy.

 If you are the head of the school board, can you accommodate the Khalsa Sikh
without undue hardship?
 Yes, I can accommodate Khalsa Sikh if they only obey the law that the
school will implement “ no weapon “ policy for the students safety.

Case #3:

Greg had conflict with Joash due to the boundary of their properties. It has been
years already they haven’t been talking with each other although they have been
friends for the pass years. Uncle sam was both a friend to them and has been giving
constant reminders to both of them. Aling Martha is a neighbor of Greg who has a
grudge with the wife of Joash because she has been talking about her as a
“mangkukulam.” Although Greg has a problem is still facing the boundary dispute with
Joash he is still a friend of Tom who is a basketball player and a cousin of Joash but at
the same is envious of Joash because their grandparents gave a bigger portion of their
land to the father of Joash. Lovely a young student was a friend of Joash daughter and at
this time was heartbroken because her boyfriend who is the Son of Greg has broken up
with her. And her family was very furious of that boyfriend and curse the family of
Greg. The Conflict is still on going.
Questions:

 What is the best conflict tool analysis to be applied in this case?


 The great conflicts of two families Joash and Greg are the quarrel
between the two and their children are still in love so it is good for
them to agree on their children.

 Present your own analysis of the situation using that conflict analysis tool?
 If I were to ask in that situation, I would rather have Greg and
Joash join the two families to fix their lives and especially Uncle
sam they are friend too who gives them advice both a reminder.
And don’t let anyone judge you if you don’t know the truth. And
Joash and Greg they are jealous of Toms because their
grandparents they gave a huge piece of land to his Dad of Joash,
and Tom is just a friend of Joash. And the strife of two lovers with their
parents should not over power, instead of just agreeing because it
is never wrong to love.
