CITY ORDINANCE NO. 2016-012

AN ORDINANCE PROVIDING FUNDS FOR EDUCATION AND

LIVELIHOOD ASSISTANCE TO QUALIFIED DIFFERENTLY-ABLED
PERSONS IN CABADBARAN CITY REPEALING FOR THE PURPOSE
CITY ORDINANCE NO. 2014-002 KNOWN AS THE DALE
ORDINANCE OF 2014

WHEREAS, the Differently-abled Persons are generally the most neglected

sector, the marginalized among the marginalized sectors, the “hoy poloy” or the
faceless people in our society who need greater attention and care.

BE IT ORDAINED, by the 3rd Sangguniang Panlungsod of Cabadbaran City,

in its 7th Special Session, that:

SECTION 1. DECLARATION OF POLICY – It is hereby the policy of the City

Government of Cabadbaran to mainstream persons with disability in the society by
providing them a functional educational and livelihood assistance program for them to
be holistically empowered.

SECTION 2. SCOPE AND COVERAGE:

A. FOR EDUCATIONAL ASSISTANCE PROGRAM –

a. Coverage
i. All registered Differently-abled persons (DAPs) living in
Cabadbaran City for a minimum of six (6) months who
wish to study or who wish to continue their studies either
in elementary, high school, or college (regular or
vocational);
ii. DAPs whose parents, guardians, or custodians have no
regular means of living and who are not recipient/s of
conditional cash transfer or 4Ps;
b. Requisites for Admission
i. Must be a Filipino Citizen
ii. Must be a registered member of the Federated
Association of Differently-abled Persons in Cabadbaran
City, Inc. (FADAP-CC), possessing PWD National I.D.
issued by the Persons with Disability Affairs Office
(PDAO) or by the CSWD Office of Cabadbaran City;
iii. The Parents/guardians must be a registered voter of
Cabadbaran City;
iv. Parents/guardians have no regular means of living;
v. Enrolled in any school within the City of Cabadbaran by
the time of application;
vi. Must not be a Pantawid Pamilya beneficiary or recipient;
vii. Must be an active member of FADAP-CC in their
respective barangay/chapter;
viii. Must be willing to sign an agreement for the completion
and full accomplishment of the Program.
c. Required Documents
i. Photocopy of FADP-CC Local ID;
ii. School Enrollment Certificate;
iii. List of school needs, tuition fee, and/or billing;
iv. Duly accomplished FADAP-CC Assistance Form;
d. Amount of Assistance and Purpose
i. Elementary – financial assistance in the amount of One
Thousand Five Hundred Pesos (P1,500.00) first tranche
on the month of June and another One Thousand Five
Hundred (P1,500.00) on the month of November, a total
of Three Thousand Pesos (P3,000.00) for the whole
school year intended to assist expenses on school
supplies, uniforms, projects, school fees, and
transportation.

ii. High School – financial assistance in the amount of two

thousand five hundred pesos (P2,500.00) first tranche on
the month of June and another Two Thousand Five
Hundred Pesos (P 2,500.00) on the month of November,
for a total of Five Thousand Pesos (P5,000.00) for the
whole school year intended to assist expenses on school
supplies, uniforms, projects, school fees, and
transportation.
iii. College (regular or vocational) – financial assistance in
the amount of Ten Thousand Pesos (P10,000.00) per
semester/enrollment to support expenses on school fees,
transportation, uniforms and projects.
e. Mode of Termination – the privilege and assistance herein
provided shall be immediately terminated upon occurrence
of any of the following circumstances:
i. Unsettled school fees;
ii. Unfinished school year;
iii. Parent/s, guardian, or custodian is/are inactive in
participating FADAP-CC chapter meetings as evidenced
by a certification from the FADAP-CC President and
presentation of meeting attendance log book;
iv. Inclusion to 4Ps or reception of any educational
assistance from other entities or agencies.

B. FOR LIVELIHHOD ASSISTANCE PROGRAM

a. Admission qualification and documentary requirements
i. Only organized group of Differently-abled Persons within
Cabadbaran City with functional set of officers and duly
registered and accredited to the FADAP-CC, can avail of
the program;
ii. Existence for not less than six (6) months of the group
within the Barangay as certified by the Barangay Captain
of the Barangay concerned;
iii. Updated and current list of active members;
iv. Financial record/statement reflecting member’s
contribution and management of economic activity;
v. Copy of project proposal;
vi. Capital build-up as program counterpart;
vii. Must have undergone a series of seminars under the
CSWD Office/SLP pertaining to social preparation, basic
entrepreneurship and business management.

b. Time, Manner, and Amount of Assistance

i. The project shall be implemented in Cabadbaran City;
ii. The amount of livelihood financial assistance shall not
exceed the amount of Fifteen Thousand Pesos
(P15,000.00) and shall be determined based on the
details given on the project proposal prepared by the
chapter association;
iii. The financial assistance shall be paid without interest
through monthly amortization within a period of three (3)
years from receipt of the amount granted, subject to a
grace period of another one (1) year, subject to the
discretion of the CSWD Office for a reasonable cause or
causes not limited to force majeure.
iv. Failure of the recipient group to pay the amount herein
granted shall be a cause for the denial of all benefits and
privileges for DAPs that may be provided in the future.
c. Mode of termination - the privilege and assistance herein
provided shall be immediately terminated upon occurrence of
any of the following circumstances:
i. Full payment of the livelihood assistance as provided in
paragraph iii, subsection b, above;
ii. Non-compliance to the qualifications and requirements.

SECTION 3. APPROPRIATION – There shall be an annual appropriation of

not less than Five Hundred Thousand (P500,000.00) for the effective implementation
of this Ordinance.

SECTION 4. REPEALING CLAUSE – City Ordinance No. 2014-002

(DALE Ordinance of 2014) is hereby repealed. Any ordinances and local issuances
inconsistent with this ordinance are likewise repealed or modified accordingly.

SECTION 5. EFFECTIVITY – This Ordinance shall take effect upon approval

and compliance of the posting or publication requirements.
