INTERNAL RULES OF PROCEDURE
OF THE SANGGUNIANG BAYAN
Of Licab, Nueva Ecija
For the Term of Office
July 1, 2019 – June 30, 2022
(Amended, November 11, 2019)

RULE I
SESSIONS

Sec. 1. The regular sessions of the Sangguniang Bayan shall be every


Monday, 9:00 AM. of every week unless it falls on an official holiday or conduct
of the session is prevented by force majeure, in which case, the session will be
held on the following working day. The session shall be held in the Session Hall
of the Licab Municipal Building.

Sec. 2. Special sessions may be held as the need arises. The Mayor
or a majority of the members of the Sanggunian may call a special session by
personally serving a written notice on each member or leaving a copy thereof
with a member of his household at his place of residence at least twenty four
hours before the special session is held. The notice must state the day, time,
place and purpose of the session. Unless otherwise agreed by two thirds vote of
the members present, there being a quorum, no other matter may be considered
at a special session except those stated in the notice. As may be determined by
the majority of the Sangguniang Bayan Member.

Sec. 3. All members of the Sangguniang Bayan attending the session


shall be in their respective seats at least fifteen minutes before the opening of
the session. There will be a fifteen-minute grace period from the start of the
session. A fine of P500.00 will be collected in case member/s of the body
come to the session after 9:15 in the morning.

Sec. 4. All members of the Sangguniang Bayan should be in their


prescribed uniform during regular and special sessions.

Unless this requirement is waived for specific sessions by unanimous vote


of the members in a session at which there is a quorum, a fine of P500.00 will
be incurred to the member/s of the Sangguniang Bayan who will come to
the session not wearing the prescribed uniform.

Sec. 5. Each absence in regular sessions without justifiable


reason will incur a fine of P1,000.00

Valid reasons for absence of a Sangguniang Bayan Member are as follows:

1. Death of an immediate family member.


2. In case there is a need for a member of the body to attend
important meetings that pertain to the functions of their
respective committees.
3. Sickness of a Sangguniang Bayan Member.

*The Liga ng Barangay President and the PPSKF President shall be exempt
to the penalty under Section 5.

RULE II
QUORUM

Sec. 6. A majority of all the members of the Sanggunian who have


been elected and qualified shall constitute a quorum for it to transact official
business. Majority shall consist of fifty percent of the number of said members,
plus one.

Sec. 7. Where there is no quorum, the presiding officer may declare a


recess until such time as a quorum is constituted, or a majority of the members
present may adjourn from time to time and may compel the immediate
attendance of any member absent without justifiable cause by designating a
member of the Sanggunian, to be assisted by a member or members of the police
force assigned in the territorial jurisdiction of the Local Government concerned,
to arrest the absent member and present him at the session hall.

Sec. 8. If there is still no quorum despite the enforcement of the


immediately preceding paragraph, no business shall be transacted. The
presiding officer, upon proper motion duly approved by majority of the members
present, shall declare the session adjourned for lack of quorum.

Sec. 9. No session duly convened at which there is a quorum shall be


suspended or adjourned except when so directed by the Sanggunian, but the
presiding officer may, in his discretion, declare a recess in short intervals or
suspend or adjourn the session in case of emergency, or when the same has
become unruly or uncontrollable.

RULE III
ORDER OF BUSINESS

Sec. 10. Order of Business is the summary of the series of activities in


a Sanggunian session, arranged in the sequence in which these are to be
undertaken. The order of business in the regular session of the Sanggunian
shall be as follows:

a. Call to Order
b. Prayer
c. Roll Call
d. Reading, adoption, revision or approval of the minutes of the previous
meeting.
e. Referral of business to committees concerned.

i. Proposed ordinances
ii. Proposed resolutions
iii. Other communications

Sec. 11. Mention of the titles of proposed ordinances and resolutions in


the “Referral of Business” portion of the Order of Business fulfills the legal
requirement of first reading.

Sec. 12. The “Unfinished Business” included in the Calendar of


Business involves any question or proposal which has remained undecided by
Sanggunian at the time of its adjournment in the immediately preceding session.

Sec. 13. The “Business for the Day” referred to in the Calendar of
Business consist of ordinances and resolutions to be reported out by the
committees on second reading during the session, to be taken up in the
sequence in which they appear in the Calendar.

Sec. 14. The “Unassigned Business” mentioned in the Calendar of


Business is a list of proposed ordinances and resolutions embodied in committee
reports, the dates of discussion of which have not as yet been determined.
These are presented in the Calendar of Business in order that the Sanggunian
may be informed of the pendency of these proposed measures.

Sec. 15. The “Business on Third and Final Reading” includes


ordinances and resolution previously approved by the Sanggunian on second
reading, and scheduled by it for final vote in this portion of the Order of
Business.

Sec. 16. Matters certified to as urgent by the mayor may be brought


before the Sanggunian for immediate consideration even though they are not
listed in the Calendar of Business and without need of suspending the rules.

Sec. 17. Any topic proposed to be included in Order of Business of a


particular session shall be submitted to the secretariat of the Sanggunian at
least three working days before the said session.

Sec. 18. On motion to suspend the rules, items of business may be


taken away from their fixed order to permit consideration of urgent matters
ahead of the others.

RULE IV
PROCEDURE FOR ORDINANCES, RESOLUTIONS,
AND OTHER LEGISLATIVE MEASURES

Sec. 19. An Ordinance is a local law, a regulation of a general,


permanent nature established by authority. It prescribes some permanent rule
of conduct which has the force and effect of law, to continue in force until
repealed or superseded by subsequent enactment. A resolution, on the other
hand, is a mere expression of the opinion or mind of the Sanggunian concerning
some matter of administration coming within its official cognizance, and provides
for the disposition of a particular item of the administrative business of the
Municipality. It has no permanent value, for it deals only with matters of special
or temporary character.

Sec. 20. The enactment of an ordinance or a resolution shall require


three (3) readings, and involves the following steps.

Sponsorship of Ordinance or Resolution

Step 1

A Sanggunian member of group of members shall file with the secretary of the
Sanggunian three (3) copies of the draft ordinance or resolution in the form
prescribed for the purpose.

Step 2

The secretary to the Sanggunian shall record the draft ordinance or resolution in
a logbook, indicating the following basic information.

Name of the author or authors

Title of the proposed ordinance or resolution

Date filed, and

The number assigned to it.

Step 3

On first reading, the secretary to the Sanggunian shall report to the Sanggunian
members, the proposed ordinances or resolutions filed with the secretariat at
least three (3) days before the session. He shall read the draft ordinance or
resolution by its numbers and title and the name of the author or authors, after
which the presiding officer shall immediately assign the proposed measure to the
committee or committees concerned. Distribution of copies of the proposed
measure shall be done later by the secretary.

Committee Deliberations

Step 4

If the committee concerned, after subsequent deliberation recommends action on


the proposed ordinance or resolution, a report to the effect shall be submitted to
the presiding officer through the chairman of the Committee on Rules, who shall
calendar the proposed measure for second reading.

It the committee action on the proposed measure is unfavorable, it shall be laid


on the table and, within ten (10) days, the author or authors concerned shall be
given notice stating the reason(s) for such action.

Second Reading and Floor Consideration

Step 5

No proposed ordinance or resolution may be considered on second reading in


any regular session unless it has been reported out by the proper committee to
which it was referred on first reading, or it was certified as urgent by the Mayor.

On the day set for consideration of the proposed measure on second reading, the
secretary shall read the proposed ordinance or resolution in its entirely,
although this may be dispensed with on motion, provided that in the latter case,
every member of the Sanggunian had been furnished a copy of the proposed
measure at least three (3) days prior to the session, as certified to by the
secretary. The Chairman of the committee concerned or someone designated for
the purpose shall explain briefly the nature of the proposed measure, and
recommend its approval. Thereafter, the proposed ordinance or resolution shall
be subject to debate and amendment , if any, and other proper parliamentary
motions.

Step 6

The Secretary to the Sanggunian shall prepare enough copies of the proposed
measure in the form it was passed on second reading, and shall distribute these
to each member of the Sanggunian at least three (3) days before the final
reading.

Third Reading and Final Vote

Step 7

No ordinance or resolution may be approved unless it has passed three (3)


readings, and copies thereof in final form have been distributed to the members
of the Sanggunian at least three (3) days before its passage, except when the

mayor or the Sanggunian itself certifies to the necessity for its immediate
enactment to meet a public calamity of emergency.

Upon third reading of the proposed measure, the presiding officer shall put the
questions(s) to a vote, and shall direct the secretary to the Sanggunian to call the
roll to record each member’s vote. The presiding officer shall then announce the
result of the voting.

Approval of Ordinance and Resolutions

Step 8

Every ordinance and resolution enacted by the Sanggunian shall be presented to


the Mayor for approval. It he approves it, he shall express his approval in
writing by endorsing the word “Approved” followed by his signature on each and
every page of the ordinance or resolution. If he disapproves the proposed
measure, he shall veto it and return the same to the Sanggunian together with
his written objections, within ten (10) days from his receipt of the said ordinance
or resolution; otherwise, the proposed measure shall be deemed approved as if
he had signed it.

The Sanggunian may override the veto of the mayor by a two-thirds (2/3) vote of
all its members, thereby making the ordinance or resolution effective for all
intents and purposes.

Review of Ordinances or Resolutions

Step 9

An ordinance or resolution of the Sangguniang Bayan shall be submitted by its


secretary to the Sangguniang Panlalawigan for review, within three (3)days
following its approval. If no action is taken by the Sangguniang Panlalawigan
within thirty (30) days after submission to it of the proposed measure, the same
shall be presumed consistent with law, and therefore, valid.

Sec. 21. Motions may be presented orally or in writing and considered


according to the rules of procedure of the Sanggunian, provided, however, that
any motion which in the opinion of the body may be acted upon without
reference to any committee, may be considered immediately for final action. An
urgent motion, if substantive in character and presented orally, shall, if
approved, be written out by the secretary in resolution or ordinance form, as the
case may be.

RULE V
VOTES AND VOTING

Sec. 22. Voting in the Sanggunian shall be done by voice, raising of


hand, rising, or by roll call, unless a different method is prescribed by the
Sanggunian for a particular question. In taking the vote, the affirmative shall be
taken first and then the negative.

Sec. 23. To pass an ordinance or any proposition creating an


indebtedness, the affirmative vote of a majority of all members of the Sanggunian
is necessary.

Other measures, except as otherwise specially provided, shall prevail upon


the majority vote of the members present at any meeting duly called and held, at
which there is a quorum.

Sec. 24. A member may change his vote only before the Chair
announces the result of the voting and if his vote can be identified by the mode
of voting. Thereafter, a member may change his vote only if allowed by majority
vote of the members present.

Sec. 25. A member who arrives late at the meeting shall be permitted
to vote, provided the result of the voting has not been announced yet by the
Chair.

RULE VI
THE PRESIDING OFFICER

Sec. 26. The Vice Mayor shall preside in all sessions of the
Sanggunian, as much as possible.

Sec. 27. The presiding officer shall vote only to break a tie.

Sec. 28. In the event of the inability of the regular presiding officer to
preside at the session of the Sanggunian, the members present and constituting
a quorum shall elect from among themselves a temporary presiding officer. He
shall certify within ten (10) days from passage of ordinances enacted and
resolutions adopted by the Sanggunian in the sessions over which he
temporarily presided.

RULE VII
AMENDMENT TO RULES

Sec. 29. These rules may be amended at any regular meeting by a two-
thirds vote of all members of the Sanggunian, provided that notice of the
proposed amendment has been given at any meeting previous to the one at
which the said amendment is to be considered, but in no case later than three
(3) days before the regular meeting in which the proposed amendment is to be
considered.

RULE VIII
DATE OF EFFECTIVITY OF THESE RULES
Sec. 30. These Rules shall take effect upon their adoption.

RULE IX
DECORUM – (Adopted on July 01, 2019)

The following decorum must be observed by all the members present during
session.

1. No smoking inside the Session Hall.


2. Do not butt in or interfere when somebody is speaking, wait until recognized
by the Presiding Officer.
3. Each member must wear the prescribed uniform.
4. Each member shall address each other Honorable and must direct all queries
to the Presiding Officer.
5. No deadly weapons shall be allowed inside the Session Hall.
6. Solicitors shall not be entertained inside the Session Hall.
7. Cellular Phones/Communication equipment and other electronic gadgets
must be turned off or put to silent mode during session.
8. Each member must limit their speech presentations/arguments to a
maximum of five (5) minutes.
