AFFIDAVIT-COMPLAINT

I, A, 25 years old, single, and a resident of Block 1, Lot 1,


Barangay San Agustin, San Isidro, Pasay City 1306, after having
been duly sworn to in accordance with law, hereby deposes and says
THAT:

1. I am the daughter of B, 45 years old, resident of Block 1, Lot


1, Barangay San Agustin, San Isidro, Pasay City 1306.

2. Last July 19, 2019, on or about 9:30 P.M., I suddenly woke


up while sleeping. As I peep through a hole in in the wall of
my room, I saw X and Y, who are close and dear friend of
my father, B, whispering to each other. I came to know them
since I was little due to the fact that their lands are adjoined
to my father’s and they occasionally visit our home either to
have a drinking spree with my father or attend birthday
celebrations.

3. X and Y approached our home, accompanied by three other


men whom I do not know of. I am aware that it was X and Y
whom I saw since the moon was bright and the area was
well lit. X acted as the leader of the group as he was giving
orders to them. All of them are armed with firearms.

4. I went down to check on my father and he signaled me to


hide in our kitchen. I peeked again in the window where I
can clearly see X and Y as well as the three strangers. They
approached our door, and Y shouted demanding my father
to give his group some food while holding his pistol. My
father remained silent and was shaking from fear. Y cocked

his pistol, and as soon as when my father heard it he said
that he would willingly comply on the condition that he would
hand the food through an opening in the wall. I can see that
he was afraid to open the door because of the possibility of
being harmed.

5. Each one of them lighted their torches, which were made of


coconut leaves and started throwing it inside our window.
Fire started to spread but my father was able to quickly
suppress the fire. My father pleaded not to burn our house,
he repeated his request and told them that he would wrap
the food and hand it to them through the opening of the wall.

6. The group demanded that my father open the door


immediately, otherwise they will burn our house. When my
father refused to comply insisting that he would hand them
the food through the opening in the wall, Y fired the first shot
at my father, followed by the group, who started firing their
firearms.

7. At that instance, I hurriedly went to my room and jumped out


of the window to escape. When I looked back, I saw our
house burning while the group fired at my father who ran
outside the house.

8. I proceeded to my brother’s house, C, which was 15 meters


away from ours. I told him immediately what happened to my
father but he was not able to move because he was
shivering in fear.

9. The following day, I went to our house together with my
brothers and sisters. I found my father’s body nearby our
house with multiple stab and gunshot wounds. The Death
certificate of my father issued by the civil register as well as
the autopsy report duly issued by the Philippine National
Police Crime Lab is hereunto attached and made as an
integral part hereof as Annex “A” of the complaint

10. I was brought to a police station where I executed my


affidavit. Our house and everything inside it, which had a
total value of 30,000 Php, were totally burned. The original
copy of the excerpt of the police report duly issued by Pasay
Police Station is hereunto attached and made as an integral
part hereof as Annex “B” of the complaint;

11. I am therefore executing this affidavit freely and


voluntarily in support of my intent to file a case for MURDER
and/or the appropriate criminal case against X and Y, who
are both 40 years of age and residents of Block 2, Lot 1,
Barangay San Agustin, San Isidro, Pasay City 1306, and
JOHN DOE, JANE DOE, AND PETER DOE.

IN WITNESS WHEREOF, I have hereunto set my hand this 20th


day of July, 2019 at Pasay City, Philippines.
