(SECTION – A) (04X15)
1. The contract of employment consists of the following clause:
"That the employee will not permit to join any firm of our competitors or run a business of his
own in similar lines directly and or indirectly, for a period of two years at the place of his last
posting after he leave the company".
Explain in the light of the applicable provisions of the Indian Contract Act, 1872 with the help of
case laws. Can negative covenants during the subsistence of a contract of employment be
enforced? Discuss with judicial pronouncements.
2. The U.P. Government advertised for tenders for the supply of iron among other things to be
delivered as per the terms and specifications as enumerated in Tender Notice. Tata Steel sent a
tender which was as follows:
"….the undersigned, hereby undertake to supply the Great Northern Railway Company, for 12
months from 01 January, 2017 with such quantities of each or any of the several articles named in
the attached specification as the Company's store-keeper may order from time to time, at the price
set opposite each article respectively, and agree to abide by the conditions stated on the other
side". The U.P. Government accepted this tender. Explain what kind of offer it is? What are the
rights and obligations of the parties?
3. A builder accepted bookings nearly two times the available flats of accommodation and received
money without intimating to the buyers that their purchase will depend on the availability of the
flats of accommodation. As a result, the builder could not allot the flats to the excess over
purchasers. What remedies are open to the purchasers under the Indian Contract Act, 1872? What
provisions are incorporated in the Real Estate (Regulation and Development) Act, 2016 to protect
the interest of the purchasers?
4. Critically analyze the Doctrine of Promissory Estoppel in detail.
5. "In the law of England certain principles are fundamental. One is that only a person who is a party
to a contract can sue on it. Our law knows nothing of a jus quasitum tertio arising by way of
contract. Such a right may be conferred by way of property, as, for example, under a trust but it
cannot be conferred by way of property, as for example, under a trust, but it cannot be conferred
on a stranger to a contract as a right to enforce the contract in personam…" In which case this
principle was laid down, what are the exceptions and right conferred on a stranger under the
Contracts (Rights of Third Parties) Act, 1999.
6. Mr. Salman Khan and Mr. Abdulla agreed that Mr. Salman Khan would pay Rs. 5,00,000 to Mr.
Abdulla. Mr. Nazir, a reputed cricketer, hits a six in a cricket match. What type of agreement it is?
Whether what is void can it be equated with that of forbidden by law?
