1. (a) “Our Constitution may be said to be an expansion and explanation of the Preamble”.
In the backdrop of the aforesaid statement, comment on the significance of the Preamble
of the Constitution of India.

(b) What meaning can the phrase ‘other authority’, under Article 12, be understood to
bear?
2. The two contentious issues in the application of Articles 15 and 16 are ‘determination of
backward classes’ and ‘extent or quantum of reservation’. Comment on the aforesaid
statement.

(SECTION – A) (04X15)
1. A authorized B to carry on business (purchase and sale of goods) for and on behalf of A
in any manner B chose. B appointed C to enter into transactions of purchase and sale of
goods on the following terms: (i) that C would render accounts of all sales and purchases
to B; (ii) that C would act according to the instructions of B on behalf of B and; (iii) that
C would charge a certain commission on the transactions. Explain in detail the following
(A) and (B) in the light of the applicable provisions under the Indian Contract Act, 1872
and leading cases:
(A) What is the position of C in relation with A?
(B) Can A institute a suit against C for accounts?
2. A partnership deed consisted of the following terms: (i) if any of the partners
unfortunately dies, then in that case the partnership shall not be dissolved, but his sons
will become partners of his share and that person will become the partner who may have
been nominated by the deceased partner; (ii) if any partner wanted to separate from the
business of the partnership before the expiry of one year and even if he did so, his capital
would not be returned before the end of the year; (iii) no partner could withdraw from the
partnership so long as the loan taken from the Bank by the Partnership Firm was not
repaid.
What kind of Partnership Firm is it? How can it be dissolved? Explain with the applicable
provisions and case law under the Indian Partnership Act, 1932.
3. Where a letter by the surety guaranteeing the repayment of a loan by the two principal
debtors contained inter alia that in case the creditors are not able to recover the amount
from the principal debtors, the surety agreed to pay the same. The creditor sued only the
guarantor to recover the amount due from the principal debtors.
(A) Will the creditor be able to recover from the surety? Why?
(B) What are the rights of the surety?
Explain in the light of applicable provisions under the Indian Contract Act, 1872.
4. Enumerate the statutory provisions relating to ‘Designated Partners’ as provided in The
Limited Liability Partnership Act, 2008.
5. Discuss the rights and responsibilities of ‘Bailor and Bailee’ bearing in mind the
applicable legal provisions.
6. Explain in detail the ‘Implied Conditions and Warranties’ as embodied in the Sale of
Goods Act, 1930.

(SECTION – A) (04X15)
1. Madeeha has filed Domestic Violence case in her native place at a distance of 250 kms
against all the family members of husband (Ansar) with false and immoral allegations. So he
divorced her by pronouncing single Talaq in presence of two witnesses and sent the
talaqnama and she acknowledged it. She has also challenged validity of the Talaq by filing a
civil suit in native place and he (husband) submitted statement for it and matter is pending
trial.
During Domestic Violence trial she has not proved any allegations except that he failed to
maintain her and children after she left the matrimonial home. Hon'ble Magistrate considered
this as mental cruelty and awarded maintenance of Rs 14,000 pm against his salary of 42,000
along with arrears of 3 lakh rupees and discharged his parents and sisters from the case as the
allegations against them are baseless.
The husband has contended that she has left his house during her 7th month of pregnancy by
conducting ceremony and he provided photo proof for the same and she stayed at her own
will and against his consent at her parents’ house for 1 year even after the child delivery with
an intention to intimidate him to set up separate home away from my old aged parents. She
also attended mediations prior to the filing of her Domestic Violence case but no where she
raised any allegations as stated in Domestic Violence petition.
The Court has not considered the overall facts and circumstance of the case and stated that she
was subjected to domestic violence because of non maintenance of her and children when she
was staying a her parents’ house and stated that it is continuing offence even though no act of
violence was proved when she was in at her husband’s home. Also he told that Talaq is under
challenge so she is entitled to maintenance and further stated that it is the responsibility of the
husband to maintain them and he failed to do it.
Though husband prefers for appeal in Domestic Violence case, but he knows she is also
entitled for maintenance under CRPC 125, where also she can get the same amount of
maintenance. So the appeal will lead him to face another case for which he is really fed up
already because of DV case which ran for 2 years and also to fight the new case in her native
place is also cumbersome and his office work is also disturbed.
1) Is it good to go for appeal now and come out clean hands in Domestic Violence case and
later pay maintenance only under 125 Cr. P. C. if she files for the same? (5 marks)
2) Will Paying maintenance under Domestic Violence Act have any negative impact in
husband’s future when compared to pay maintenance under 125 CrPC? (5 Marks)
3) Once his Talaq got proved in civil court, Can he file petition to stop her maintenance under
Domestic Violence Act? (5 marks)

3. Can a wife obtain divorce in following conditions? Give reasons and case law in support for
your answer.
a) Sheetal marries Anirban in year 2013 according to hindu rites and ceremonies.
Within a year of their marriage they realized that they were incompatible. Anirban
started spending more time outside the home and was drawn toward his colleague
Sukanya who was married to Lakshya. There is no marital relationship between
Sheetal and Anirban for almost 3 years. (5 marks)
b) Vikram has lost his job due to recession and unable to maintain his wife Riya and
family. Vikram is trying to get new work and is very diligent toward his wife and
family. Riya is obnoxious and humiliates Vikaram and his family at every possible
instance. (5 marks)
c) Due to constant quarrelling and fights Rimi left her husband Anil house with their
daughter and started living with her friend Abhimanyu. Enraged with this Anil filed
a RCR petition in the family Court. The learned Family Judge decided in the favour
of Anil. Despite efforts Rimi refused to join her Husband. Two years has elapsed
from the date of decree.(5 marks)
4. Riya and Ahmed met at their office and fell in love with each other. After a year of courtship
they started living together. In a fateful accident their closest friends Suman and Abeer died
and left to them the guardianship of their infant daughter. They bought the daughter home and
started raising her. After an year another daughter was born to them. With the passage of time
the relationship between Riya and Ahmed got strained and when their daughters were 4yrs
and 2 years respectively they separated. Within a year of separation Ahmed married Aneesa
in accordance toSsunni law. Aneesa came to know about the earlier relationship of Ahmed
and was distraught and left the house. She is four month pregnant.
a) Can riya claim maintenance for her daughters and herself? (7 Marks)
b) What are the remedies available to Aneesa? (4 marks)
c) What are the defenses available to Ahmed in the current scenario? (4 marks)
5. What do you understand by Talaq under Muslim Law? Differentiate it from Talaq-e-Tafweed

8. Ram Vilas was a Lower caste Hindu. He converts to Islam. After a few years he converts to
Hinduism. He now chooses the Brahmin caste. He starts following the Brahmin practices and

Brahmin community do not accept Ram Vilas as one of their own. Decide on the validity of
the re- conversion.
