JUDICIAL AFFIDAVIT
OF PEDRO D. BUTRON

I, PEDRO D. BUTRON, of legal age, Filipino, single, and a


resident Brgy. San Jose, Sierra Bullones, Bohol after having been
duly sworn to in accordance with law, fully conscious that I am
answering the following questions under oath, and that I may
face criminal liability for false testimony or perjury and said
judicial affidavit was conducted at the Provincial Prosecutors
Office, Tagbilaran City, Bohol which taking was done in English
language but are translated in the Cebuano dialect which I speak
and fully understand and that the other information or
requirements of Sec. 3, A.M. 12-8-8-SC as explained to me by the
administering officer, hereby deposes and states as follows:

PURPOSE

This affidavit of the witness, Pedro D. Butron is being


offered to prove that:
1. He was the one approached by Vicente Engbino to assist
the latter for help.
2. He was present at the Police Station to report the incident.
3. He was present during the investigation by the police at
the crime scene.
4. Other relevant information pertaining to the case.

1. Q: Please state your name and other personal


circumstances for the records.
A: I am Pedro Butron y Deli, 24 years of age, single, and
resides at Brgy. San Jose, Sierra Bullones, Bohol.

2. Q: Are you the same Pedro D. Butron, who is the witness


of this case?
A: Yes.
3. Q: Where were you at the early morning of August 10,
2019?
A: I was at Sitio Binintian, Brgy. Bugsoc, Sierra Bullones.

4. Q: What are you doing there?


A: I make a living there as a habal-habal driver.

5. Q: How long have you been a habal-habal driver?


A: Almost five years.

6. Q: What happened in the early morning of August 10 of


2019?
A: When I was in our stationed in Sitio Binintian, waiting
for passengers, Vicente T. Engbino came. ( in our association we
have a rotation on what Brgy. To stay)

7. Q: How do you know Vicente T. Engbino?


A: He was my passenger for five years in Barangay
Bugsok.

8. Q: What did he say to you upon his arrival?


A: He said to me that our friend Macario was dead and was
hacked by Julio Quieta. He said we need to go to the police
station to report. (arrival of Vicente Engbino around 5:30 a.m.)

9. Q: What happened next?


A: We went straight to the police station and reported the
incident. (15 min. travel time) (I used my motorcycle)

10.Q: What happened next?


A: Police Officer Marsilino Y. Kurat who was the desk
officer on duty at that time assisted us. After the blotter.
We went to Sitio Binitian with other three police officers
and officer Kurat himself. ( Officer Cotto, Officer Rebelyame and
Officer Padilla )

11.Q: What happened next?


A: While we were still on the road of Sitio Binintian,
Barangay Bugsok. Vicente saw Julio Quieta going towards
the way were we came from. Vicente then shouted; “Julio.
Looked, it’s Julio.”
12.Q: What happened next?
A: We stopped. We dis embarked from the vehicle and so
also the police officers who was behind us in their vehicle.
I saw Julio Quieta.

13.Q. How did you know it was Julio Quieta?


A. I know him because he is also my passenger in
Barangay Bugsok.

14.Q: What happened next?


A: The police investigator Kurat asked if he was Julio
Quieta who is the suspect of the alleged murder of Macario
Rosales.

15.Q: How did Julio replied?


A: He was not able to answer the question right away, then
he stuttered but eventually in a fear sound tone, he said,
“YES”.

16. Q: How did you describe Julio Quieta at that time?


A: He looked pale and nervous and there was some blood
stains on his (black) t-shirt . He was carrying a ( black)
backpack and wore only one part of slipper (right foot).

17.Q: What happened next?


A: The police who were with us handcuffed Julio, they get
back to the vehicle and we went straight to the place where
the incident happened.

18.Q: What happened next?


A: Upon arrival, I saw a body bath with blood on the
ground. The victim whore a white stripe shirt and a black
short pants and with slippers on his feet.

19.Q: How do you describe the area upon arrival?


A: The area was deserted. Tall grasses and plants were
visible and there were no houses nearby. It was also beside
a wide rice fields.

21. Q. What else did you see?


A. I saw a bolo and a part of the slipper (left pair of the slippers)
which I believed to be the one used by the criminal.
23. Q: What happened next?
A: The police cordoned the area and made investigation
and medic came over.

24. Q: What did Julio do that time?


A: He was in the vehicle and I can hear him crying. (his
handcuffed was tied in the bar of the vehicle)

25. Q: What happened next?


A: After the investigation. The police moved the body to
medic vehicle, then we went back to Poblacion. (went
to police station for the briefing that we will be the witness of the
case)

ATTESTATION CLAUSE

I, Prosecutor James C. Bermundo, hereby attest that I


faithfully recorded the questions propounded and the
corresponding answers given by the witness Pedro D. Butron. I
did not in any way coach or taught or instruct the witness on
how to answer or any other person or persons then present or
assisting the witness regarding the latter’s answers.
