JUDICIAL AFFIDAVIT
OF VICENTE T. ENGBINO

I, VICENTE T. ENGBINO, of legal age, Filipino, married,


and a resident of Brgy. Bugsok, Sierra Bullones, Bohol after
having been duly sworn to in accordance with law, fully
conscious that I am answering the following questions under
oath, and that I may face criminal liability for false testimony or
perjury and said judicial affidavit was conducted at the
Provincial Prosecutors Office, Tagbilaran City, Bohol,
Philippines which taking was done in English but are translated
in the Cebuano dialect which I speak and fully understand and
that the other information or requirements of Sec. 3, A.M. 12-8-
8-SC as explained to me by the administering officer, hereby
deposes and states as follows:

PURPOSE

This affidavit of the witness, Vicente T. Engbino is being


offered to prove the existence of the charged of murder against
the accused Julio B. Quieta based on the matters relayed by the
deceased Macario Rosales before his death and other matters
relevant to the case.

1. Q: Please state your name and other personal


circumstances for the records.
A: I am Vicente Engbino y Timbal, 35 years of age, married,
and resides at Sitio Binintian, Brgy. Bugsok, Sierra Bullones,
Bohol.
2. Q: Are you the same Vicente T. Engbino, who is the witness
of this case?
A: Yes.

3. Q: What is your job?


A: I am a Bus conductor.

4. Q: Where were you in the early morning of August 10,


2019?
A: I was at home in Sitio Binintian, Brgy. Bugsok preparing
for work.

5. Q: After preparing for work, what did you do next?


A: I started walking and around 5:15 in the morning, while
walking for some distance from my house. I saw a man
lying beside the tall grasses.

6. Q: What did you do?


A: I run closer towards the man.

7. Q: Upon reaching, what did you observe?


A: I noticed blood over the body and the man was
groaning.

8. Q: What happened next?


A: When I was about to extend my help, I was surprised,
because he looked like Macario Rosales.

9. Q: What happened next?


A: The man said to me that , “Julio Quieta” hacked him
suddenly out of nowhere and said “because of water” and
he breath deeply and his eyes close and he was not
breathing anymore.

10.Q: How did you know that the man who is lying down and
bloody is Macario Rosales?
A: He was my neighbor, and his shirt was familiar to me,
and he and Julio Quieta was the only neighbors next close
to our house.

11.Q: How long have you been neighbor’s with Macario


Rosales and what is the distance from your house to his
house?
A: We’re neighbors for five years. My house is 500 meters
away from his house.
12.Q: What else did you observe on the area of the crime
scene?
A: Tall grasses, footprints and a sharp bolo near the body
of Macario.

13.Q: What did you do next?


A: I run and look for help.

14.Q: Now, where did you go for help?


A: To a motorcycle (habal-habal) station.

15.Q: Upon arrival at the habal-habal station what happened


next?
A: Pedro Butron, a habal-habal driver was at the station. I
told him that Macario was dead and we need to go to the
Police Station to report.

16.Q: What happened next?


A: We went to the Police Station. Upon arrival, we reported
what I’ve saw and heard of what Macario Rosales said to
me before he died.

17.Q: What happened next?


A: The Police Officer who was named Marsilino Y. Kurat,
made the blotter of our report. Then after we went to the
crime scene in Sitio Binintian, Brgy. Bugsok with three
other police officers and also officer Kurat himself.

18.Q: What happened next?


A: When we were in Brgy. Bugsok, I saw Julio Quieta
walking towards our opposite direction, then I shouted his
name.

20. Q. What happened next?


A. We stopped and the police vehicle who was behind us
stopped also. I said to officer Kurat that the man is Julio, the
suspect.

21. Q. What happened next?


A: Officer Kurat interrupted Julio’s walking and then he
asked and narrated that an incident happened which
involved a certain Julio Quieta. Then he asked if his name
is Julio Quieta.

22.Q. What was his response?


A. He was not able to answer the question right away, but
eventually, he said, “YES” but answered he was not the
Julio they were looking for.

23. Q. What happened next?


A. Officer Kurat asked Julio if where he is going and why
there is blood on his shirt. He also asked why he is a
bringing a backpack and wore only a part of a slippers.

24.Q. What is his response?


A. He did not answer the question.

25.Q. What did you observe from Julio that time?


A: He looked pale and nervous and there was some blood
stains on his t-shirt. He was carrying a backpack and he only
wore one part of a slipper.

26.Q: What happened next?


A: After officer Kurat said something, the police officers who
was with us handcuffed him. Then they get him in to the
vehicle. Then after we went to the area where the crime
happened.

27.Q.Upon arrival at the crime scene what else did you notice?
A. The police officers secured a part of a slipper which is
similar to the part of slipper wore by Julio Quieta during our
encounter at the road.

28.Q: What happened next?


A: After the investigation of the police they lift the body of
Macario and they put it on the vehicle of the medic team then we
went after to the police station in poblacion.

29.Q: As neighbors of both the accused and the victim, what


issues if any, have you know between the two?
A: I just heard from both of them, when we had conversation
that they had problem on each other on water supply of their rice
fields.

how to answer or any other person or persons then present or
assisting the witness regarding the latter’s answers.
