1.2. Annexure-II: Rent Agreement format

WHEREAS
A. The Lessor is the absolute and rightful owner in possession of the premises bearing

referred to as the “Demised Premises”) with clean and unrestricted right to let out the
demised Premises and is legally competent to enter into this agreement;

B. The Lessor is the owner of the fixtures and fittings within the Demised Premises.
C. The Lessor has agreed to let out on rent the Demised Premises along with the fittings and
fixtures to the Lessee on the following terms and conditions, which have been mutually
agreed upon.
NOW THIS AGREEMENT WITNESSETH AS FOLLOWS:-

1. The agreement shall be valid for a period of _____ months commencing from ………… to
…………………..The agreement shall be renewable for a further term of ____ months by
mutual agreement by giving one month’s prior written notice to the Lessor before the expiry of
the initial Agreement Period.

2. The India Post Payments Bank shall pay to the Lessor for the Demised Premises along with
the fixtures and fittings a monthly rent of Rs ………………….. (Rupees
………………………………. Only) the rent in advance/on completion of month by
cheque/draft/RTGS/NEFT shall be paid by the seventh (7th) day of each English calendar
month.
3. That the IPPB shall pay to Lessor Rs. ………………… (Rupees……. ……………………
………………………………………. only) as the Security deposit. The security Deposit shall be
refunded by the Lessor to the Lessee at the time of handing over of the peaceful vacant
possession of the entire Demised Premises with all fittings and fixtures without encumbrances
and after the lessor has appropriated all sums due from the lessee upon expiry or earlier
termination of the Agreement.
4. The premises, shall be used for the purpose of residence exclusively for the lessee and
members of his family, including for temporary stay of relatives and personal friends. No
commercial activity to be undertaken in the premises, whatsoever.
5. The Lessee shall pay all the charges for the consumption of electricity and water in the
Demised Premises during the agreement period levied by the government authorities from
time to time on the basis of actual consumption as per the meter readings on the receipts of
bills. The original receipts of the bills after payments will be sent to the Lessor for keeping the
same and the photocopy will be kept by the Lessee. The Lessee shall however not be liable
for outstanding of any kind whatsoever for the period prior to the commencement date of the
agreement period or after the expiry of earliest termination of the agreement.
6. That the Lessee shall not carry out any structural addition or alterations in the Demised
Premises without the consent of the Lessor in writing, however, minor changes which do not
make any structural alterations shall be permissible by the Lessee.
7. That the Lessee shall permit the Lessor or his authorized agents to enter upon the Demised
Premises for inspection after completion of 6 month of the agreement with the prior
appointment and consent of the Lessee and in the presence of a representative of the Lessor.
8. That the Lessee and the Lessor shall comply with all the Rules, Regulations and Bye Laws of
the local authorities/municipal authorities or any Statutory development authority or a
Government department or Agency with relation to the Demised Premises.
9. That the Lessor shall pay all taxes etc. applicable to the property to the authorities and all fixed
monthly maintenance charges, if any payable to the society (other than water, electricity etc.
which shall be paid directly by the lessee to the society) required to be paid in relation to the
Demised Premises.
10. That all minor repairs to the extent of Rs 200/- (Rupees Two hundred only) such as leakage in
the sanitary fittings, water taps and electrical malfunctioning and usage, Air Conditioner’s
servicing, regular servicing of the Reverse Osmosis unit and the other furniture and fittings
shall be carried out by the Lessee. Repairs, if any required above Rs 200/- shall be under
taken by the Lessor.
11. That the Lessor and Lessee shall be entitled to terminate the agreement at any time during
the agreement period serving one month’s prior notice in writing at the above said addresses
of the Parties to this Agreement, i.e. Lessor & Lessee.
12. The demised premises consist of the functional fittings and fixtures as described in detail in
the enclosed Annexure at the end of this Agreement, which is part and parcel of the
Agreement. In case the walls or any other fitting or fixture is defaced or damaged by the
Lessee, which is beyond the usual wear & tear with the usages, the Lessee has to restore
them to the similar condition before vacation. In case at the time of termination of rent
agreement the Lessee does not restore the normal condition, then the Lessor would be entitled
to recover the cost of the same from the security deposit.
13. In case there are no damages or defacements and the premises are returned in the similar
condition, the Lessor shall refund the security deposit at the time of vacating the demised
premises.
14. The Lessor to the satisfaction of the Lessee has had the Demised Premises, distempered,
painted and polished at the cost of the Lessor, before the commencement of the agreement
period. Further, if the Lease Period is extended beyond the Agreement period in question, prior
to commencement of extended period the Lessor will get the demised premises distempered,
painted & polished to the satisfaction of the Lessee.
15. That any notice required to be served upon the Lessee/Lessor shall be sufficiently served and
given if delivered to it at the address given herein above and duly acknowledged by the Lessor
/Lessee.
16. If the Lessor at any time during the initial agreement period of this agreement sells and/or
transfers his rights in the whole or in part(s) of the Demised Premises to any person or persons,
then in that event, the agreement shall attorn to such transferee or transferees on the same
terms & conditions as are contained herein. However, the Lessor shall ensure that a letter is
issued by the prospective new landlord/owner or transferee in favour of the Lessee confirming
that the terms herein agreed to shall be binding on the new Landlord/ Owner/ transferee in
favour of the Lessee and that the new Landlord/Owner/transferee will also acknowledge that
he/she will be liable to refund to the Lessee the interest free security deposit as above said
paid by the Lessee to the Lessor.
17. All disputes, differences and questions of any nature which at any time arise between the
Parties to this agreement or their respective representatives and assigns in relations to the
construction of or concerning anything contained in or arising out of this Agreement or as to
the rights, duties or liabilities of the Parties to the agreement and of their respective
representatives shall be referred to and finally settled by Arbitration proceedings in terms of
the Arbitration & Conciliation Act,1996, which shall be held at Delhi.
18. That in the event of dispute, if any, the agreement is subject to the jurisdiction of the courts in
Delhi.
19. Both the lessor and lessee represent and warrant that they are fully empowered and authorized
to make this agreement.
20. The Lessor would need to provide his/her identification, photograph and signature proof to the
lessee at the time of signing of the agreement.
