AFFIDAVIT OF ADVERSE CLAIM

THAT I, CRISELDA O. EBIO, married, Filipino citizen, of legal age, with


residence at Brgy. Bancod, Indang, Cavite, after having been duly sworn to in
accordance with law, depose and say:

THAT I am one of the children and compulsory heirs of the late PEDRO C.
OCAMPO who died on March 05, 2017;

THAT during his lifetime, he had executed a Notarial Will that would govern
and control the entire disposition of his estate;

THAT as expressly stated in his Notarial Will1, he is allocating to LUISITO


OCAMPO, my brother and also a compulsory heir, two (2) parcels of unregistered
land as his share to his estate;

THAT it has come to my knowledge that LUISITO OCAMPO has already


been negotiating with prospective buyers for the sale of the aforementioned parcels
of land without our conformity or consent, and in the absence of a probate
proceeding;

THAT worse, he had already transferred the said parcels of land under his
name, previously covered by Tax Declaration No. 10 0009 00487 and Tax Dec No. 10
0009 00520, and are now registered under the following Tax Declarations in the
name of LUISITO OCAMPO:

TAX DECLARATION NO. 10-0009-01342

“ Lot No. 10169 located in Brgy. Bancod Indang, Cavite; x x x


x containing an area of SEVEN HUNDRED FORTY FIVE (745),
more or less.”

TAX DECLARATION No. 10-0009-01222

“Lot No. 15541 located in Brgy. Bancod Indang Cavite, xxxx


containing an area of ONE THOUSAND ONE HUNDRED
NINETY SQUARE METERS, more or less

THAT in the same manner, LUSITO is now claiming for my share in the
estate of my father and demanding that he is entitled thereto completely
disregarding the wishes of my deceased father;

THAT to legally enforce the wishes of my father, I am now left with no other
recourse but to undertake the filing of petition for probate proceedings and judicial
partition of his estate;

THAT under the law, it is clear that Probate is mandatory, which means that
no will passes either real or personal property unless it is proved and allowed in a
proper court;

THAT because of this probate proceeding, all the properties of my father,


which belongs to his estate based on his Notarial Will, should be first inventoried
and collated, and thus, any further distribution and allocation to be made by
LUISITO would unduly hamper and frustrate the proceedings;

THAT I execute this affidavit of adverse claim to attest to the truth of the
foregoing declaration and to pre-empt whatever disposition or alienation that may
be undertaken by my co-heir of the subject parcelsof land that would result to my
damage and prejudice, in the absence of probate and judicial partition proceeding;

THAT I therefore request the Provincial Assessor’s Office and Municipal


Assessor’s Office of Indang, Cavite to annotate this Adverse Claim on the face Tax
Declarations No. 10-0009-01342 and Tax Declaration No. 10-0009-01222 .
