MOTION FOR PERMANENT DISMISSAL

COMES NOW movant-accused, by himself, and unto this Honorable Court,

most respectfully states that:

1. On 22 October 2018, an Order was issued by this Honorable Court

dismissing the instant case provisionally. A copy of the Order is hereto
attached and made an integral part hereof as Annex “1”;

2. More than one (1) year had already elapsed from the issuance of the
said order and the private complainant has not filed any motion to
revive the instant case;

3. Considering that it is more than one (1) year that the instant case was
provisionally dismissed without the private complainant having filed
the necessary motion to revive, the accused respectfully moves that the
instant case be permanently dismissed;

WHEREFORE, it is most respectfully prayed of this Honorable Court that

an Order be issued permanently dismissing the instant case and the cash bond
posted be ordered released in favor of the accused.

Other reliefs are also prayed for
