DEED OF UNDERTAKING

KNOW ALL MEN BY THESE PRESENTS:


I, NORMALINDA VILLAMIN, of legal age, Filipino, married, and a resident of
Poblacion, Dauin, Negros Oriental, after being sworn to in accordance with the law, do hereby
states that:
1. I am one of the Heirs of Aquilina Tuboran, owner and registered title holder of
Original Certificate of Title (“OCT”) No. F-V-9352 issued pursuant to Free Patent
No. 446125 on June 10, 1989.
2. The duplicate original title of the above OCT was lost and I executed an Affidavit of
Loss on November 29, 2021 and the same was annotated on the OCT likewise on said
date with Entry No. 2021004134.
3. I had caused the sale of this parcel of land under OCT No. F-V-9352 with an area of
4,333 sqm to Spouses Josephus Charles Guadez and Janice C. Guadez on September
01, 2021
4. I am aware that ANDREW SIMON FRIEL of legal age, single, US Citizen and with
residence address at #1501/100 Benavidez Makati City, 1226 had FUNDED the
purchase of the property by Sps. Guadez who in turn executed a Memorandum of
Agreement dated June 16, 2021 recognizing their loan from Mr. Friel of P6,500,00
for the purchase of this property and binding themselves to issue an Irrevocable
Special Power of Attorney in favor of Mr. Friel granting him administrative rights of
using, renting, introducing improvements and if necessary, selling the property.
5. I agree to cooperate and assist Mr. Friel in filing and litigating a Petition for
Reissuance of a Duplicate Original of Title of subject property.
6. I agree to turn over or to bind / instruct my lawyer to turn over possession of the
reissued Duplicate Original of title to Andrew Friel as security for the debt of Sps.
Guadez to the latter.
