TENDER NOTICE
Sealed offers are invited from Reputed Consultancy Firms / Individuals for Consultancy
Service for installation of Roof Top Solar PV Plant at Bank’s own buildings at various
places across the country with target of installation of solar PV with aggregate capacity of
approx.. 200 Kwp under "two bid" system i.e Technical bid and Price bid.
Tenderers are advised to go through this tender document carefully as well as visit the
Bank’s office premises at Gurugram and acquaint themselves with the site and present
condition of building and system, etc. before submission of tender.
As bid to be applied through e-tender, hence hard copies be marked Technical Bid in a
cover marked 'Offer for Consultancy Services for installation of Roof Top Solar PV
Plant' and be dropped in the Tender Box installed on ground floor behind reception of our
corporate office and soft copies of all documents to be uploaded in e-tender site. The
Bank will not be liable for Bids lost in transit. Tenders not dropped in the tender box
or received beyond 3.00 pm on 14.08.2019 will not be considered.
The technical bids will be opened at 3.30 p.m. on the last date of submission of Tenders
on 14/08/2019 in the presence of bidders or duly authorized representatives of the
bidders, who wish to be present.
The financial bids will be opened at e-tender site only for the bidders who have met the
qualifications laid by the Bank on a later date. Successful bidders will be informed
separately. No correspondence in this regard will be entertained.
This Tender will follow e-Tendering process [e-bids] as under which will be conducted
by Bank’s authorized e-Tendering Service Provider M/s Antares Systems Ltd. through
Website https://www.tenderwizard.com. Following activities will be conducted online
through above website:
a) Submission of Technical Bid & Commercial Bid by the Vendor(hard copies to
be submitted to bank in form of technical bid in sealed envelope)
b) Opening of Technical Bid by the Bank
c) Clarification, if any, sought by the Bank.
d) On-line evaluation by the Bank.
Bidders who wish to participate in e-Tender need to fill data in predefined forms of RFP,
Technical, Price bid available in respective tender only.
After filling data in predefined forms bidders need to click on final submission link to submit
their bid.
I. The offers submitted shall be valid for a period of 120 days from the last date for
submission of tender.
II. Oriental Bank of Commerce reserves the right to reject any / all tenders
without assigning reason thereof.
Tenders received late on account of any reason or by courier/post will not be entertained.

I/We hereby submit application for Consultancy Service for installation of Roof Top Solar
PV Plant at Bank’s owned buildings at various places across the country in the prescribed
format for your consideration.
2.1 That I/We have carefully examined all the contents incorporated in various parts
of this tender document.
2.2 That all the statements made and information supplied in the enclosed forms
and accompanying statements are true and correct.
2.3 That I/We have furnished all information and details necessary for
prequalification and have no further pertinent information to supply.
2.4 That I/We authorize Oriental Bank of Commerce to approach individuals, Banks,
firms and corporation to verify our competence and general reputation
2.5 That I/We submit the certificates in support of our suitability and technical
know-how.

Oriental Bank of Commerce, one of the premier Public Sector Banks, invites tenders for
Consultancy Service for installation of Roof Top Solar PV Plant at Bank’s owned buildings
at various places across the country on the following terms and conditions:
3.1.1 Interpretation:
3.1.1.1 Bank: The term Bank shall denote 'Oriental Bank of Commerce' with their
Corporate Office at Plot No. 5, Sector 32, Institutional area, Gurgaon and any of
its employees representatives authorized on their behalf.
3.1.1.2 Consultants: The term Consultant shall mean ________ (Name and address of
the Consultant) or in the event of his/their ceasing to be Consultants for the
purpose of this contract such other person/s as the Bank shall nominate for the
purpose. The Consultant with the approval of the Bank may engage a local
Consulting Engineer for supervision and co-ordination of the work at the site.
3.1.1.3 Consultancy Services: Consultancy services mean and include services related
to survey of area, design of suitable solar energy system as per statutory norms,
preparation of initial and detailed estimates, detailed drawings, preparation of
tenders, inviting the tenders, comments on tenders received, site supervision,
approval from authorities, checking of bills, obtaining final clearance certificates
from statutory authorities, if any and other related services generally rendered by
Consultants.
3.1.1.4 Contractor: The term contractor shall mean the agency selected for installation of
Solar Power system and allied works after tendering and his/their heirs, legal
representatives, assigns and successors.
3.1.1.5 Site: The site shall mean the site where the works are to be executed including
any building and erection thereon allotted by the Bank for the contractor's use.
3.1.1.6 Drawings: The work to be carried out in accordance with drawings,
specifications, the schedule of quantities and any further drawings which may be
supplied or any other instruction, which may be given by the Bank during the
execution of the work. All drawings relating to work given to the contractor
together with a copy of schedule of quantities are to be kept at site and the Bank/
Consultant/ Contractor shall be given access to such drawings or schedule of
quantities whenever necessary.
3.1.1.7 Work: The work shall mean the work or works to be executed under this project.
3.1.1.8 Act of Insolvency: The Act of Insolvency shall mean any act such as defined by
the Presidency Towns Insolvency Act or in Provisional Insolvency Act or any
amending statutes.
3.1.2 Language of Bid should be English or Hindi.
3.1.3 The rates should be quoted both in figures and words. In case of the difference
between two, the amounts written in words would be considered.
3.1.4 It is essential to submit attested documents in support of the pre-qualification
criteria as mentioned in the documents.
3.1.5 In case of non adherence of the Formats or partial submission of bids, the bid may
not be evaluated.
3.1.6 Each Page of the document shall be signed by the tenderer.
3.1.7 Any overwriting or corrections made shall be duly signed by the tenderer.
3.1.8 Withdrawal/ Amendment in the bids: The Bank reserves the right to accept or
reject one/all proposal(s), to amend the tender terms, to request one or more
resubmission/clarifications from one or more tenderers, or to cancel the process in
whole or part.
3.1.9 The bank also reserves the right to amend the conditions related to consultancy
services at any point prior to last date of tender submission. The bank may, for
any reason, whether at its own initiative or in response to clarification(s) requested
by a prospective tenderer, modify the content of this document by amendment.
Amendment will be notified on the bank's website and will be binding on all
participating tenderers. No individual instruction shall be given in this regard. The
bank shall not be liable for any communication gap. In order to provide prospective
tenderers, reasonable time to take the amendment into account for preparation of
their bid, the bank may, at its discretion, extend the last date for bid submission

3.1.10 Force Majure: This process may be terminated or can be cancelled if event like,
but not limited to, by Acts of God or of Public Enemy, Acts of Government of
India/State in their sovereign capacity, acts of war, fire, floods, strikes, lock outs
etc, occurs.
3.1.11 Only the selected bidder would be intimated by way of Letter of Intent and the
selected bidder consultant shall enter into an agreement with Bank within 15 days
of dispatch of Letter of Intent, failing to which, it will be considered that the
Consultant has no intention for acceptance of work.
3.1.12 In case the selected bidder consultant fails to enter into an agreement as
stipulated in the forgoing clause, it would be the absolute discretion of the Bank to
choose another bidder who stands second in the order of merit in the reckoning of
the Bank or to cancel/revoke the whole bid process and initiate fresh bid process.
3.1.13 It may be noted that too low fee quoted shall be viewed with circumspection and
the tender may be rejected.
3.1.14 In case of a tie, the bank reserves the right to choose any one of the tenderer
based on merit without stating reasons.
The Bank intends to install a Roof Top Solar PV Plant at its owned buildings at various
places across the country with a target of installation of approx.. 200 Kwp during 2019-20.
The capacity of plant can be increase on the basis of the available place for PV Cells.
The consultant shall render the following services (not limited to) in connection with the
project:
a) Taking Bank's instructions, visiting the site, preparing schematic designs which shall
be in accordance with local governing codes/ standards, regulations, etc. (including
carrying out necessary revisions till the schematic designs are finally approved by
Bank), The Consultant will evaluate the space available in bank’s own buildings &
suggest for which model is suitable and in case of CAPEX model to be adopted, he
shall design the system, prepare specifications, prepare estimate & Bill of quantities,
assist in selection of contractor & obtaining approvals from local authorities,
supervise the execution of work, recommend for payment.making approximate
estimate of cost, area measurement, or otherwise and preparing reports on the
scheme so as to enable the Bank to take a decision on the sketch designs.
b) Submitting a proper CPM chart / Bar Chart incorporating all the activities required
for the completion of the project well in time, i.e., preparation of working drawings,
detailed drawings, calling tender, etc. The programme should also include various
stages of services to be done by consultants in co-ordination with the Consultant.
c) Submitting required drawings to authorities and obtaining their approval if
necessary.
d) Preparing working drawings, detailed estimates and all such other particulars as
may be necessary for preparation of bill of quantities.
e) Preparing pre-qualification documents and detailed tender documents..
f) Preparing tender notices for issue by Bank or inviting tenders from prequalified/
shortlisted parties on behalf of Bank, as the case may be for all trades and
submitting assessment reports thereon, together with recommendations specifying
abnormally high and low rated items. Preparing contract documents for all trades
and getting them executed by the concerned contractors.
a. The assessment report shall be based on proper analysis of rates with
constants from an approved Standard Hand Book and market rates.. All
conditions shall be evaluated in financial terms instead of merely saying
whether a condition may be accepted or not.
b. When conditions are not susceptible of evaluation, the alternative procedure
of calling all the tenderers for negotiation and asking them to submit a final
bid based on the terms and conditions accepted to the Bank may be
adopted.
g) Preparing for the use of the Bank, the contractor and site staff, 4 copies of contract
documents for all trades including all drawings, specifications, and other particulars.
Preparing such further details and drawings as are necessary for proper execution
of the works.
h) Assuming full responsibility for supervision and proper execution of all works by
General and Specialist Contractors who are engaged from time to time, including
control over quantities during the execution to restrict variation, if any, to the
minimum.
i) No deviations or substitutions should be authorized by the consultant without
working out financial implication, if any, to the contractor and obtaining approval of
the Bank. However, where time does not permit and where it is expedient, the
consultant may take decisions on behalf of the Bank, the total cost of the
item/deviation of which should not exceed Rs. 10,000/-. This deviation shall be got
subsequently ratified from the Bank duly justifying his action at the earliest.
j) Checking measurements of works at site, checking contractor's bills, issuing
periodical certificates for payments, and passing and certifying accounts, so as to
enable the Bank to make payments to the contractors and adjustments of all
accounts, so as to enable the Bank to make payments to the contractors and
adjustments of all accounts between the contractors and the Bank. Consultants
shall assume full responsibility for all measurements certified by them. It shall be
mandatory on the part of the Consultant to check the measurements of various
items to the extent of at least 25% of each item of work claimed, in each running
bill.
Certified that the various items of work claimed in this ______ running bill/ final
bill by the contractors ______________________ have been completed to the
extent claimed and at appropriate rates and that the items are in accordance
with and fully confirming to the standard/ prescribed specifications and drawings.
We further certify that we have checked the measurements to the extent of 100
percent of each item claimed in this bill. Hence, the bill is recommended for
payment of Rs. _________
NOW THIS DEED WITNESSETH and the parties hereto hereby agree as follows:
1. The Bank agrees to pay the Consultants as remuneration for the professional
services to be rendered by the Consultants in relation to the said project
particularly
for the services hereinafter mentioned, a fee calculated at ___ % + GST (as
applicable) of the actual cost of work/ accepted tender cost, whichever is less.
The said fee being hereinafter called as "Basic Fee". In case there is an
escalation in the actual project cost over the accepted tender cost, the payment
to the Consultant shall be worked out as below:
a) 100% of the Basic Fee on the accepted tender cost plus
b) 50% of the Basic Fee on the escalated cost over & above the accepted
tender cost.
Subject to a ceiling of 110% of the Basic Fee worked out on the accepted
tender cost.
2. i) The Consultant shall take the Bank's instructions, prepare sketch designs,
make
approximate estimate cost, prepare drawings sufficient for making applications
or
other licenses to local authorities or for other approvals, prepare working
drawings,
prepare specifications, prepare bills of quantities, and detailed estimate with rate
analysis, prepare tender documents, advise on preparation of a panel of
contractors
to be invited for tendering, assist in obtaining tenders, advise on tenders
received,
prepare contract documents, nominate and instruct consultants (if any),
coordinate
5. The Bank shall pay to the Consultants their basic fee in the following manner:
Total fee calculated ___ % + GST of the total cost of work, subject to the
ceiling given in clause 1.
a) Progressive payment will be made on the basis of cost of works done and
shall be linked to payment made to the contractor.
b) The fees will be paid by NEFT/RTGS
7. i) The Consultant shall give total supervision with complete execution responsibility
as mentioned in para 2. ii) before.
ii) The Bank may employ a local Consulting Engineer if required who shall assist the
principal Consultants in the following manner:
a) Study drawings submitted by the Consultant at different stages and point out
any discrepancy therein and suggest any amendments to suit site or local
conditions or local bye-laws.
b) Submit drawings to authorities and obtain approval thereon.
c) Co-ordinate all construction activities including supervision and measurement
at site and keep the Consultants informed regarding progress of the work by
submitting regular progress reports.
iii) The Consultants shall not make any material deviation, alteration, addition to or
omission from the approved design without the knowledge and consent of the Bank.
iv) Copy-right in all drawings and in the works executed from them will remain the
property of the Consultants.
v) The fees and charges payable to the Consultants shall be in accordance with the
Scale of Charges (Clause 6).
8. In case of any dispute between the Consultant and other agency, the matter shall be
referred to the Bank whose decision shall be final and binding on all parties.
9. In case it is established that due to fault of Consultant the Bank has to pay extra
amount due to over-run of the Project, over measurements- faulty description of
tender item or any other lapse on the part of Project Consultant necessary recovery
may be effected from the Project Consultant's fee as per provision of section 73 of
Indian Contract Act.
10. In the event of any dispute, difference or question arising out of or touching or
concerning this agreement or the execution of the project, the same shall be
referred, at the opinion of either party (Bank or the Consultants), to the arbitration of
a sole Arbitrator mutually agreed upon, and in default of such agreement to the
arbitration of two arbitrators, one each appointed by the two parties; who in default
of mutual agreement may in turn appoint an umpire. The arbitrator or arbitrators or
umpire, as the case may be, will be Fellows of the Indian Institute of Architects or
Fellow of Institution of Engineers (India). Such submission shall be deemed to be a
submission to arbitration within the meaning of the Indian Arbitration Act, 1940 or
any statutory modifications thereof. The award of the arbitrator(s) or umpire, as the
case may be, shall be final and binding upon the parties. The total cost of arbitration
is to be borne by all the concerned parties in equal ratio. The arbitration shall be
held at Head Office of the Bank.
11. This agreement can be terminated by either party on giving 3 month's notice
normally. However, in exigent circumstances, the services of the Consultant can be
terminated by the Bank by giving notice of lesser period.
12. The consultant will confirm that there is no link between the contractor and his
agency and his employees and sign the undertaking on stamp paper as per Bank's
format.
IN WITNESS WHEREOF the parties hereto have hereunto set their hands the day and

The bidder should have local office / branch office at Delhi/ NCR.
Minimum one Solar PV plant executed shall be of 200 Kwp or above, in the same
name.
OR
Minimum three Solar PV plant executed shall be of Rs. 120 Kwp. or above, in the
same name.
NOTE: Criteria mentioned above are just minimum requirement. The Bank at its
discretion may upgrade the criteria. No complaint on this account will be entertained.
Necessary details and documentary proofs, photographs of completed works have to
be enclosed with the application.
Selection of the Consultant will be done through technical evaluation of the details
submitted by the applicants, visit to their completed sites and confidential reports from
their clients.
Price bids of the consultants who fulfill the prequalification criteria and shortlisted on the
basis of site visits & confidential reports will be opened in the presence of the bidders
who wish to remain present.
