JUDICIAL AFFIDAVIT

I, TRISTAN H. JABINIGAY, 21 years old, single and a resident of

Brgy. Poblacion, Guimbal, after having been duly sworn to in accordance with
law, hereby depose and state:

PRELIMINARY STATEMENT

That I am being questioned by ATTY. FLYNN AGUILAR, with

business address at 3 Floor, JML Bldg.Jaro, Iloilo City. The questioning is

being held at the same address. I am answering his questions fully conscious
and that I do so under oath and may face criminal liability for false testimony.

QUESTION AND ANSWER

1. Q : What is your purpose in coming voluntarily to this Office?

A : I wanted to testify on the incident that happened last December
24, 2018 at Brgy. Poblacion, Guimbal.

2. Q : What is your relationship with Maria Fina Baniaga Y Alonzo?

A : I am her neighbor at Brgy. Poblacion, Guimbal for almost a year.

3. Q : Where were you at the time of that the incident happened?

A : I am in my living room watching Ang Probinsyano.

4. Q : Did you notice anything at that time?

A : I heard a voice of a man, shouting in front of the house of Fina.

5. Q : What did you do?

A : I hurriedly went outside of my house to see what is happening.

6. Q : What did you see when you went outside of your house?
A : I saw a guy holding a nearly emptied Johnnie Walker bottle while
pointing at the house of Fina.

7. Q : Do you know the guy?

A : Yes. He was Mr. Jose Andres Baniaga y Rizal, the husband of Ms.
Fina. Fina once told me about him and showed me his picture.

 8. Q : What happened next?
A: I heard Mr. Jose, while pointing on the direction of the house,
shouting again “Hoy bigaon nga Fina. Wala ka huya nga asawa.
Gin-guba mo kabuhi ko. Ibalik diri bata ko. Mga wala kamu pulos
ka pamilya mo.”

9. Q : What did you notice next?

A : The scene continued until I heard the siren of the police and came
a police car. Two uniform personnel alighted from the vehicle and
apprehended Mr. Jose.

10.Q : Do you have anything more to say?

A : None sir.

11.Q: Are you willing to sign this affidavit to attest the truthfulness of
the same?
A : Yes sir.
