PETITION

The City Legal Office of Davao City and in behalf of the City of
Davao, unto this Honorable Court, respectfully avers that:

1. MARCELITO M. MARSHAL, a Filipino citizen, and resident of the City

of Davao, Davao del Sur, died intestate in the said City on January 18,
2020.

2. At the time of his death, he left real a property in the City of Davao,
particularly described to wit:

TRANSFER CERTIFICATE OF TITLE NO. 149-2014001269

“Lot No: 3 Block No. 2 Plan No. PCS-

112402-005802 xxx Location: Barrio Hayahay,
Barangay of Marilog, City of Davao,
Philippines. xxx AREA: FIVE THOUSAND
SIX HUNDRED THIRTY TWO SQUARE
METERS (5,632 sq. m.), more or less.”

3. He left no heir/s or persons who by law are entitles to inherit his real
property.

PRAYER

 WHEREFORE, it is most respectfully prayed that, upon due notice
and hearing, and after the payment of his just debts and charges, the estate of
the deceased MARCELITO M. MARSHAL be declared escheated in favor
of the Government in accordance with law.

commenced any other action involving the same issue in the Supreme
Court, the Court of Appeals or any other tribunal or agency; (b) to the
best of my knowledge, no such action or proceeding which is either
